About procedure for import to the Republic of Moldova and export from its territory of property physical persons

Article 1. Purpose of the law and scope

(1) This law establishes procedure for movement by physical persons of goods, objects of private use and vehicles through customs border of the Republic of Moldova.

(2) Provisions of this law are not applied to movement of property by physical persons through customs borders of free enterprise zones.

Article 2. Basic concepts

For the purpose of this law the following basic concepts are used in value:

a) physical persons - the residents and nonresidents who are not subjects of business activity;

b) physical resident persons - the citizens of the Republic of Moldova, foreign citizens and persons without citizenship who are constantly living in its territory that is supported by the relevant documents;

c) physical nonresident persons - the citizens of the Republic of Moldova, foreign citizens and stateless persons which are not specified in Item b);

d) the permanent residence - the residence in the territory of certain state of physical person provided that its accommodation in this territory is not connected with execution of service duties or with study;

e) property - goods, objects of private use and vehicles;

f) goods - any personal estate, objects and other values, including currency (cash national and foreign currency, the materialized securities and payment instruments expressed in national and foreign currency), natural gas, electric, thermal and other types of energy and the vehicles except for specified in Item h);

g) objects of private use - personal clothes and footwear, perfumery, means of hygiene, cosmetics and drugs, food for private consumption, and also portable tools which the corresponding person needs when implementing the occupations or profession. This property cannot intend for business or productive activity;

h) the vehicle - any vehicle staying on the permanent registry in other state and used for international carriages of goods and passengers and also containers and other transport equipment;

i) the international mailing - any mailing which is drawn up according to provisions of the national legal system and acts of Universal Postal Union, arrived on the territory of the Republic of Moldova or sent out of its limits;

j) unaccompanied baggage - the property sent by the owner (owner) or on its specifying, moved through customs border with carrier without maintenance by the owner (owner);

k) oral declaring - the declaration form providing the owner (owner) in oral form to customs authority upon the demand of his official, all data on quantity, quality and cost of the goods and objects of private use moved through customs border;

l) written declaring - the declaration form established by provisions of the Customs code and other regulations adopted on its basis;

m) declaring by action - form of explicit (obvious) declaring of the vehicle in case of which the physical person is exempted from filling of any customs papers on condition of representation to the customs authorities located in transition Items through frontier, documents on registration of the vehicle (in case of observance of the conditions provided by parts (3), (5) and (14) article 10 of this law), with subsequent its registration in information system of Customs Service. In case of declaring application by action customs papers are not issued.

n) measures of economic policy - import restriction to the Republic of Moldova and export about its territories of goods and vehicles established proceeding from interests of the state, providing licensing, quoting and the taxation;

o) cultural values - being of value, by determination of competent authority, the literary work, objects of art, sciences, cultures and religions;

p) the vehicle, the motor vehicle - the self-moving mechanical system (except for moving on railway lines) serving for transportation of passengers, baggage and loads or performing any other work;

r) the vehicle having historical or ethnographic value, – the vehicle of any model or any type, age more than 30 years which is in its initial condition, without essential changes of the chassis, body, steering, brakes, transmission or suspension bracket, the engine, wings, etc., being of the cultural value of last eras confirmed with the Ministry of Culture;

s) the green channel, or "nothing to declare" - corridor for the physical persons which do not have things and goods or having only the things and goods which are not requiring customs declaring in writing allowed to the country. Pass of physical persons through the green channel is recognized implied customs declaring of the corresponding things and goods, with observance of requirements of the current legislation;

t) the red channel - corridor for the physical persons moving the things and goods which are subject to declaring in writing according to the current legislation.

Article 3. Movement of property

(1) Physical persons have the right to import into the Republic of Moldova and to export from its territory property according to this law, the Customs code and other regulations regulating movement of property through customs border. Provisions of Articles 4-11 are not applied when moving by physical persons through customs border of currency values.

(2) Import and transfer to the Republic of Moldova, transfer and export from the Republic of Moldova by physical persons of currency values (others, than the coins containing precious metals), including declaring of the specified currency values, are performed according to provisions of the foreign exchange legislation.

(3) Physical persons have the right to import and send to the Republic of Moldova, to export and send from the Republic of Moldova currency values without customs payment.

Article 3-1. Import and export of cash and checks in national currency of the Republic of Moldova, and also cash and travel checks in foreign currency

Physical persons shall declare in writing cash and checks in national currency of the Republic of Moldova, and also cash and travel checks in foreign currency in the following cases:

a) when importing those to the territory of the Republic of Moldova if their amount exceeds 10000 euros (or their equivalent) as like as two peas;

b) in case of evacuation of those from the territory of the Republic of Moldova if their amount exceeds 10000 euros (or their equivalent) as like as two peas;

c) upon the demand of the customs employee.
