About approval of Regulations of special receivers of law-enforcement bodies

1. Approve the enclosed Regulations of special receivers of law-enforcement bodies.

2. To committee of administrative police of the Ministry of Internal Affairs of the Republic of Kazakhstan (Lepekh I. V.) provide state registration of this order in the Ministry of Justice of the Republic of Kazakhstan and its official publication.

3. To impose control of execution of this order on the deputy minister of internal affairs of the Republic of Kazakhstan police colonel Tynybekov K. S. and Committee of administrative police of the Ministry of Internal Affairs of the Republic of Kazakhstan (Lepekh I. V.).

4. This order becomes effective after ten calendar days after day of its first official publication.

Regulations of special receivers of law-enforcement bodies

Chapter 1. General provisions

1. These rules of internal rules and procedures of special receivers of law-enforcement bodies (further - Rules) are developed according to the Law of the Republic of Kazakhstan of March 30, 1999 "About procedure and conditions of keeping of persons in the special facilities, special rooms providing temporary isolation from society" (further - the Law) and determine internal rules and procedures of special receivers for the purpose of providing detention regime.

2. Providing the mode in special receivers, maintenance of internal rules and procedures in them is assigned to administration and employees of the special receiver.

2-1. In office activities employees of the special receiver treat the containing persons according to the principles of legality, equality of citizens before the law, humanity, respect of honor and advantage of the personality, and also take other measures assuming exception of the reasons and conditions promoting manifestations of roughness and indifference.

3. The internal rules and procedures of day of special receivers in form according to appendix 1 to these rules are determined and affirms the chief of law-enforcement body.

4. Internal rules and procedures in the special receiver are hung out in each camera.

5. The basic concept used in these rules:

1) the special receiver – the special facility of law-enforcement bodies intended for acceptance and content of persons subjected to administrative detention, the foreigners and stateless persons which are subject to expulsion forcibly;

2) person subjected to administrative detention - person concerning whom the court issues the decree on imposing of administrative detention.

Chapter 2. Order of registration of persons brought in the special receiver

6. The person on duty on the special receiver in case of acceptance of person subjected to administrative detention, the foreigner and the stateless person which is subject to expulsion forcibly checks availability:

1) the judge's ruling on arrest signed by it personally and court under seal or signed by the digital signature (for persons subjected to administrative detention);

2) resolutions of law-enforcement body, about preventive restriction of freedom of travel, authorized by court (for the foreigners and stateless persons which are subject to expulsion forcibly);

3) the protocol of personal inspection with the withdrawn things prohibited to storage in the special receiver;

4) the identity document of person subjected to administrative detention, the foreigner and the stateless person which is subject to expulsion forcibly.

7. The person on duty verifies the corresponding entries in the judge's ruling on arrest with data on the identity of delivered, checks availability of the things listed in the protocol of examination and registers in the Magazine of registration of persons brought in the special receiver in form according to appendix 2 to these rules.

8. The men placed in special receivers accommodate separately from women.

The patients with infectious form of tuberculosis, venereal and other infectious diseases needing special medical care, observation, ensuring personal security are isolated from other persons.
