1. This Provision determines procedure for licensing of the activities for transportations by inland water transport, sea transport of passengers performed by legal entities and individual entrepreneurs (further - transportations of passengers).
2. Licensing of activities for transportations by inland water transport, sea transport of passengers is performed by Federal Service for the Oversight of Transport and its territorial authorities (further - the licensing body).
3. Activities for transportations of passengers include the following works:
transportations by inland water transport of passengers, including with use undersized court;
transportations by sea transport of passengers, including with use of small size vessels.
4. The licensed requirements imposed to the license applicant (licensee) in case of performance of works on transportation by inland water transport of passengers are:
a) availability at the license applicant (licensee) on the property right or on other legal cause of the passengers of the courts conforming to requirements of the technical regulation about safety of objects of the inland water transport approved by the order of the Government of the Russian Federation of August 12, 2010 N 623 intended for transportation (if the specified requirements are applied to such courts);
b) availability at the license applicant (licensee) of the official responsible for ensuring safe operation of courts on inland waterways having length of service at least 3 years as the ship master, the senior assistant of the captain or the senior mechanic on inland navigation vessels or on ocean ships, secondary professional or higher education in "navigation" or "operation of ship power stations", and also the holding the post certified on the right in accordance with the established procedure (except for license applicants (licensees) transporting passengers with use of small size vessels);
c) availability at the license applicant (licensee) of life insurance contracts and health of members of crews of vessel in case of execution of service duties by them according to item 4 of article 28 of the Code of inland water transport of the Russian Federation;
d) availability for each vessel (except for the small size vessel) intended for transportation of passengers, the following documents:
the certificate on the property right to the vessel or the copy of the certificate on the property right to the vessel certified by the body which granted such certificate or the notary;
the certificate on the right of navigation of the vessel under National flag of the Russian Federation;
the certificate on the validity of the vessel to swimming;
ship sanitary certificate;
the certificate on prevention of environmental pollution from the vessel;
certificate or certificate on the minimum structure of crew of the vessel;
certificate on classification;
certificate of measurement;
(1)) availability for each small size vessel of the ship ticket;
e) availability for each vessel (except for the small size vessel) the ship certificate on safety management, stipulated in Article 34.1 Codes of inland water transport of the Russian Federation;
e) availability at the license applicant (licensee) of the insurance contract of the civil responsibility of carrier for damnification of life, to health and property of passengers according to the Federal Law "About Obligatory Civil Liability Insurance of Carrier for Damnification of Life, to Health, Property of Passengers and about Procedure for Compensation of Such Harm Done when Transporting Passengers by the Subway";
g) availability for each vessel of the ship plan of emergency measures for prevention of pollution by oil, stipulated in Article 39 Codes of inland water transport of the Russian Federation;
