According to article 12 of the Law of the Republic of Belarus of October 24, 2016 "About legal executives" the Council of Ministers of the Republic of Belarus DECIDES:

1. Approve the enclosed Regulations on procedure and the amount of payment to legal executives of headquarters of forced execution of the Ministry of Justice and territorial authorities of forced execution of monetary compensation for use of the vehicles belonging to them in the office purposes.

2. This resolution becomes effective since March 19, 2012.

Regulations on procedure and the amount of payment to legal executives of headquarters of forced execution of the Ministry of Justice and territorial authorities of forced execution of monetary compensation for use of the vehicles belonging to them in the office purposes

1. This Provision determines procedure and the amount of payment to legal executives of headquarters of forced execution of the Ministry of Justice and territorial authorities of forced execution (further – legal executives) monetary compensation for use of the vehicles belonging to them in the office purposes (further – compensation).

2. The legal executives using the vehicles belonging to them in the office purposes receive compensation of cost of the spent fuels and lubricants.

Other expenses connected with use by legal executives of the vehicles belonging to them in the office purposes (depreciation (depreciation), repair, obligatory civil liability insurance of owners of vehicles, losses for the harm done to the vehicle, losses for the harm done by the vehicle, and other), legal executives bear at own expense.

3. Need of use by legal executives of the vehicles belonging to them for the office purposes is determined by the head of body of forced execution in case of which the legal executive, in the form of the written permission consists.

4. Compensation is paid from the money collected by relevant organ of forced execution in case of forced making of actions for property penalties.

Compensation can be paid to several legal executives consisting under body of forced execution.

The extreme amount of compensation constitutes seven basic sizes a month on body of forced execution.

5. For preparation of calculation for payment of compensation by the legal executive no later than the 5th following reporting are represented:

the statement of the legal executive addressed to the head of body of forced execution in case of which the legal executive consists containing position, surname, own name, middle name (if that is available) the legal executive, the name of the used vehicle;

the report on use of the vehicle (with indication of the distance in kilometers speedometer passed according to indications in case of accomplishment of service duties);

the copy (photocopy) of the written permission of the head of body of forced execution for use of the vehicle in the office purposes;

copy (photocopy) of the registration certificate (log book) of the vehicle;

the payment document confirming acquisition of fuels and lubricants (their cost).

6. Calculation of the amount of compensation is made by structural divisions of the Ministry of Justice, headquarters of justice of regional executive committee, the Minsk Gorispolkom to which financial accounting functions are assigned.

In need of compensation payment to several legal executives of the same body of forced execution the amount of compensation for each legal executive is determined in proportion to the incurred expenses (but no more extreme amount of compensation).

7. Compensation payment to the legal executive of body of forced execution is performed based on the order of the Minister of Justice, the chief of headquarters of justice of regional executive committee, the Minsk Gorispolkom. Representation to the Minister of Justice, chief of headquarters of justice of regional executive committee, Minsk Gorispolkom is brought by the head of relevant organ of forced execution with application of documents, specified in Item 5 of this provision.

Compensation is paid to the legal executive, as a rule, together with the salary for the second half of month.

8. The legal executives who provided false information on use of the vehicles belonging to them in the office purposes bear responsibility according to legal acts of the Republic of Belarus.

9. The chairmen of the courts who approved (claimed) documents for payment of compensation according to this Provision bear the personal responsibility for justification of payment of compensation.
