About approval of the sizes, sources, types and Rules of provision of the public assistance to citizens which are given the public assistance

According to subitem 25-1) of article 4 of the Law of the Republic of Kazakhstan "About education" the Government of the Republic of Kazakhstan DECIDES:

1. Approve enclosed:

1) Rules of provision of the public assistance to citizens which are given the public assistance;

2) the Sizes, sources and types of provision of the public assistance to citizens which are given the public assistance.

2. Recognize invalid some decisions of the Government of the Republic of Kazakhstan according to appendix to this resolution.

3. This resolution becomes effective after ten calendar days after day of its first official publication, except for the subitem 7) of Item 5 of Rules of provision of the public assistance to citizens which are given the public assistance, approved by this resolution, the paragraph of the third Item of 1 sizes, sources and types of provision of the public assistance to citizens which are given the public assistance approved by this resolution, which become effective since January 1, 2018.

Rules of provision of the public assistance to citizens which are given the public assistance

1. These rules of provision of the public assistance to citizens which are given the public assistance (further - Rules) are developed according to subitem 25-1) of article 4 of the Law of the Republic of Kazakhstan "About education" and determine procedure for provision of the public assistance to citizens during education in the organizations of education.

2. The state during education completely provides expenses on the public assistance:

1) to orphan children and children without parental support;

2) to children with limited opportunities in development, to persons with disability and to persons with disability since the childhood, to the children with disability who are brought up and (or) students in the residential organizations;

3) to the children who are in the centers of adaptation of minors and supports of the children needing special social services.

3. Complete state providing includes provision of the place of residence in boarding school of the organization of education, soft stock, the equipment and regimentals, food, textbooks and medical care.

4. Regulations of food, providing with clothes, footwear and soft stock of children with limited opportunities in development, persons with disability and persons with disability since the childhood, children with disability, children from large families, children from the families receiving the address public assistance, and the children who are under guardianship (guardianship), on foster education and in foster home, brought up in the organizations for orphan children and children without parental support, and the residential organizations, and the children who are in the centers of adaptation of minors and supports of the children needing special social services are established according to appendices 4 and 8 to the sizes, sources and types.

5. The state partially compensates expenses during education:

1) to orphan children and children without parental support, and also the citizens of the Republic of Kazakhstan from among youth who lost or without parental support to age of majority;

2) to persons with disability of the first or second group, to persons with disability since the childhood, to children with disability;

3) to children from large families;

4) to children from the families having the right to the address public assistance and also to children from the families which are not receiving the government address public assistance in which the average per capita income is lower than the size of subsistence minimum;

5) to the children living in boarding schools of general and sanatorium types, boarding schools under schools;

6) to the children who are brought up and students in the specialized residential organizations of education for exceptional children;

7) to pupils of the residential organizations;

8) to children who for health reasons study for a long time according to general education training programs of primary, main secondary, general secondary education at home or in the organizations providing medical care in stationary conditions and also recovery treatment and medical rehabilitation;

9) to the students studying according to the educational grant in non-commercial joint-stock company "Kazakh National Women's Pedagogical University";

10) to the students studying according to the educational programs of technical and professional, postsecondary education providing training of skilled workers of personnel;

11) to other categories of citizens determined by the laws of the Republic of Kazakhstan.

To the categories of citizens specified in subitems 5), 6) and 7) of Item 5 of these rules, the state compensates expenses for food in the amount of 80 percent from food cost (20 percent become covered at the expense of parent payment).

To the categories of citizens specified in subitems 1) and 2) of Item 5 of these rules, the state during training in the organizations of technical and professional, postsecondary, higher and (or) postgraduate education compensates expenses for accommodation in hostels in the amount of, not exceeding twenty nine monthly settlement indicators established as of January 1, 2023 a year.

The persons specified in subitems 3) and 4) of Item 5 of these rules and which are under guardianship (guardianship) on foster education and in foster home, during training in the organizations of technical and professional, postsecondary, higher education have the right to free hot meals at the rate of 40 percent of cost of day diet for orphan children at the expense of republican or local budgets.

To persons specified in the subitem 9) of Item 5 of these rules, the state compensates expenses on hot meals in the amount of 100 percent from food cost.

