About the museums

(as amended on 04-06-2010)

Considering lack of the general precepts of law regulating creation and activities of the museums, their reorganization and liquidation, and also considering specifics of activities of the museums,

The parliament adopts this ordinary law.

Chapter I General provisions

Art. 1. - This law determines the general legal basis of creation and functioning of the museums in the Republic of Moldova.

Art. 2. - The state guarantees equal conditions for creation and functioning of all museums irrespective of their profile and type of property.

Art. 3. - (1) the Legislation in the field of the museums includes the Constitution of the Republic of Moldova, presidential decrees of the Republic of Moldova, the laws and resolutions of Parliament, the resolution, ordinances and orders of the Government, international agreements, one of the parties of which is the Republic of Moldova, this law and other regulations.

(2) If the international agreement, one of the parties of which is the Republic of Moldova, other regulations than established by this law are provided, regulations of the international agreement are applied.

Art. 4. - For the purpose of this law the following concepts are used in value:

the museum - cultural scientific institution which purpose are collecting and storage of cultural values, and also their promoting mainly by exhibiting in the educational, educational purposes and for the purpose of the organization of leisure of general population;

museum collection - group of the objects representing scientific, historical, cultural, art, museum value, collected and systematized in the museum;

museum subject - any of two - or the three-dimensional subject representing scientific, historical, cultural, art, museum value, which is stored in the museum;

museum fund - set of cultural values of the museum in which qualities of inalienability, mobility and stability are inherent and which continuously are replenished and develop;

cultural values - any objects with signs of relative original creativity which are the historical evidence of technical, social, esthetic, religious, mythological, daily conduct of life of any society in certain interval of time;

storage of cultural values - set of the measures taken for the purpose of preserving cultural values in normal physical state;

restoration of cultural values - set of the measures taken for the purpose of giving of original form or structure to the cultural values which underwent to spoil or degradation;

scientific, historical, cultural, art, museum attribution - determination of scientific, historical, cultural, art, museum value of the cultural values which are kept in the museum.

Chapter II Museums

Art. 5. - The museums are non-commercial organizations with the status of the legal entity which are registered according to the procedure, established by the law.

Art. 6. - The museums perform the following functions:

a) creation and development of museum fund according to profile of the museum, its accounting and storage;

b) studying of the museum fund for the purpose of completing of collections;

c) promotion of museum fund in the educational and cognitive purposes;

d) ensuring safety of museum fund;

e) development and implementation of scientific and cultural projects and programs for the purpose of promoting of museum collections and development of spirit of community;

f) preparation and edition of catalogs of museum collections, other scientific and popular scientific publications;

g) exchange and cooperation with other museums as in the country, and abroad.

Chapter III Museum fund

Art. 7. - (1) the Museum fund is in public property of the state, in property of administrative and territorial units, and also in private property of physical persons or legal entities.

(2) the Museum fund is inaliennable.

Art. 8. - Are part of museum fund:

a) the personal estate of special historical, documentary, art, archaeological, ethnographic value representing the nature, the equipment, literature and art, life and activities of outstanding persons of different spheres of activity, etc.;

b) works of the fine arts;

c) manuscripts, ancient and rare editions, antiquarian objects;

d) weapon collections, harness objects;

e) objects of numismatics, notaphily, medalistika, philately, faleristika, etc.

f) collections of objects from precious metals and stones of special historical, art and museum value;

g) the real estate classified as monuments history, architecture, ethnographies;

h) the natural reserves representing the flora, fauna, natural or well-planned landscapes, structures which are the certificate of development of the environment;

i) other cultural values having documentary, educational or evident value and used in museum activities.

Art. 9. - From the point of view of specifics of museum fund the museums on the profile can be archaeological, historical, natural-historical, ethnographic, art, literary, scientific and technical, architectural, memorial, under the open sky, etc.

Art. 10. - Completing of the museum fund which is in public property of the state is performed by means of:

a) purchases of museum objects at the expense of the budgetary funds assigned to the museums;

b) purchases of museum objects at the expense of the special means received by the museums from rendering different services and implementation of museum activities;

c) sponsorship and donations;

d) purchases of works of the modern fine arts based on decisions of Council of experts in survey, assessment and purchase of works of the fine arts of the Ministry of Culture and procurement commissions of the museums;

e) acceptances in the order of the museum of museum objects from foreign physical persons and legal entities as a result of return of these objects to the country of their origin or donations of specified persons;

f) acceptances in the order of the museum of museum objects from other museums owing to reorganization or liquidation of those;

g) acceptances in the order of the museum of museum objects from customs and law enforcement agencies according to the current legislation.

Art. 11. - Are transferred to the museums which are in public property of the state in the procedure established by the law:

a) the museum collections and museum objects confiscated based on the decision of degree of jurisdiction or transferred to the public possession of the state based on inheritance right;

b) the cultural values which are part of the archaeological, historical or cultural treasures opened in the territory of the Republic of Moldova.

Art. 12. - Completing of the museum fund which is in private property is performed at the expense of means of owners or investments of other physical persons or legal entities according to the current legislation.

Art. 13. - (1) Cultural values of Museum fund of the Republic of Moldova are brought in the State register of movable cultural values (further - the State register).
