About approval of Instructions for use heat energy

For the purpose of establishment of procedure for use of heat energy and determination of relations of the heatsupplying organizations with consumers the Government of the Kyrgyz Republic decides:

1. Approve the enclosed Instructions for use by heat energy.

2. This Resolution becomes effective after 15 days from the date of official publication.

Instructions for use heat energy

Chapter 1. Terms and determinations

1. The terms and determinations used in these rules of use of heat energy (further Governed):

Emergency unloading - working hours of the heatsupplying organization in case of which reduction of leave of heat energy to consumers for the purpose of the prevention of violation of stability of system operation of heat supply is made.

Emergency armor - the smallest expense of heat energy providing in case of partial or complete stop of the company, safety of people, safety of the equipment, work of heating on duty, means of fire safety.

The residential customer of heat energy (population) - the consumer using heat energy on heating and hot water supply of premises.

Intra house system of heat supply (further - VDS) - set of the interconnected systems of pipelines and individual thermal Item.

Border of balance sheet accessory of thermal networks - the line of the Section of elements of thermal networks between owners on the basis of property or complete economic maintaining.

Limit of operational responsibility - the line of the Section of elements of system of heat supply of object established on the basis of obligations (responsibility) for their operation and maintenance according to the legislation of the Kyrgyz Republic and reflected in the Agreement.

The admission to operation of the heatusing installations and thermal networks - the procedure determining readiness of the heatusing installations and thermal networks for operation and which is coming to the end with signing of the act of the established sample.

Contractual size - the amount of heat energy approved in the Agreement on supply with heat energy between the heatsupplying or heat-transmitting organization and the consumer for the corresponding settlement period.

The housing organization (housing cooperative, condominium (condominium) form of business of property management of all owners of rooms (both residential, and non-residential) in the apartment apartment house or group of houses for joint management and ensuring operation with complex of real estate, ownership, use of common property and the order it in the limits set by the legislation of the Kyrgyz Republic.

Individual thermal Item - the complex of devices for accession of systems of heatconsumption to thermal network intended for distribution of the heat carrier by consumption types, servicing the building or its part.

The final consumer - the end user of heat energy.

The independent supplier - the legal entity or physical person having licenses for production, distribution and sale of heat energy which self-constructs heat energy and delivers it to the consumer.

Final settlement - settling with the consumer for the consumed heat energy after settlement period.

Having rummaged in giving of heat energy - interruption in supply of heat energy in point of connection of the consumer or the discrepancy of parameters of the heat carrier fixed by devices, to parameters the defined Agreement.

The payment document - the payment order, the account or the notification based on which payment by the consumer of heat energy, the performed works, the rendered services of the heatsupplying organization is made.

The consumer of the heatsupplying organization - the physical person or legal entity, thermal networks and (or) thermal installations of which are attached to networks of the heatsupplying organization and the Agreement having with it on heat supply.

The settlement metering device of heat energy - the metering device, system of accounting based on which indication the amount of the heat energy used by the consumer (subconsumer), subject for payment is determined.

Settlement period - period of time for which the amount of the consumed heat energy is determined and settlement for the consumed heat energy between the consumer and the heatsupplying organization is made. The settlement period approved by the parties is specified in the Agreement.

The subconsumer of heat energy - the consumer to whom heat energy is delivered by the heatsupplying organization through networks of the main consumer to whose networks he is attached.

The subconsumer of the heatsupplying organization - the consumer who is directly attached to thermal networks of the consumer of the heatsupplying organization and the Agreement having with him on use of heat energy and border of balance sheet accessory.

Thermal network - set of the devices intended for transfer of heat energy to consumers.

The heatusing installation - complex of the devices using heat energy for heating, ventilation, hot water supply and technology needs.

Technology armor of heat supply - the smallest duration of consumption of heat energy necessary for completion of engineering procedure, production cycle then the corresponding heatusing installations can be turned off.

The heatsupplying organization (licensee supplier) - the company (or the organization), being the legal entity and having in property or in complete economic conducting installation, the generating heat energy, thermal networks and providing transfer of heat energy to consumers on contractual basis.

The heat-transmitting organization (licensee transmitter) - the company (or the organization), being the legal entity and having thermal networks in property or complete economic maintaining. The heat-transmitting organization will be for the consumer the heatsupplying organization if the consumer is connected directly to its thermal networks.

Force majeur circumstances - the events caused by circumstances extraordinary and insuperable in this situation: natural disasters (earthquake, fall of meteorite, the fire, flood) and other events which action cannot be anticipated by means of practice of highly professional personnel.