To persons specified in the subitem 10) of Item 5 of these rules, the state compensates expenses on hot meals at the rate of 40 percent of cost of day diet for orphan children at the expense of local budgets.

Expenses for food can be covered completely at the expense of local budgets according to the decision of local executive bodies.

Students of the organizations of secondary education from the families having the right to the government address public assistance and also from the families which are not receiving the government address public assistance in which the average per capita income is lower than the size of subsistence minimum and orphan children, children without parental support, are provided with disposable school food according to the sizes, sources and types of provision of the public assistance to citizens which are given the public assistance, by the approved this resolution.

The public assistance to orphan children and children without parental support who study in the organizations of formation of technical and professional, higher education of foreign countries directed by state bodies of the Republic of Kazakhstan, appears these state bodies.

6. The public assistance during education is performed by the organizations of education or state bodies of the Republic of Kazakhstan from the written application in any form of the orphan children and children without parental support who reached age of majority, parents or other legal representatives with appendix of one of the following supporting documents:

1) copies of the certificate of birth – for children from large families;

2) copies of the certificate of approval of guardianship (guardianship) – for the orphan children and children without parental support who are brought up in families;

3) copies of the contract on transfer of child(children) for foster education or in foster home – for the orphan children and children without parental support who are brought up in families;

4) certificates of disability – to persons with disability and to persons with disability since the childhood, to children with disability or copies of the conclusion psikhologo - medico-pedagogical consultation – for children with limited opportunities in development;

5) the reference confirming belonging of the applicant (family) to receivers of the government address public assistance provided by local executive bodies – for children from the families having the right to the address public assistance;

6) data on the gained income (the salary of the working parents or replacing them entrepreneurial incomes and other types of activity, the income in type of children maintenance and other dependents) – for children from the families which are not receiving the government address public assistance in which the average per capita income does not exceed poverty line;

7) copies of the order on transfer in educational institution - for persons specified in the subitem 10) of Item 5 of these rules.

The average per capita income of the family which is not receiving the government address public assistance is determined by division of the amount of the income on the number of months since the beginning of year until the address (including month of the address) behind purpose of funds for rendering the public assistance and to number of family members.

In case of calculation of the average per capita income in family composition parents (other legal representatives) and children who are in their dependence did not reach 18 years are considered.

The right to the public assistance during education for children from the families having the right to the address public assistance and also from the families which are not receiving the government address public assistance in which the average per capita income does not exceed poverty line shall be confirmed annually by submission of documents to the organization of education according to subitems 4) and 5) of Item 6 of these rules.

6-1. Persons specified in subitems 1) and 2) of Item 5 of these rules when settling to hostels of the organizations of technical and professional, postsecondary, higher and (or) postgraduate education provide one of the following supporting documents:

1) the copy of the certificate of guardianship (guardianship) - for orphan children and children without parental support;

2) copies of death certificates of parents or the reference from the organization for orphan children and children without parental support;

3) the certificate of disability - for persons with disability of the first or second group, persons with disability since the childhood, children with disability.

7. The organization of education or state body of the Republic of Kazakhstan within 10 calendar days from the date of receipt consider applications with necessary documents them and make the decision on provision of the public assistance or refusal.

In case of representation by parents or other legal representatives of incomplete document package and (or) documents with the expired effective period, the organizations of education or state bodies of the Republic of Kazakhstan refuse reception of an application.

8. Refusal to citizens in receipt of the public assistance is representation by the applicant of the false information which entailed illegal purpose of the public assistance and the untimely notice by the receiver about the circumstances influencing receipt of the public assistance.

In case of refusal the motivated answer in writing about causes of failure in provision of the public assistance is given.

9. Heads of the organizations of technical and professional, postsecondary, higher education and state bodies of the Republic of Kazakhstan perform:

1) financing by the student from among orphan children and children without parental support, in the period of vacation of journey, daily issues in the procedure established by the legislation at the expense of means of the organizations of education and state bodies in those organizations and families where they were brought up;

2) allocation by the student from among orphan children and children without parental support who is not leaving to places of organized rest in the period of vacation, cash within the cost of standard daily rate on food.
