Chapter I General provisions

Article 1. Appointment and scope of this law

(1) This law regulates measures for strategy implementation and politicians of maintenance of the high employment level and adaptation of the population to work market requirements, on social protection of persons which are in job search, to prevention of unemployment and fight against its social consequences.

(2) For the implementation of measures and goal achievement provided by this law national strategy and programs in employment of the population and social protection of persons which are in job search affirm.

Article 2. Basic concepts

In this law the following concepts are used in value:

employer - the legal entity or physical person registered on legal causes in the territory of the Republic of Moldova, performing employment of citizens according to the law;

workplace - the environment determined in space and in time in which activities are performed revenue-producing, and legal employment relations materialize;

suitable work - the work corresponding to professional training, years of service and experience of activities in this profession, the state of health of person, being at acceptable distance from the residence and guaranteeing the monthly salary at a rate of not less than officially the established level of minimum wage;

person which is in job search - person registered in National employment agency of the population or in the private agency given according to the law authority on assistance in employment;

the unemployed - person meeting in total the following conditions:

a) being ranging from 16 years to the age established for emergence of pension entitlement on age or on other type of pension, except for pensions on the occasion of loss of the supporter and pension on restriction of opportunities to persons with limited opportunities to which according to the conclusion of the National consultation of establishment of restriction of opportunities and working capacity or its territorial structures employment is recommended;

b) for health reasons, to physical and mental capabilities suitable for accomplishment of certain work;

c) not having work and not performing activities for the purpose of income acquisition;

d) actively looking for work and ready to start it;

e) not studying at full-time department in educational institution;

f) registered in territorial agency of employment of the population in the place of permanent residence;

the unemployed long time - person which did not find work within the first 12 months from the date of registration as the unemployed;

the level of unemployment - the ratio between number of the unemployed and total number of able-bodied population expressed as a percentage and calculated at the national and territorial levels;

insured person - the able-bodied physical person who is constantly living or temporarily staying in the Republic of Moldova who gains income and for receipt of the rights shall make payments on the national social insurance for the purpose of the prevention, restriction or elimination of the social risks provided by the current legislation including risk of loss of workplace;

uninsured person - the able-bodied physical person who is constantly living in the Republic of Moldova who does not make payments on the national social insurance for the purpose of the prevention, restriction or elimination of the social risks provided by the current legislation including risk of loss of workplace;

occupied population - set of persons who perform economic or social activity therefore make products and render services for the purpose of receipt of salary incomes or other profits;

able-bodied population - set of the persons participating in social labor and performing professional activity and also persons of working-age, persons interested to work and ready to get to work;

employment of the population - the economic indicator reflecting extent of participation of able-bodied population in implementation of activities in any country;

the market of labor power - economic space in which meet, compared and freely labor demand of the owners of the capital acting as buyers and the offer of labor power are implemented by the owners that acting as the offerer;

private employment agency of the population - the legal entity performing activities for selection and employment of labor power in the country and/or abroad who has the license granted in the procedure established by the legislation;

selection and employment of labor power in the country and/or abroad - the intermediary services provided in case of employment, including activities for informing the parties mediations, preliminary selection or candidate screen according to requirements of the offered workplaces and according to professional training, capabilities and interests of candidates;

practical training – form of acquisition of work experience in any area.
