About approval of the National program for control over tobacco for 2012-2016
For the purpose of realization of provisions of the Law on ratification of the Framework convention of the World Health Organization on control over tobacco No. 124-XVI of May 11, 2007. (The official monitor of the Republic of Moldova, 2007, Art. No. 78-81, 362), with subsequent changes, the Law on tobacco and tobacco products No. 278-XVI of December 14, 2007. (The official monitor of the Republic of Moldova, 2008, Art. No. 47-48, 139), with subsequent changes and amendments, and also the Law on the state supervision of public health No. 10-XVI of February 3, 2009. (The official monitor of the Republic of Moldova, 2009, No. 67, the Art. 183) DECIDES: the Government
1. Approve:
The national program for control over tobacco for 2012-2016 according to appendix No. 1;
Staff of National coordination council in the field of control over tobacco according to appendix No. 2;
Regulations on National coordination council in the field of control over tobacco according to appendix No. 3.
2. To the ministries and central administrative authorities:
take necessary measures for accomplishment in full and at the scheduled time of provisions of the National program for control over tobacco for 2012-2016;
provide annually in limits of the approved means of assignment for implementation of measures provided by the specified Program;
annually till May 30 to inform the Ministry of Health on the course of accomplishment of this Program.
3. To the Ministry of Health till July 1 to submit to the Government the annual statement about realization of provisions of the National program for control over tobacco for 20122016 years.
4. Recommend to bodies of local public authority to undertake measures for development and approval of local annual plans of actions for implementation of the National program for control over tobacco for 2012-2016.
5. Determine that financing of the actions provided by the National program for control over tobacco for 2012-2016 will be performed for the account and within the means of the national public budget and other financial sources which are not contradicting the legislation.
6. Determine that in case of release from the held public positions of members of council of their power in its structure persons who are again appointed to the corresponding positions without adoption of other order of the Government will carry out.
7. To impose control over the implementation of this Resolution on the Ministry of Health.

to the Order of the Government of the Republic of Moldova of February 16, 2012 No. 100
1. The national program for control over tobacco for 2012 - 2016 years (further - the Program) is the document on strategic planning of state policies on control over tobacco in the Republic of Moldova and establishes tasks for the medium-term period which need to be realized for implementation of state policy in the field of reducing consumption of tobacco products and impact of smoking on the state of health of the population.
2. The program was developed according to provisions of the Law No. 124-XVI of May 11, 2007 on ratification of the Framework convention of the World Health Organization on control over tobacco (further - RKKT) and the guidelines accepted by the Conference of the Parties according to the Law on tobacco and tobacco products No. 278XVI of December 14, 2007, to the Law on the state supervision of public health No. 10-XVI of February 3, 2009, the National policy in the field of health approved by the Order of the Government No. 886 of August 6, 2007, to the Agreement on accession between the Republic of Moldova and the European Union regarding coordination of the European Union law and the legislation of the Republic of Moldova and to the Report of the Mission of the European Union (October, 2010) which is basis of this Agreement, in view of application and coordination with directives and recommendations of the European Union and to other international documents in the field.
3. This Program describes the current situation in the field, determines necessary tasks, measures and actions and establishes accurate obligations for all participants performing actions for control over tobacco including necessary actions for harmonization of the national legal system in the field of control over tobacco with European Union directives concerning tobacco and recommendations and the RKKT protocols.
4. Consumption of tobacco products is one of the leading causes of death in the world which can be prevented. Smoking kills about a half of smokers, having been the cause of every tenth death among adults, and reduces the smoker's life on average by 15 years.
Smoking represents one of the main problems of modern society, more people, than from AIDS, alcoholism and drug addiction, the road accidents, murders, suicide become its victims annually, and are one of basic reasons of death who can be warned. In the XX century epidemic of tabakozavisimost led about 100 million people to death.
At world level according to forecasts of the World Health Organization in 2012 the tabakozavisimost will become cause of death about 5 million people, including 1,2 of one million Europeans. This figure does not include 600 000 people who die because of passive smoking, among which and 150 000 children.
5. Scientific research proves that consumption of tobacco products is the main reason of development of some fatal diseases. Smoking is also the major risk factor and the reason at least six destructive chronic diseases: heart diseases, cancer, tserebrovaskulyarny diseases, diabetes, destructive and chronic pulmonary diseases and atherosclerosis. Consumption of tobacco is the reason over 50% of malignant tumors (from them 90% are constituted by lung cancer), 80% of chronic bronchitis, emphysemas of lungs and obstructions of airways, more than a half of cardiovascular diseases (heart attack, atherosclerosis) and tserebrovaskulyarny diseases.
Smoking doubles risk of infertility at women, leads to violation of potentiality at men and provokes sterility. Specialists claim that smoking at youthful and teenage age leads to the wrong development of brain structures with adverse and unpredictable effects for mental health. The situation becomes even more disturbing taking into account that smoking even more often practices among children and youth, and average age of the beginning smokers becomes more and more early. It should be noted what what at earlier age of people begins to smoke, especially smoking consequences are destructive - at early age they are more destructive as the probability that young people will become permanent smokers is high, and it will be more difficult to refuse smoking. At the smoking expectant mothers the bad development of fruit provoked by weakening of blood-groove in uterus and placenta and lowering of concentration of oxygen in blood is observed. Thus, the risk of abortion and/or underdevelopment of fruit increases. Smoking at the beginning of pregnancy of mother can be the cause of low weight of fruit, premature birth, development of anomalies, such as lack of extremities.
6. Along with ratification of RKKT Republic of Moldova undertook to protect present and future generations from destructive consequences of smoking and from the impact made by tobacco smoke on human health, the environment, social and economic environment by realization of certain measures for control over tobacco for the purpose of gradual and considerable decrease in level of consumption of tobacco and impact of tobacco smoke.
7. Thus, the Republic of Moldova developed the legal base concerning the certain aspects connected with prohibition on advertizing, sale and distribution of tobacco products, prohibition on smoking in public places, in government, educational institutions, healthcare institutions, entertaining organizations and on public transport. According to provisions RKKT warnings of harm of smoking which shall occupy the most part of packaging are regulated. The structure of tobacco products is also regulated and sale of tobacco products to persons is forbidden 18 years are younger. Despite it, the conducted researches prove insufficient efficiency of state policies and insufficient measure for permanent and considerable decrease in level of consumption of tobacco and passive smoking, and also the fact of availability of certain difficulties on implementation of the existing legal base and the fact that it will not be completely harmonized with RKKT and the European legislation.
