About approval of Requirements to management system activities of the operating organization (operator)
According to the subitem 11 of item 4 of the Regulations on the State inspection of the nuclear regulation of Ukraine approved by the Presidential decree of Ukraine of April 06, 2011 No. 403, and Item 3 of the Actions plan on ensuring openness and availability of information connected with use of nuclear energy, and also increase in the level of culture of nuclear safety in nuclear power approved by the order of the Cabinet of Ministers of Ukraine of August 03, 2011 No. 736-r and for the purpose of ensuring state regulation in the field of use of nuclear energy of PRIKAZYVAYU:
1. Approve Requirements to management system by activities of the operating organization (operator) which are attached.
2. To department on safety issues of nuclear installations (Shevchenko I. A.) provide submission of this order in five-day time on state registration in the Ministry of Justice of Ukraine.
3. Items 2.1 - 2.5 Chapters 2 of Requirements to carrying out modifications of the nuclear installations and evaluation procedure of their safety approved by the order of the State committee of nuclear regulation of Ukraine of January 10, 2005 No. 4, registered in the Ministry of Justice of Ukraine on January 24, 2005 for No. 78/10358, to exclude.
With respect thereto Items 2. 2.7 to consider 6, respectively by Items 2. 1, 2.2.
5. To subjects of activities in the field of use of nuclear energy to bring the activities into accord with requirements of this order till 01.03.2013.
6. To impose control over the implementation of this order on the First Deputy Chairman - the Chief state inspector on nuclear and radiation safety of Ukraine Gashev M. H.

1.1. These Requirements developed according to the General requirements to management system activities in the field of use of nuclear energy approved by Gosatomregulirovaniya's order of Ukraine of December 19, 2011 No. 190, registered in the Ministry of Justice of Ukraine on January 10, 2012 for No. 17/20330, establish requirements to development, implementation, assessment and improvement of management system by activities of the operating organization (operator) of nuclear installation at all stages of lifecycle.
1.2. These Requirements are obligatory for accomplishment by the operating organizations (operators) of nuclear installation who are subjects of activities in the field of use of nuclear energy (further - the subject of activities), and legal entities who are suppliers of goods, works and services for the systems important for safety of nuclear power plants, according to article 34 of the Law of Ukraine "About use of nuclear energy and radiation safety".
1.3. These Requirements are recommended for accomplishment by the operating organizations (operators) of nuclear installation which are not subjects of activities in the field of use of nuclear energy, and the operating organizations (operators) of storages for burial of radioactive waste at all stages of lifecycle.
1.4. In these Requirements terms are used in the values given in the Laws of Ukraine "About allowing activities in the field of use of nuclear energy", "About use of nuclear energy and radiation safety", "About physical protection of the nuclear installations, nuclear materials, radioactive waste, other sources of ionizing radiation", and also in the General requirements to management system activities in the field of use of nuclear energy approved by Gosatomregulirovaniya's order of Ukraine of December 19, 2011 No. 190, registered in the Ministry of Justice of Ukraine on January 10, 2012 for No. 17/20330, and DSTU ISO 9000:2007 "Quality management systems. Basic provisions and dictionary of terms".
2.1. The subject of activities performs the activities on planned basis according to determined by it policy and the purposes. Plans of activities contain criteria by which it is possible to estimate their accomplishment.
2.2. The subject of activities performs periodic assessment of condition of accomplishment of plans, achievements of effective objectives and observance of policy of the subject of activities. Assessment is directed to identification of variations and development of the adjusting actions.
At least once in 5 years is performed by the subject of activities compliance and conditions of realization of the policy approved by it.
2.3. For the purpose of increase in safety the subject of activities performs the analysis and implementation of the best world practice in the activities.
As criteria of compliance of the subject of activities to the best world practice it is recommended to use documents of International Atomic Energy Agency (IAEA) and other international organizations in the field of nuclear and radiation safety and quality assurance.
2.4. The policy of the subject of activities contains requirements for permanent increase in safety and improvement of activities, in particular:
timely identification and information analysis, important for safety;
regular assessment of security status taking into account the world and domestic operating experience reached the level of science and technology;
timely implementation of actions for increase in safety.
2.5. Application of requirements of management system is performed differentially and is based on classification approach about allocation of proper resources taking into account:
observance of requirements of the legislation;
the importance for safety and complexity of activities and its results;
dangers and sizes of the potential impact connected with implementation of activities and to its results;
possible effects in case of inadequate implementation of activities or negative results of activities.
2.6. The subject of activities provides timely adoption of all decisions, important for safety, taking into account results of consideration of all factors influencing safety. Consideration of these factors is performed according to the procedure that provides independent assessment, adoption of qualified and objective decisions.
