1. Form Energy council in case of the President of the Republic of Kazakhstan (further - Council).

2. Approve enclosed:

1) regulations on Council;

2) structure of Council.

3. To the government of the Republic of Kazakhstan to take the necessary measures following from this Decree.

4. This Decree becomes effective from the date of signing.

Regulations on Energy council in case of the President of the Republic of Kazakhstan

Chapter 1. General provisions

1. The energy council in case of the President of the Republic of Kazakhstan (further - Council) is created for the purpose of stable and effective development of energy industry in the Republic of Kazakhstan.

2. Council is advisory advisory body in case of the President of the Republic of Kazakhstan.

Chapter 2. Tasks and rights of Council

4. The main objectives of Council are:

5. Council in accordance with the established procedure and on the questions entering its competence has the right:

To submit 1) for consideration of the President of the Republic of Kazakhstan offers on strategic directions of development of energy industry of the Republic of Kazakhstan;

2) to create working groups for the solution of the questions entering competence of Council;

3) to request necessary information from state bodies, departments and the organizations for the questions which are within the competence of Council;

4) to involve specialists of the interested state bodies, consultants for the purpose of realization of tasks, stipulated in Item 4 this provision;

5) to perform other rights necessary for ensuring effective activities of Council within its competence.

Chapter 3. Forming and organization of activities of Council

6. The structure of Council affirms the President of the Republic of Kazakhstan.

7. Council is headed by the chairman of the board. Chairman of the board:

1) performs the common directorship of activities of Council;

2) presides over meetings of Council;

3) is determined by the place and time of holding meetings of Council;

4) exercises general control of implementation of decisions of Council;

5) No. 591 is excluded according to the Presidential decree of the Republic of Kazakhstan of 29.06.2024

During absence of the chairman of its function the deputy to whom the chairman delegates appropriate authority carries out.

8. Members of council have the right:

8-1. Secretary of Council:

1) is created by the draft of the agenda of meetings of Council;

2) will organize preparation of materials for meetings of Council, and also drafts of protocols of meetings of Council;

3) at the request of the chairman of the board performs other functions.

9. Meetings of Council are held as required in the terms determined by the chairman of the board, but at least once a half-year. Meetings of Council are held in case of direct presence of his members and are considered competent with participation in vote at least two thirds of his members. Delegation by members of council of the powers to other officials is not allowed.

10. Working body of Council is the Department of Energy of the Republic of Kazakhstan.

11. Working body of Council:

1) provides the organization of holding meetings of Council and performs preparation of the corresponding materials for holding meetings of Council;

2) notifies members of council on the place, carrying out time, the agenda of the regular meeting of Council and timely provides them with required materials;

3) is performed by coordination of the minutes of Council;

4) within two weeks from the date of decision making of Council sends the copy of the protocol and other required materials to members of council and other interested state bodies and other organizations;

5) is performed by monitoring and the analysis of realization and application of recommendations of Council.

12. Following the results of meetings of Council the decisions which are drawn up by the protocol which is signed by all members of council who were present at meeting are made.

13. Decisions of Council are made by a simple majority vote and have advisory nature. In case of equality of votes the voice of the chairman is decisive.

Members of council have the right to special opinion which, in case of its expression, shall be stated in writing and attached to the protocol.

14. Decisions of Council can be published in mass media or are brought to the attention of subjects of energy industry by any different way according to the current legislation of the Republic of Kazakhstan. The list and amount of information for the publication or transfer to subjects of energy industry are determined by Council.

Chapter 4. Termination of activities of Council

15. The basis of the termination of activities of Council is the decision of the President of the Republic of Kazakhstan.
