About carrying out extraordinary employee assessment of law enforcement agencies of the Republic of Kazakhstan

According to Item 3-1 of article 47 of the Law of the Republic of Kazakhstan of January 6, 2011 "About law-enforcement service" I DECIDE:

1. Form the Highest certifying commission in case of the President of the Republic of Kazakhstan on carrying out extraordinary employee assessment of law enforcement agencies of the Republic of Kazakhstan (further - the Commission).

2. Approve enclosed:

1) Regulations on the Commission;

2) structure of the Commission;

3) Rules of carrying out extraordinary employee assessment of law enforcement agencies of the Republic of Kazakhstan.

3. To Administration of the President of the Republic of Kazakhstan, the Prosecutor General's Office of the Republic of Kazakhstan, Agency of the Republic of Kazakhstan on fight against economic and corruption crime (financial police), the Ministry of Internal Affairs of the Republic of Kazakhstan, the Ministry of Emergency Situations of the Republic of Kazakhstan, the Ministry of Finance of the Republic of Kazakhstan till December 30, 2012 to carry out extraordinary employee assessment of law enforcement agencies, and also to take other measures following from this Decree.

4. This Decree becomes effective from the date of signing, except for subitems 1), 2) and 3) of Item 1 of Rules of carrying out extraordinary employee assessment of law enforcement agencies of the Republic of Kazakhstan which become effective after enforcement of the relevant amendments to the Law of the Republic of Kazakhstan "About law-enforcement service".

Regulations on the Highest certifying commission in case of the President of the Republic of Kazakhstan on carrying out extraordinary employee assessment of law enforcement agencies of the Republic of Kazakhstan

1. General provisions

1. This Provision determines legal status and powers of the Highest certifying commission in case of the President of the Republic of Kazakhstan by carrying out extraordinary employee assessment of law enforcement agencies of the Republic of Kazakhstan (further - the Commission).

2. In the activities the Commission is guided by the Constitution, legal acts of the Republic of Kazakhstan, acts of the President of the Republic of Kazakhstan, including Rules of carrying out extraordinary employee assessment of law enforcement agencies of the Republic of Kazakhstan and this provision.

2. Tasks of the Commission

3. Tasks of the Commission are:

1) carrying out extraordinary аттестации*:

first deputies and deputy first heads of law enforcement agencies;

heads of departments of law enforcement agencies and their deputies;

chiefs of departments of central offices of law enforcement agencies (except departments which competence questions of language policy, information and documentary support, protection of the state secrets, and also departments of logistic and financial provision of the Prosecutor General's Office of the Republic of Kazakhstan and Agency of the Republic of Kazakhstan on fight against economic and corruption crime enter);

heads of the territorial or equated to them specialized divisions of law enforcement agencies and their deputies;

heads of departmental higher educational institutions of law enforcement agencies;

candidates for structures of republican certifying commissions of central offices of law enforcement agencies;

2) organization and coordination of carrying out extraordinary employee assessment of law enforcement agencies.

3. Rights of the Commission

4. The commission has the right:

1) to request necessary information from state bodies, departments and the organizations for the questions which are within the competence of the Commission;

To attract 2) as required officials and specialists of state bodies, and also representatives of the interested organizations;

To hear 3) at meetings of members of the commission of the certified employees, and also representatives of state bodies and other organizations for the questions which are within the competence of the Commission;

4) to perform other rights necessary for implementation of the tasks assigned to the Commission.

4. Organization of activities of the Commission

5. Commission chairman is the Head of Administration of the President of the Republic of Kazakhstan.

6. Commission chairman:

1) performs the common directorship of activities of the Commission;

2) is determined by the place and time of carrying out commission sessions;

3) presides over commission sessions;

4) gives instructions, obligatory for execution, to members of the commission.

7. Members of the commission have the right:

1) to make offers on the working schedule of the Commission;

2) to take part in discussion of the questions considered on commission session.

8. The secretary of the Commission will organize carrying out commission sessions.

9. Commission session is considered competent if at it there are at least two thirds of its structure.

Decisions of the Commission are made by a simple majority vote from total quantity of the members of the commission who were present at meeting. In case of equality of votes the voice of the commission chairman is decisive.

10. The made decision of the Commission is drawn up by the protocol signed by the chairman and the secretary of the Commission and expressing consensus of all members of the commission.

11. Working body of the Commission is the Department of law-enforcement system of Administration of the President of the Republic of Kazakhstan.

Note: * - extraordinary certification of first deputies and deputy first heads of law enforcement agencies, the employees having service length in law enforcement agencies at least twenty years and also appointed to new positions less than a one years ago is carried out in process of enforcement of the relevant amendments to the Law of the Republic of Kazakhstan "About law-enforcement service".
