About approval of Rules of the admission of airways and local airlines to operation

According to the Law of the Republic of Kazakhstan of July 15, 2010 "About use of airspace of the Republic of Kazakhstan and activities of aircraft" and the purpose of determination of the admission of airways and local airlines to operation, PRIKAZYVAYU:

1. Approve the enclosed Rules of the admission of airways and local airlines to operation.

3. To provide to committee of civil aviation of the Ministry of Transport and Communications of the Republic of Kazakhstan (Adimold R. O.) submission in accordance with the established procedure of this order in the Ministry of Justice of the Republic of Kazakhstan for state registration.

4. To impose control of execution of this order on the vice-Minister of Transport and Communications of the Republic of Kazakhstan Dyusembayev E. S.

5. This order becomes effective after ten calendar days after day of its first official publication.

Rules of the admission of airways and local airlines to operation

Chapter 1. General provisions

1. These rules of the admission of airways and local airlines to operation (further - Rules) are developed according to article 36 of the Law of the Republic of Kazakhstan of July 15, 2010 "About use of airspace of the Republic of Kazakhstan and activities of aircraft".

2. Rules determine procedure for issue of the admission of airways and local airlines to operation.

3. The main terms and determinations used in these rules:

1) airway - the airspace in the form of corridor intended for flights of air vehicles and equipped with aeronautical devices;

2) local airline - the corridor in the lower airspace limited on height and width, intended for safe accomplishment of flights of air vehicles;

3) the admission - the document issued in case of the admission of airway and/or local airline to operation, certifying compliance to requirements of the international standards and recommended practice concerning airways, communication systems and radio engineering means, rules of flights and practice of air traffic maintenance;

4) the request - the written appeal of the applicant to authorized body in the field of civil aviation for receipt of the admission of airway and/or local airline to operation by air vehicles;

5) the applicant - the aeronautical organization which addressed to authorized body in the field of civil aviation for receipt of the admission;

6) area navigation (RNAV) - the navigation method allowing air vehicles to carry out flight on any desirable trajectory within the action area of radio lighthouse navaids or in the limits determined by opportunities of autonomous means or their combination;

7) air traffic maintenance (further - Department of Internal Affairs) - the general term meaning flight and information servicing, the emergency notification, advisory service of air traffic, dispatching air traffic maintenance in appropriate cases;

8) recommended practice - any requirement to physical characteristics, configurations, hardware, technical characteristics, personnel and rules which uniform use is recognized desirable for safety control, regularity or efficiency of the international air navigation and which Contracting states according to the Convention on international civil aviation will aim to observe;

9) the standard - any requirement to physical characteristics, configurations, hardware, technical characteristics, personnel or rules which uniform use is recognized necessary for safety control or regularity of the international air navigation and which will be observed by Contracting states according to the Convention on international civil aviation;

10) authorized body in the field of civil aviation - the central actuator performing management in the field of use of airspace of the Republic of Kazakhstan and activities of civil and experimental aviation;

11) the aeronautical organization - the civil aviation organization performing air traffic maintenance and transfer of necessary meteorological data aboard the air vehicle, providing airspace users with aeronautical information and operation of the radio-radar equipment and communicating device.

4. Airways and/or local airlines are allowed to operation after their inspection for the purpose of determination and establishment of their compliance to requirements of the International standards and the Recommended practice accepted by Council of International Civil Aviation Organization (ICAO) according to article 37 of the Convention on international civil aviation (further - International standards and the Recommended practice).

5. The airways and/or local airlines allowed to operation are published in the list of airways of the Republic of Kazakhstan and the list of local airlines of the Republic of Kazakhstan respectively.

6. The admission is issued without restriction of effective period on the established form, according to appendix 1 to these rules.

7. The admission is inaliennable and cannot be transferred to other person.

8. Issue, accounting of admissions are performed by authorized body in the field of civil aviation.

9. Aggregate term of work according to the admission of airways and/or local airlines to operation from the date of application shall not exceed three months.

10. In case of the admission of airways to operation the equipment of airway and/or local airline given in appendix 2 to these rules is subject to obligatory inspection.

Chapter 2. Giving and preliminary analysis of the request

11. For the admission of airway and/or local airline to operation the applicant sends to authorized body in the field of civil aviation the request of the established form, according to appendix 3 to these rules with the documents confirming compliance of airway and/or local airline to requirements of International standards and the Recommended practice.

12. The following documents confirming compliance of airway and/or local airline to requirements of International standards and the Recommended practice are attached to the request:

1) designation (index) of airway and/or local airline and the established main points on it;

2) the established minimum absolute altitudes on this airway and/or local airline and its sites;

3) the RNP type ordered for airway and/or local airline or its sites, including routes of area navigation (RNAV);

4) criteria of expansion of radio navigation aids and radar equipment on airway and/or local airline to its sites;

5) the list of communications, aid and radar equipment according to which navigation targeting on airway is provided and/or to local airline to its sites;
