Material and technical resources, including means of the special account of the State inspectorate for supervision of industrial safety and to mountain supervision under the Ministry of natural resources of the Kyrgyz Republic to leave under the authority of the State Agency for Geology and Mineral Resources under the Government of the Kyrgyz Republic as legal successor of the Ministry of natural resources of the Kyrgyz Republic.

3. To the State Agency for Geology and Mineral Resources under the Government of the Kyrgyz Republic:

- together with the State inspectorate for ecological and technical safety under the Government of the Kyrgyz Republic to determine the list of the material means which are subject to transfer to the State inspectorate for ecological and technical safety under the Government of the Kyrgyz Republic for implementation of functions of control and supervision in the field of industrial safety;

- in three-months time to submit in accordance with the established procedure for consideration of the Government of the Kyrgyz Republic projects of regulations on the subordinated divisions and other regulatory legal acts of the Kyrgyz Republic following from this resolution.

4. Recognize invalid:

- Item 1 of the order of the Government of the Kyrgyz Republic "About the State inspectorate for supervision of industrial safety and mountain supervision under the Ministry of natural resources of the Kyrgyz Republic" of February 19, 2010 No. 108.

Regulations on the State Agency for Geology and Mineral Resources under the Government of the Kyrgyz Republic

1. General provisions

1. The State Agency for Geology and Mineral Resources under the Government of the Kyrgyz Republic (further - the Agency) is the state body of the executive authority realizing state policy in the field of subsurface use and development of the mining industry.

2. The State Agency for Geology and Mineral Resources under the Government of the Kyrgyz Republic is legal successor of the Ministry of natural resources of the Kyrgyz Republic.

3. The agency performs the activities according to the Constitution of the Kyrgyz Republic, the laws of the Kyrgyz Republic, regulatory legal acts, international treaties which came in accordance with the established procedure into force which participant is the Kyrgyz Republic, and also this Provision.

4. The agency is legal entity, has seal with the image of the State Emblem of the Kyrgyz Republic and the name in the state and official languages, special and other accounts in system of treasury of the Ministry of Finance of the Kyrgyz Republic.

5. The agency performs the activities in interaction with other state bodies of the executive authority, local public administration, local government bodies, public associations and other organizations.

The agency and the organizations subordinated to it provide single system of effective use of subsoil from expansion and completion of inventories of minerals before their production and conversion. 3. Tasks of the Agency

8. Tasks of the Agency are:

b) state regulation of questions of subsurface use and enhancement of management system by the state fund of subsoil;

c) protection of subsoil and the environment during the conducting exploration works and development of mineral deposits;

d) creating favorable conditions for development of the mining industry;

e) carrying out single technical policy in development of land and cartographical works, implementation of the latest developments of science and technology and the best practices in case of production of cartographical, land works.

4. Functions of the Agency

9. The agency performs the following functions:

a) Functions of realization of industry policy:

- realizes single state policy in the field of studying and rational use of subsoil;

- attracts direct foreign and domestic investments on conducting exploration works and in the mining industry;

- participates in development of the corresponding regulatory legal acts;

- participates in development of strategy of effective development of geological researches and the mining industry;

- participates in development of the current and perspective state, regional plans and industry programs of studying and use of mineral raw material resources and controls their accomplishment;

- performs representation of the Kyrgyz Republic in bodies of interstate management and the international organizations for the questions connected with competence of the Agency, according to the procedure and the cases provided by the corresponding regulatory legal acts of the Kyrgyz Republic and international treaties of the Kyrgyz Republic;

- participates in creation and implementation of interstate programs and agreements on studying of subsoil and development of mineral raw material resources;

- provides system carrying out geological studying of the territory of the Kyrgyz Republic for the purpose of identification and the forecast of new mineral deposits and the solution of tasks of scientific and applied value;
