Regulations on provision of services of Telecommunication system of bodies of public management according to appendix No. 1;

changes which are made to some orders of the Government according to appendix No. 2.

Regulations on provision of services of Telecommunication system of bodies of public management

I. General provisions

1. The regulations on provision of services of Telecommunication system of bodies of public management (further - the Provision) determine general terms of rendering services by Telecommunication system of bodies of public management, establish financial and material logistics, and also conditions of ensuring protection of Telecommunication system of bodies of public management.

2. In this Provision the following concepts are used:

The telecommunication system of bodies of public management (further System) - system of special telecommunications which is created and functions for ensuring needs of bodies of public management;

the operator - Public organization "Service of Information Technologies and Cybernetic Safety";

the user - bodies of public management, and also any other legal entity for the benefit of whom services of System are rendered; the services rendered by System - the basic and additional services rendered by the operator to the user.

II. Provision of services of System

3. Basic and additional services of System are provided by the operator.

4. Basic services of System include:

a) services in the protected exchange of interdepartmental information between bodies of public management and service in ensuring communication and access to the state information resources and systems - the Government Intranet;

b) services in provision to bodies of public management of access to worldwide network Internet;

c) services of system of e-mail of bodies of public management;

 d) ceased to be valid  

5. For ensuring the protected data exchange between bodies of public management basic services in the following cases are used:

a) in case of data exchange between information and telecommunication systems of bodies of public management.

b) when implementing access to resources of worldwide network the Internet;

c) in case of establishment of communication with external information and telecommunication systems;

d) in case of exchange of electronic correspondence between organizations;

e) by provision of access to the third parties to the state information resources and systems;

f) application of the digital signature in electronic documents of bodies of the public power.

6. The additional services rendered by system are determined by the operator and are provided based on the agreement.

7. Services of System are provided according to the rules of rendering services approved by the operator and also with technical rules on functioning of System.

8. The operator has the right to suspend rendering services in the following cases:

a) for the period of carrying out scheduled maintenance in the System hardware and software system;

b) in case of approach of force majeur circumstances;

c) in case of violation of safety of System if this violation poses threat for functioning of System;

d) in case of violation by the user of requirements of this provision.

III. Safety in the course of rendering services of System

9. Information security within System is provided with the operator, with use of complex technical and cryptographic means on data protection, and also by implementation of organization-legal and technical measures in the field.

10. Rendering services of System assumes observance by users of requirements in the field of cryptographic and technical information security and recurring inspection of observance of these requirements by the operator.

11. Security of services of System is provided by application of technological and administrative measures concerning technical means, programs, data and services, with respect for the principles of availability, integrity and confidentiality of information.

IV. Financial and material logistics of System

12. Financial and material logistics of functioning and development of System, including payment of basic services, is performed for:

a) the users specified in the List of the public subjects provided with basic services, approved by the Government within budgetary appropriations;

b) other customers - at the expense of own means on contractual basis.

13. Ceased to be valid.

15. Payment of the additional services of system provided by the operator is performed at the expense of means of the user.

16. Connection and reconnection of users to System is performed within budgetary appropriations or for their own account.

Changes which are made to some orders of the Government

1. In Item 1 of the Order of the Government No. 1487 of December 12 2003,. "About some measures for accomplishment of the Order of the Government No. 735 of June 11, 2002" (2003, No. 248-253, of the Art. 1542) the words "Services of Information and Safety" to exclude the official monitor of the Republic of Moldova.

2. In Item 41 of the Regulations on procedure for the creation and the organization of activities of the centers of certification of open keys approved by the Order of the Government No. 945 of September 5 2005,. (Official monitor of the Republic of Moldova, 2005, No. 123-125, of the Art. 1020), to exclude the words "Services of Information and Safety".
