About the National plan of anti-corruption for 2012 - 2013 and introduction of amendments to some acts of the President of the Russian Federation concerning anti-corruption

According to Item 1 of part 1 of article 5 of the Federal Law of December 25, 2008 N 273-FZ "About anti-corruption" I decide:

1. Approve the enclosed National plan of anti-corruption for 2012 - 2013.

2. To make to presidium of Russian President's Council for Countering Corruption based on the materials represented by the Ministry of Labour and Social Protection of the Russian Federation explanations on application of acts of the President of the Russian Federation on anti-corruption subject.

3. To heads of federal executive bodies, other state bodies:

a) strengthen work of divisions of personnel services of the specified bodies for prevention of corruption and other offenses and provide till October 1, 2012 to the chairman of presidium of Russian President's Council for Countering Corruption the report on the done work;

b) being guided by the National strategy of anti-corruption approved by the Presidential decree of the Russian Federation of April 13, 2010 N 460, and the National plan of anti-corruption for 2012 - 2013 approved by this Decree to bring till July 1, 2012 in the plans for anti-corruption of the corresponding federal executive bodies, other state bodies of change directed to achievement of specific results to provide control over the implementation of the actions provided by plans.

4. Recommend:

a) To the Supreme Court of the Russian Federation to organize work on studying of practice of application by courts of the legislation of the Russian Federation on anti-corruption and to prepare, including taking into account the international obligations of the Russian Federation provided by the Convention on fight against bribery of foreign officials when implementing the international commercial transactions of November 21, 1997, the Convention on criminal liability for corruption of January 27, 1999 and the Convention of the UN against corruption of October 31, 2003, explanation to courts concerning application:

the penal legislation of the Russian Federation in the part concerning corruption crimes;

legislations of the Russian Federation on the administrative responsibility of legal entities for corruption offenses;

b) to public authorities of subjects of the Russian Federation and local government bodies:

stir up activities of councils on anti-corruption;

strengthen work of divisions of personnel services of the specified bodies for prevention of corruption and other offenses;

being guided by the National strategy of anti-corruption approved by the Presidential decree of the Russian Federation of April 13, 2010 N 460, and the National plan of anti-corruption for 2012 - 2013 approved by this Decree to bring till May 1, 2012 in the plans for anti-corruption of relevant organs of the government of subjects of the Russian Federation and local government bodies of change directed to achievement of specific results to provide control over the implementation of the actions provided by plans including with involvement of institutes of civil society.

5. Offer the Public chamber of the Russian Federation, Chamber of Commerce and Industry of the Russian Federation, the All-Russian public organization "Association of Lawyers of Russia", political parties, self-regulatory organizations, public organizations combining industrialists and entrepreneurs:

a) for the purpose of forming of complete system of public control to develop the federal law draft about public control in which to determine powers of institutes of civil society by implementation of public control over activities of federal executive bodies, public authorities of subjects of the Russian Federation and local government bodies, and to provide it to the chairman of presidium of Russian President's Council for Countering Corruption;

b) continue work on forming in the society of the intolerant attitude towards corruption behavior.

6. Bring in Regulations on representation by the citizens applying for the substitution of the state positions of the Russian Federation, and persons replacing the state positions of the Russian Federation, data on the income, on property and obligations of property nature approved by the Presidential decree of the Russian Federation of May 18, 2009 N 558 "About representation by the citizens applying for substitution of the state positions of the Russian Federation and persons replacing the state positions of the Russian Federation, data on the income, on property and obligations of property nature" (The Russian Federation Code, 2009, N 21, Art. 2543; 2010, N 3, to the Art. 274), change, having stated Item 10 paragraph two in the following edition:
