1. Approve the enclosed Rules of provision to the employee of diplomatic service of lump money payment in case of the injury of health received by the employee of diplomatic service or the member of his family living together with it during work of the employee in diplomatic representation, consular establishment of the Russian Federation or representation of the Russian Federation in case of international (interstate, intergovernmental) the organizations as a result of act of terrorism or other actions of violent nature.

2. Financial provision of the payment commitments arising in connection with implementation of this resolution is performed within the budgetary appropriations provided to the Ministry of Foreign Affairs of the Russian Federation in the federal budget for the corresponding financial year on content of the foreign office of the Ministry.

3. This resolution extends to the legal relationship which arose since January 1, 2012.

1. These rules determine procedure for provision to the employee of diplomatic service of lump money payment in case of the injury of health received by the employee of diplomatic service or the member of his family living together with it during work of the employee in diplomatic representation, consular establishment of the Russian Federation or representation of the Russian Federation in case of international (interstate, intergovernmental) the organization as a result of act of terrorism or other actions of violent nature provided by part 7 of article 14 of the Federal law "About Features of Passing of Federal Public Civil Service in System of the Ministry of Foreign Affairs of the Russian Federation" (further - payment), and also the amount of payment.

2. Payment is estimated proceeding from monthly salary (in rubles) the employee of diplomatic service according to the position of Federal public civil service and the monthly salary (in rubles) according to (diplomatic rank) appropriated by the class rank of Federal public civil service established to the employee of diplomatic service on the date of payment replaced by it (further - salary of monetary pay).

3. Payment is provided depending on extent of disability of the employee of diplomatic service or the member of his family living together with him in the following sizes:

12 salaries of monetary pay - in connection with damnification to health, entailed temporary disability from 2 to 4 months without disability establishment;

20 salaries of monetary pay - in connection with damnification to health, entailed temporary disability more than 4 months without disability establishment;

30 salaries of monetary pay - in connection with establishment of disability of III group;

60 salaries of monetary pay - in connection with establishment of disability of the II group;

84 salaries of monetary pay - in connection with establishment of disability of the I group.

4. Payment is provided based on the statement and documents confirming the term of temporary disability or group of disability, represented by the employee of diplomatic service or the member of his family living together with it or their legal representative to the Ministry of Foreign Affairs of the Russian Federation for the solution of question of payment provision.

The statement and documents attached to it submitted to the Ministry of Foreign Affairs of the Russian Federation are subject to consideration in 30-day time.

5. For the solution of question of cause and effect relationship availability between the fact of act of terrorism or other actions of violent nature and damnification to health of the employee of diplomatic service or the member living together with it of his family in the Ministry of Foreign Affairs of the Russian Federation the commission can be established.

6. The legal act of the Ministry of Foreign Affairs of the Russian Federation about provision or about refusal in provision of payment is accepted based on the statement and documents attached to it, and also taking into account recommendations of the commission, stipulated in Item 5 these rules.

7. Provision of payment it can be refused if by results of the carried-out consideration of the submitted documents availability of relationship of cause and effect between the fact of act of terrorism or other actions of violent nature and damnification to health of the employee of diplomatic service or the member of his family living together with it was not established.

8. The copy of the legal act of the Ministry of Foreign Affairs of the Russian Federation certified in accordance with the established procedure about provision or about refusal in provision of payment goes or issued to the employee of diplomatic service, or the member of his family, or their legal representative living together with it in week time from the date of the edition of the specified legal act.

9. Payment is paid within 3 months from the date of the edition of the legal act of the Ministry of Foreign Affairs of the Russian Federation.
