based on article 11 of the Agreement on uniform conditions of transit through the territories of the State Parties of the Customs union of January 22, 1998,
in view of article 7 of the Agreement on uniform conditions of transit through the territories of the State Parties of the Customs union of January 22, 1998,
agreed as follows.
The parties under mutual approval have the right to set restrictions for movement of separate types of goods by en route through the territories of the states, including to determine the list of check points through which movement of such goods is allowed.
Movement of ethyl alcohol (codes according to the Commodity Nomenclature of Foreign Economic Activity of the CIS 2207 10 000, 2207 20 000, 2208 90 910, 2208 90 990) in the cases established by articles 3 and 4 of the Agreement on uniform conditions of transit through the territories of the State Parties of the Customs union of January 22, 1998 through the territories of the states of the Parties it is allowed only by rail.
Import of ethyl alcohol in the territory of the states of the Parties is made only by railway or sea transport, including courts of the swimming mixed (river sea), through certain check points.
In the absence of through traffic between the State Parties of the Customs union, Party under mutual approval based on bilateral or multilateral arrangements can establish the rules of movement of ethyl alcohol other than rules of the this Protocol.
Each of the Parties will provide the list of check points through which movement of ethyl alcohol is allowed to Integration Committee. This list is subject to publication in the Bulletin of development of integration published by Integration Committee.
The parties have the right to refuse the omission in the territory of the states of the ethyl alcohol moved with violation of the conditions established by the this Protocol or to take to it measures, according to the national legal system.
The this Protocol is integral part of the Agreement on uniform conditions of transit through the territories of the State Parties of the Customs union of January 22, 1998.
The this Protocol becomes effective from the date of its signing, and for the states which need to perform interstate procedures, from the moment of delivery on storage to depositary of the adequate notice.
The this Protocol acts within year from the date of its signing and is automatically prolonged for the next year.
The either party has the right to leave the this Protocol, having sent to depositary the written notice of the intention at least in three months prior to exit, previously having settled the obligations assumed according to the this Protocol.
It is made in Moscow on October 26, 1999 in one authentic copy in Russian.
The authentic copy is stored in Integration Committee which will send to each Party its verified copy.
