ORDER OF THE GOVERNMENT OF THE REPUBLIC OF KAZAKHSTAN

About approval of the sizes, sources, types and Rules of provision of the public assistance to citizens which are given the public assistance

According to subitem 25-1) of article 4 of the Law of the Republic of Kazakhstan of July 27, 2007 "About education" the Government of the Republic of Kazakhstan DECIDES:

1. Approve enclosed:

1) Rules of provision of the public assistance to citizens which are given the public assistance;

2) the Sizes, sources and types of provision of the public assistance to citizens which are given the public assistance.

2. Recognize invalid some decisions of the Government of the Republic of Kazakhstan according to appendix to this resolution.

3. This resolution becomes effective after ten calendar days after day of its first official publication, except for the subitem 7) of Item 5 of Rules of provision of the public assistance to citizens which are given the public assistance, approved by this resolution, the paragraph of the third Item of 1 sizes, sources and types of provision of the public assistance to citizens which are given the public assistance approved by this resolution, which become effective since January 1, 2018.

Rules of provision of the public assistance to citizens which are given the public assistance

1. These rules of provision of the public assistance to citizens which are given the public assistance (further - Rules) are developed according to subitem 25-1) of article 4 of the Law of the Republic of Kazakhstan of July 27, 2007 "About education" and determine procedure for provision of the public assistance to citizens during education in the organizations of education.

2. The state during education completely provides expenses on the public assistance:

1) to orphan children and children without parental support;

2) to children with limited opportunities in development, to disabled people and disabled people since the childhood, to the handicapped children who are brought up and (or) students in the residential organizations;

3) to the children who are in the centers of temporary isolation, adaptation and rehabilitation of minors.

3. Complete state providing includes provision of the place of residence in boarding school of the organization of education, soft stock, the equipment and regimentals, food, textbooks and medical care.

4. Medical care is provided to citizens who are given the public assistance during education within the guaranteed amount of free medical care.

5. The state partially compensates expenses during education:

1) to children from large families;

2) to children from the families having the right to the address public assistance and also to children from the families which are not receiving the government address public assistance in which the average per capita income is lower than the size of subsistence minimum;

3) to the children living in boarding schools of general and sanatorium types, boarding schools under schools;

4) to the children who are brought up and students in the specialized residential organizations of education for exceptional children;

5) to pupils of the residential organizations;

6) to children who for health reasons study for a long time according to general education training programs of primary, main secondary, general secondary education at home or in the organizations giving stationary help, and also recovery treatment and medical rehabilitation;

7) to the students studying according to the educational grant in non-commercial joint-stock company "The Kazakh national women's pedagogical university;

8) to the students studying according to the educational programs of technical and professional, postsecondary education providing training of skilled workers of personnel and also students within training with technical and professional education taking into account requirements of the labor market of the first direction of the State program of development of productive employment and mass entrepreneurship for 2017 - 2021 of Enbek approved by the order of the Government of the Republic of Kazakhstan of November 13, 2018 No. 746;

9) to other categories of citizens determined by the laws of the Republic of Kazakhstan.

To the categories of citizens specified in subitems 3), 4) and 5) of Item 5 of these rules, the state compensates expenses for food in the amount of 80 percent from food cost (20 percent become covered at the expense of parent payment).

The persons specified in subitems 1) and 2) of Item 5 of these rules and which are under guardianship (guardianship) and patronage during training in the organizations of technical and professional, postsecondary, higher education have the right to free hot meals at the rate of 40 percent of cost of day diet for orphan children at the expense of republican or local budgets.

To persons specified in the subitem 7) of Item 5 of these rules, the state compensates expenses on hot meals in the amount of 100 percent from food cost.

To persons specified in the subitem 8) of Item 5 of these rules, the state compensates expenses on hot meals at the rate of 40 percent of cost of day diet for orphan children at the expense of local budgets.

Expenses for food can be covered completely at the expense of local budgets according to the decision of local executive bodies.

Students of the organizations of secondary education from the families having the right to the government address public assistance and also from the families which are not receiving the government address public assistance in which the average per capita income is lower than the size of subsistence minimum and orphan children, children without parental support, are provided with disposable school food according to the sizes, sources and types of provision of the public assistance to citizens which are given the public assistance, by the approved this resolution.

