About theaters, circuses and the concert organizations
The Parliament adopts this organic law.
This law determines the basic principles of creative activities of theaters, circuses and concert organizations, procedure for their creation, reorganization, liquidation, financing and management of them.
Tasks of this law are:
a) preserving local traditions and identity of theatrical culture and spectacular art, development and distribution of art achievements in the field of spectacular art, maintenance of the interethnic, regional and international cultural relations;
b) providing the rights of citizens to freedom of art creativity, on participation in art process, open entry to creativity of theaters, circuses and concert organizations;
c) providing legal guarantees of preserving state (including specialized educational institutions), municipal, departmental, local cultural institutions and art and harmonious development of such organizations, irrespective of form of business and type of property;
d) initiation and support of the local, national, international projects relating to the field of theater, circus and concert programs;
e) creation of conditions for discovery of new talents, permanent replenishment and updating of creative and artistic personnel of theaters, circuses, concert organizations;
f) creation of the legal base for financial and economic activities of public cultural institutions and art, and also system of social protection of employees of these organizations.
In this law the following basic concepts are used:
theater - the public cultural institution and arts satisfying cultural requirements of society and which is engaged in creative, productive, economic, technical, scientific, educational activity for the purpose of creation and representation alive before the audience of theatrical performances, holding other cultural events;
circus - the public cultural institution and arts satisfying cultural requirements of society, performing creative, productive, economic, technical, scientific, educational activity for creation and display alive before public of circus representations, holding other cultural events;
the concert organization - the public cultural institution, musical art, other art genres satisfying cultural requirements of society, which is engaged in creative, productive, economic, technical, scientific, educational activity for creation and representation before public of musical performances, display of concert programs, holding other cultural events.
creative personnel - the persons which are directly managing creative sectors and developing the single concept of the work of art, providing its complete scenic realization: the artistic director, the chief director, the director, the chief ballet master, the ballet master, the chief conductor, the conductor, the chief chorus master, the chorus master, the art director, the artist (the property man, the decorator, the sculptor, the lighter, the make-up artist, the fashion designer), the choreographer, the set designer, the composer, the playwright managing literary department, the manager of musical department, the leader of vocal, the leader of the ballet, the manager of literary part, the technical director, the sound producer managing troupe, the adviser to the artistic director, the vocal tutor, the ballet tutor, the tutor for diction, the circus tutor, the assistant, the sound technician, the prompter, etc.;
artistic personnel - persons realizing the concept and strategy offered by creative personnel in practice: actors of different genres, actors of symphonic and chamber orchestras, ensembles of song and dance, choral and choreographic collectives, orchestras of folk music, brass, simfo-jazz bands, variety orchestras and ensembles, actors of opera and chamber vocal, ballet, lyrical comedy and platform, reciter, actors of vocal and vocal and tool ensembles, original genres of platform, accompanist, kotsertmeyster, event host of the program, soloists, actors of circuses, inspector of arena, trainer, etc.
(1) the Purpose and tasks of this law follow from the state strategy of development for field of activity of theaters, circuses and concert organizations. This strategy is component of state policy in the field of culture and art and is based on recognition of value of spectacular art as important element of culture, means of preserving national consciousness and jointly the functioning languages, one of paramount social institutes of the state for support, improvement and development of moral and spiritual life of society. It is under construction on the following principles:
a) right to open entry to art creativity, to integration into all-art process;
b) uniqueness of talent and responsibility of the state for creation of conditions for its realization, including by means of training in specialized educational institutions;
c) recognition of creative independence of theaters, circuses, concert organizations and their support by government structures;
d) integration of national cultural process into world cultural process.
(2) For the purpose of implementation of the state strategy of development for field of activity of public cultural institutions and art bodies of the central branch public management:
a) support activities of the creative unions;
b) provide possibility of participation of non-governmental structures in development of this strategy, in development of development programs of culture and art for the short period and on perspective, programs of training and their employment, creation of proper working conditions and social protection of creative specialists, provision of financial privileges;
c) give help to non-governmental structures by subsidizing of some cultural programs and actions by means of provision of state orders on competitive basis.
(3) the State creates to theaters, circuses and the concert organizations, irrespective of property type, equal legal and economic conditions for activities, guarantees realization of their rights and legitimate interests, promotes development of free, fair competition between creators of theatrical performances, circus representations and concert programs, provides them equal opportunities when using intellectual and art potential of the country, material, natural, labor, financial and information resources, without allowing market monopolization of creators of art, regulates art business activity according to the current legislation.
(4) Organa of public management do not bear responsibility according to obligations of the state, municipal and local theaters, circuses and concert organizations. Public cultural institutions and arts do not bear responsibility according to obligations of bodies of public management.
