According to part seven of Article 20 of the Budget code of Ukraine the Cabinet of Ministers of Ukraine decides:

1. Approve the Procedure for use of the means provided in the government budget for restructuring and liquidation of objects of the companies of mountain chemistry and implementation of urgent nature protection actions in zone of their activities, and also restructuring of the companies for underground production of iron ore which is applied.

2. Recognize invalid resolutions of the Cabinet of Ministers of Ukraine according to the list which is attached.

Procedure for use of the means provided in the government budget for restructuring and liquidation of objects of the companies of mountain chemistry and implementation of urgent nature protection actions in zone of their activities, and also restructuring of the companies for underground production of iron ore

1. This Procedure determines the mechanism of use of the means provided in the government budget according to the "Restructuring and Liquidation of Objects of the Companies of Mountain Chemistry and Implementation of Urgent Nature Protection Actions in Zone of Their Activities, and also Restructuring of the Companies for Underground Production of Iron Ore" program (further - budgetary funds).

2. The main manager of budgetary funds and the executive in charge of the budget program is the Ministry of Economic Development.

3. Receivers of budgetary funds are the Rozdolsky state mining and chemical company "Sirka", the Novoyavorovsky state company "Ekotransenergo", the state company "Krivbassshakhtozakrytiye".

4. Receivers of budgetary funds use budgetary funds according to the plan approved by the Ministry of Economic Development.

5. Budgetary funds are used for the purpose of restructuring of the mining and chemical companies for preserving own ore base of the chemical industry, overcoming negative demographic and social and demographic consequences and prevention of irreversible processes in zone of activities of the mining and chemical companies, and also preserving own (unique) ore base of metallurgical industry, overcoming negative demographic and social-and-ecological consequences, prevention of irreversible processes in the surrounding environment of Kryvbas.

6. Budgetary funds are allocated on:

1) accomplishment of such projects:

recovery of ecological equilibrium and recultivation of the lands broken by mining operations of the Yavorovsky state mining and chemical company "Sirka";

on completion in 2014 to liquidation of sulfuric pits, recovery of ecological equilibrium and landscape in zone of activities of the Rozdilsky state mining and chemical company "Sirka";

2) implementation of such working projects:

liquidation of the May Day mine and its transfer to the special mode of hydroprotection of mining operations and selitebny territories of Ternivsky district of of Kryvyi Rih;

first-priority measures for liquidation of the Saksagan mine;

liquidation of the mine "Giant";

3) debt repayment according to the budget obligations of last years, registered in bodies of Treasury.

7. The Ministry of Economic Development develops and approves the work plan on restructuring and liquidation of objects of the companies of mountain chemistry and implementation of urgent nature protection actions in zone of their activities and for restructuring of the companies for underground production of iron ore. The copy of the specified plan moves to the Ministry of Finance.

8. Purchase of goods, works and services at the expense of budgetary funds is performed in the procedure established by the law.

Advance payment of such goods, works and services is carried out taking into account provisions of the budget legislation.

The priority direction in capital construction is the aspiration of budgetary funds for objects with high degree of construction readiness.

10. Display in primary and financial accounting of information on the received (created) current and non-current assets, and also opening of accounts, registration, accounting of the budget obligations, in bodies of Treasury and carrying out the transactions connected with use of budgetary funds are performed in the procedure established by the legislation.

11. Receivers of budgetary funds give the Ministry of Economic Development quarterly to the 10th which comes behind the accounting period, information on accomplishment of the work plan specified in Item 7 of this Procedure on the form established by the Ministry of Economic Development in coordination with the Ministry of Finance.

The Ministry of Economic Development submits the specified information to the Ministry of Finance quarterly to the 20th which comes behind the accounting period, and annually till February 10 of the next year.

12. Creation and submission of financial and budget reports about use of budgetary funds, and also control of their target and effective expenditure are performed in the procedure established by the legislation.
