About approval of the Regulations on licensing procedure of provider of program service

National council of Ukraine concerning television and broadcasting according to Articles 13, 14 and 17, part two of article 24 of the Law of Ukraine "About National council of Ukraine concerning television and broadcasting", Articles 1, 24, 31, 39 and 40 Laws of Ukraine "About television and broadcasting" RESHILA:

1. Approve Regulations on licensing procedure of provider of program service which are applied.

2. Submit to legal support division this decision on state registration to the Ministry of Justice of Ukraine.

3. To department of communications with mass media and public organizations to place this decision in mass media.

4. Recognize invalid decisions of National council of Ukraine concerning television and broadcasting

of 19.04.2006 No. 357 "About approval of the Instruction about issue, prolongation, renewal and issue of the duplicate of the license of provider of program service"

of 20.01.2010 No. 2 "About renewal of action of the Instruction about issue, prolongation, renewal and issue of the duplicate of the license of provider of program service"

of 11.02.2010 No. 354 "About the number of the providers of program service performing activities in the same territory within administrative and territorial units" of 23.02.2011 No. 359 "About modification of the decision of National council

5. Control over the implementation of this decision to assign to the Chairman of National council of Ukraine concerning television and broadcasting V. Manzhosov.

6. This decision becomes effective from the date of its official publication.

Regulations on licensing procedure of provider of program service

I. General provisions

1.1. This Provision determines the mechanism of implementation of requirements of the Law of Ukraine "About television and broadcasting" concerning licensing of providers of program service and annual re-registration of the general concept (the principles, the bases) of selection of programs for relaying (the offer to subscribers).

1.2. For the purposes of this provision licensing of providers of program service is understood as issue, renewal, cancellation of licenses of providers of program service, issue of duplicates of licenses of providers of program service.

1.3. The license of provider of program service is granted according to the statement for issue (prolongation) of the license of provider of program service which form is given in appendix 1 to this Provision which is given by subject of managing which aims to render program service with use of resource of multichannel television network, irrespective of technology of provision of service.

II. Procedure for licensing of providers of program service

2.1. The license of provider of program service is the single legal cause for implementation of activities for provision of program service.

2.2. The license of provider of program service is the document of the state sample which is issued by National council of Ukraine concerning television and broadcasting (further - National council) and certifies the right of the licensee to provide program services with use of resource of multichannel television networks. In the license of provider of program service the relevant information given in appendix 2 to this Provision is noted.

2.3. The provider of program service shall satisfy license conditions. The national council controls accomplishment of program service of license conditions by providers, and in case of its violation applies sanctions according to requirements of the Law of Ukraine "About television and broadcasting".

2.4. Subject of managing which aims to obtain the license of provider of program service or the provider of program service who aims to extend the license of provider of program service submits to National council the application for issue (prolongation) of the license of provider of program service according to requirements of article 24 of the Law of Ukraine "About television and broadcasting" to which are applied:

copies certified of the procedure for constituent documents established by the legislation;

the documents confirming acquisition and the right to distribution (relaying) of programs of other speaker (according to information on programs which the provider of program service intends to relay, given in appendix 3 to this Provision);

the general concept of packaging (list) of the programs acquired for relaying for form according to appendix 3 to this Provision (total quantity of programs of program service, the number of domestic programs, the list of teleradio programs). The list of teleradio programs shall not contain programs which relaying is limited according to requirements of the legislation of Ukraine;

the data on structure of property of the applicant represented according to the Procedure for representation by the teleradio organizations and providers of program service of information on structure of property and corresponding document forms of the teleradio organizations and providers of program service approved by the decision of National council of Ukraine concerning television and broadcasting of January 21, 2016 No. 2, registered in the Ministry of Justice of Ukraine on February 17, 2016 for No. 251/28381;
