1. Approve the enclosed Regulations on licensing of transportations of passengers by the road transport equipped for transportations more than 8 people (except for case if the specified activities are performed by orders or for own needs of the legal entity or individual entrepreneur).

2. Recognize invalid:

Item of 23 changes which are made to acts of the Government of the Russian Federation concerning the state control (supervision), approved by the order of the Government of the Russian Federation of April 21, 2010 No. 268 "About modification and recognition voided some acts of the Government of the Russian Federation concerning the state control (supervision)" (The Russian Federation Code, 2010, No. 19, the Art. 2316);

Item of 24 changes which are made to orders of the Government of the Russian Federation concerning the state fee, approved by the order of the Government of the Russian Federation of September 24, 2010 No. 749 "About modification of some orders of the Government of the Russian Federation concerning the state fee" (The Russian Federation Code, 2010, No. 40, the Art. 5076);

the order of the Government of the Russian Federation of September 27, 2011 No. 790 "About modification of the order of the Government of the Russian Federation of October 30, 2006 No. 637" (The Russian Federation Code, 2011, No. 40, the Art. 5552).

3. Determine that subitems "e" and "zh" of item 4 of the Provision approved by this resolution become effective since January 1, 2013.

1. This Provision determines procedure for licensing of activities for transportation of passengers by the road transport equipped for transportations more than 8 people (except for case if the specified activities are performed by orders or for own needs of the legal entity or individual entrepreneur) (further - activities for transportation of passengers).

2. Licensing of activities for transportation of passengers is performed by Federal Service for the Oversight of Transport and its territorial authorities (further - the licensing body).

3. Activities for transportation of passengers the following works are included:

a) regular transportations of passengers in the city and suburban message;

b) regular transportations of passengers in the long-distance message.

4. Licensed requirements when implementing activities for transportation of passengers are:

a) availability at the license applicant (licensee) to the established requirements of the rooms and the equipment for maintenance and repair of vehicles belonging to it on the property right or other legal cause and conforming or agreement availability with the specialized organization on provision of services for maintenance and repair of vehicles;

b) availability at the license applicant (licensee) of the transport drivers who signed with it the employment contract or the service provision agreement and having necessary qualification and length of service, and also underwent medical examination in accordance with the established procedure;

c) availability at the license applicant (licensee) of the license for implementation of the medical activities providing performance of works (services) in medical examinations (pretrip, posttrip), or availability of the service provision agreement on performing medical examinations (pretrip, posttrip) with the legal entity or the individual entrepreneur having the license for implementation of medical activities providing performance of works (services) in medical examinations (pretrip, posttrip);

d) availability at the license applicant (licensee) on the property right or on other legal cause necessary for performance of works, stipulated in Item 3 this provision, the vehicles corresponding to destination and design to technical requirements to transported passengers and allowed in accordance with the established procedure to participation in traffic;

e) use by the licensee of the vehicles equipped in accordance with the established procedure with technical means of control of observance by the driver of the modes of movement, work and rest (when implementing regular transportations of passengers in the long-distance message);

j) observance by the licensee of the requirements established according to the Federal Law "About Transport Safety".

5. Implementation of activities for transportation of passengers by road transport with gross violation of licensed requirements involves the responsibility established by the legislation of the Russian Federation.
