Standard provision about industry, territorial (regional, city, district) council on labor and social problems

Chapter 1. General provisions

1. This Standard provision determines the purposes, tasks and functions industry, territorial (regional, city, district) council on labor and social problems (further - council), legal and organizational basis of its activities.

2. Council is created for the purpose of implementation of interaction of republican state bodies or local executive and administrative organs (further - state bodies), the corresponding associations of the employers and labor unions which are the parties of council (further - the parties of council), on realization of social and economic policy, protection of the labor, social and economic rights and interests of citizens at the industry and local levels.

3. Council in the activities is guided by the Constitution of the Republic of Belarus, the Presidential decree of the Republic of Belarus of July 15, 1995 No. 278 "About development of social partnership in the Republic of Belarus" (Collection of presidential decrees and resolutions of the Cabinet of Ministers of the Republic of Belarus, 1995, No. 21, the Art. 485), other acts of the legislation of the Republic of Belarus, including this Standard provision, and also the principles of social partnership.

Chapter 2. Purposes, tasks and functions of council

4. The purposes of council are:

development of the general principles of carrying out the approved social and economic policy directed to protection of the labor, social and economic rights and interests of workers of the corresponding industry, area (the city, the area), increase in level of living of the population;

development of social partnership in industry, area (city, area).

5. Tasks are assigned to council:

ensuring participation of the parties of council in development and implementation of tariff (industry), local agreements, realization of the social and economic policy directed to protection of constitutional rights of citizens, their economic and social interests;

the analysis of situation in the social and labor sphere of industry, area (the city, the area), accomplishment of tariff (industry), local agreements by the parties, work on development of social partnership in industry, area (the city, the area);

ensuring constructive interaction and cooperation of the parties of council within system of social partnership, coordination of their actions for accomplishment of the undertaken obligations.

6. Council performs the following functions:

considers projects of the regulatory legal acts governing the social and labor relations;

participates in project development of tariff (industry), local agreements and actions for their realization, and also exercises control of the course of accomplishment of such actions;

coordinates and analyzes work in industry, area (the city, the area) on the conclusion of agreements and collective agreements, gives information and methodical help to employers and labor unions in their development and accomplishment;

holds consultations and negotiations on urgent labor and social and economic problems of development of industry, area (the city, the area), to questions of preparation, the conclusion and accomplishment of tariff (industry), local agreements;

develops and takes measures for development of social partnership in industry, area (the city, the area), expansion of practice of collective and contractual regulation of the social and labor relations, practical use of scientific developments and recommendations in the sphere of the social and labor relations;

promotes settlement of the disagreements arising in the course of collective contractual relations in industry, area (the city, the area).

Chapter 3. Rights of council and its members

7. For accomplishment of the tasks assigned to council it is granted the right:

coordinate collateral actions of the parties of council on realization of the approved social and economic policy, to development and accomplishment of tariff (industry), local agreements, to make offers on their change and amendment taking into account situation in the social and labor sphere of industry, area (the city, the area);

hear information of officials concerning the social and labor relations;

perform monitoring of the course of accomplishment by the parties of tariff (industry), local agreements;

receive according to the procedure, established by the legislation, from state bodies, associations of employers and labor unions information on the course of accomplishment of tariff (industry), local agreements, economic and social situation in industry, area (the city, the area), the organizations, and also about the work which is carried out on enhancement of social partnership;

recommend representatives of council for inclusion in structure of the commissions on preparation of forecasts of social and economic development of industry, area (the city, the area), projects of regulatory legal acts and state programs, to consider relevant proposals at meetings of council;

create of number of agents of the parties of council working groups for introduction of offers by preparation of drafts of decisions of council, tariff (industry), local agreements, the regulatory legal acts affecting the labor, social and economic rights and interests of the citizens developed at the level of industry, area (the city, the area), and also in case of need to hold conciliatory meetings for settlement of the disagreements arising by preparation of the specified projects;

inform the public, National council on labor and social problems on the work on enhancement of interaction of state bodies, associations of employers and labor unions on realization of social and economic policy which is carried out to industries, area (the city, the area), to light activities of council in mass media;

involve in preparation of the questions submitted for consideration of council with the consent of the corresponding heads of representatives of state bodies, employers and labor unions, to create working groups and the commissions of their number;
