About approval of Rules of registration of the state aircrafts of Ukraine and Rules of certification of copy of the state aircraft of Ukraine

According to parts one and the second article 7 of the Air code of Ukraine and for the purpose of fulfillment of requirements of the Presidential decree of Ukraine of 15.01.98 No. 17 "About immediate measures on safety of aircraft of Ukraine" PRIKAZYVAYU:

1. Approve:

1.1. Rules of registration of the state aircrafts of Ukraine which are attached.

1.2. Rules of certification of copy of the state aircraft of Ukraine which are attached.

2. - to the Commander-in-chief of the Armed Forces of Ukraine to provide to the chief of the General Staff transfer of documentation of Service of registration and certification of the state aircrafts of logistics of Command of Air Forces of the Armed Forces of Ukraine in Management of regulation of activities of the state aircraft of Ukraine.

3. To provide to the head of department of regulation of activities of the state aircraft of Ukraine steady fulfillment of requirements of this order.

4. The order of the Minister of Defence of Ukraine of 02.12.98 No. 435 "About approval of the Regulations on order of registration of the state aircrafts of Ukraine and Regulations on procedure for test of condition of flight suitability of the state aircrafts of Ukraine and about issue and cancellation of certificates of suitability to flights", registered in the Ministry of Justice of Ukraine 28.01.99 for No. 48/3341, to declare invalid.

5. This order becomes effective from the date of its official publication.

Rules of registration of the state aircrafts of Ukraine

I. General provisions

1.1. These rules determine procedures and requirements to registration (re-registration) of the state aircrafts in the register of the state aircrafts of Ukraine, procedure for their exception of this register.

1.2. Terms which are used in these rules have such value:

the operating organization - military unit, repair shop or the organization of any form of business which directly performs operation of the state aircrafts and is responsible for technical condition;

the statement - the official appeal of the applicant to Management of regulation of activities of the state aircraft of Ukraine (further - Service of registration and certification of the state aircrafts of Ukraine) for the purpose of receipt of the registration certificate of the state aircraft, registration of its (re-registration) in the register of the state aircrafts of Ukraine or its exception of this register;

the applicant - the head (commander) of the operating organization who submitted the application to Service of registration and certification of the state aircrafts of Ukraine for the purpose of receipt of the registration certificate of the state aircraft, registration of its (re-registration) in the register of the state aircrafts of Ukraine or its exception of this register;

the register of the state aircrafts of Ukraine - the book in which the Service of registration and certification of the state aircrafts of Ukraine conducts the current registration of the state aircrafts of Ukraine;

the registration certificate of the state aircraft - the document of the established sample which contains information on the aircraft registered in the register of the state aircrafts of Ukraine;

registration number of the state aircraft - number which consists of group of figures and letters and is provided by Service of registration and certification of the state aircrafts of Ukraine to the specific aircraft which is registered in the register of the state aircrafts of Ukraine;

the certificate on exception of the state aircraft of the register of the state aircrafts of Ukraine - the document of the established sample which contains information on the aircraft excluded from the register of the state aircrafts of Ukraine;

the certificate of flight suitability of the state aircraft - the document testimonial of aircraft compliance to the existing requirements of flight suitability and granting the right to accomplishment of flights of the state aircraft within the operating operational restrictions;

The term the state aircraft is used in the value given in the Air code of Ukraine.

The terms "commission agreement", "broker", "consignor", "buyer" are used in the values given in the Civil code of Ukraine.

Other terms used in these rules are applied in the values given in the Air code of Ukraine and other regulatory legal acts of Ukraine concerning activities of the state aircraft of Ukraine.

II. General requirements

2.1. The register of the state aircrafts of Ukraine is kept by Service of registration and certification of the state aircrafts of Ukraine.

2.2. The Service of registration and certification of the state aircrafts of Ukraine is responsible for registration of the state aircrafts.

2.3. The state aircrafts, are subject to obligatory registration in the register of the state aircrafts of Ukraine.

2.4. The state aircrafts which are not included into the State register of civil aircrafts of Ukraine and registers of other countries are subject to entering into the register of the state aircrafts of Ukraine.

2.5. Ukraine does not recognize registration of the state aircraft in the register of other state if this aircraft is not excluded from the register of the state aircrafts of Ukraine.

2.6. Registration of the aircraft in the register of the state aircrafts of Ukraine determines its national identity to Ukraine.

2.7. Registration of the aircraft in the register of the state aircrafts of Ukraine is not the certificate of the property right to the aircraft of the operating organization.

2.8. The registration certificate of the state aircraft (the daleeregistratsionny certificate) is issued based on the registration application (re-registration) of the aircraft in the register of the state aircrafts of Ukraine (further - the registration application) and the documents provided by these rules.

2.9. If the registration certificate is lost, then based on materials of the office investigation made by the applicant, Management of regulation of activities of the state aircraft of Ukraine issues the duplicate of the registration certificate.

2.10. If the registration certificate became unsuitable for use, then based on the new registration application the new registration certificate after return to Service of registration and certification of the state aircrafts of Ukraine of earlier issued registration certificate can be issued.

2.11. The registration certificate, the certificate on exception of the state aircraft of the register of the state aircrafts of Ukraine (further - the certificate on exception) are signed by the head of department of regulation of activities of the state aircraft of Ukraine (in case of its absence - person fulfilling its duties) and Managements of regulation of activities of the state aircraft of Ukraine are sealed official.

2.12. Flights of the state aircrafts which are not registered in the register of the state aircrafts of Ukraine are forbidden.

2.13. Flights of the state aircrafts without identification marks or with signs of unspecified sample are forbidden, except as specified, by the provided Regulations on identification marks which are applied on aircrafts of the state aircraft of Ukraine, the approved order of the Ministry of Defence of Ukraine of July 20, 2015 to No. 347, registered in the Ministry of Justice of Ukraine on August 4, 2015 at No. 935/27380.

2.14. Registration of the state aircrafts is performed with observance of requirements of the current legislation of Ukraine concerning ensuring protection of the state secret.