6. The public assistance during education is performed by the organizations of education from the written application in any form of parents or other legal representatives in the presence of one of the following supporting documents:

1) copies of the certificate of birth - for children from large families;

2) copies of the certificate of approval of guardianship (guardianship), foster education - for the orphan children and children without parental support who are brought up in families;

3) certificates of disability - to disabled people and disabled people since the childhood, to handicapped children or the copy of the medical certificate psikhologo - medico-pedagogical consultation - for children with limited opportunities in development;

4) the reference confirming belonging of the applicant (family) to receivers of the government address public assistance provided by local executive bodies for children from the families having the right to the address public assistance;

5) data on the gained income (the salary of the working parents or replacing them entrepreneurial incomes and other types of activity, the income in type of children maintenance and other dependents) - for children from the families which are not receiving the government address public assistance in which the average per capita income is lower than subsistence minimum;

6) the copy of the order on transfer in educational institution for persons specified in the subitem 8) of Item 5.

The average per capita income of the family which is not receiving the government address public assistance is determined by division of the amount of the income on the number of months since the beginning of year until the address (including month of the address) behind purpose of funds for rendering the public assistance and to number of family members.

In case of calculation of the average per capita income in family composition parents (other legal representatives) and children who are in their dependence did not reach 18 years are considered.

The right to the public assistance during education for children from the families having the right to the address public assistance and also from the families which are not receiving the government address public assistance in which the average per capita income is lower than the size of subsistence minimum shall be confirmed annually by submission of documents to the organization of education according to subitems 4) and 5) of Item 6 of these rules.

7. The organization of education within 10 calendar days from the date of receipt considers applications with necessary documents them and makes the decision on provision of the public assistance or refusal.

8. Refusal to citizens in receipt of the public assistance is representation by the applicant of the false information which entailed illegal purpose of the public assistance and the untimely notice by the receiver about the circumstances influencing receipt of the public assistance.

In case of refusal the motivated answer in writing about causes of failure in provision of the public assistance is given.

9. The head of the organization of technical and professional, postsecondary and higher education is granted the right:

To finance 1) the student from among orphan children and children without parental support, in the period of vacation journey, daily issues in the procedure established by the legislation by means of the organizations of education in those organizations and families where they were brought up;

To allocate 2) to the students from among orphan children and children without parental support who is not leaving to places of organized rest in the period of vacation, cash within the cost of standard daily rate on food.

10. Citizens who are given the public assistance during education according to the decision of local representative bodies are granted the right of preferential journey on public transport.

11. The head of the organization of technical and professional, postsecondary and higher education, whenever possible, at the expense of means of the organizations of education provides free permits in the camp of work, boarding houses and dispensaries, rest houses, student's improving the camp, and in the presence of medical indications - sanatoria of the corresponding profile:

1) to orphan children and children without parental support;

2) to disabled people and disabled people since the childhood, to handicapped children.

12. The expenses connected with journey of the orphan children and children without parental support who are during training at complete state providing are performed at the expense of means of the organizations of education at the rate of the cost of student's and student's tickets.

13. In the organizations of additional education training of orphan children and children without parental support, is performed at the expense of means of these organizations.

14. Costs of citizens which are given the public assistance during receipt of education by them are considered by authorized body in the field of education based on requests of the state organizations of education when forming republican and local budgets according to the procedure, established by the legislation of the Republic of Kazakhstan.

The sizes, sources and types of provision of the public assistance to citizens which are given the public assistance

1. Regulations of food, providing with clothes, footwear and soft stock of the orphan children and children without parental support who are brought up and students in the organizations for orphan children and children without parental support, in the state organizations of technical and professional, postsecondary, higher education (irrespective of type and departmental subordination) are established according to appendix 1, of 2, of 3, of 4, 5 to the sizes, sources and types of provision of the public assistance to citizens which are given the public assistance during receipt of education by them (further - to the sizes, sources and types).

Expense amounts on acquisition of economic stock, personal care products, toys, fiction, on cultural events in the amount of at least three percent from upkeep cost of all pupils and students without the expense accounting on acquisition of the equipment, stock and carrying out capital repairs of buildings and constructions.

Food regulations for the students studying according to the educational grant in non-commercial joint-stock company "Kazakh National Women's Pedagogical University" are established according to appendix 5 to the sizes, sources and types.
