Agreement on the single commodity nomenclature of foreign economic activity of the Commonwealth of Independent States

The governments of the State Parties of the Commonwealth which are hereinafter referred to as - Contracting Parties,

aiming at unification of forms of customs documentation and simplification of customs procedures,

agreed as follows:

Article 1

For implementation of measures of tariff and non-tariff regulation of foreign economic activity, enhancement of maintaining the statistical recording and exchange of statistical information Contracting Parties accept the single Commodity nomenclature of foreign economic activity of the Commonwealth of Independent States (the Commodity Nomenclature of Foreign Economic Activity of the CIS) which is integral part of this agreement and based based on the Harmonized commodity description and coding system of World Customs Organization.

Article 2

1. The Customs Service of the Russian Federation performs maintaining the Commodity Nomenclature of Foreign Economic Activity of the CIS, including:

monitors changes and amendments of the international basis of the Commodity Nomenclature of Foreign Economic Activity of the CIS, explanations and other decisions on interpretation of this basis;

brings the Commodity Nomenclature of Foreign Economic Activity of the CIS into accord with its international basis;

performs maintaining and storage of reference copy of the Commodity Nomenclature of Foreign Economic Activity of the CIS;

develops together with Customs Services of other State Parties of the Commonwealth of the explanation and at the request of Council of heads of Customs Services of the State Parties of the Commonwealth approves classification decisions on interpretation of the Commodity Nomenclature of Foreign Economic Activity of the CIS;

provides publication of the Commodity Nomenclature of Foreign Economic Activity of the CIS, explanations to it;

performs other functions necessary for maintaining the Commodity Nomenclature of Foreign Economic Activity of the CIS.

2. Council of heads of Customs Services of the State Parties of the Commonwealth claims:

decisions on reduction of the Commodity Nomenclature of Foreign Economic Activity of the CIS in compliance with its international basis;

decisions on modification and amendments in the Commodity Nomenclature of Foreign Economic Activity of the CIS;

reissuing terms (in need of) the staticized versions of the Commodity Nomenclature of Foreign Economic Activity of the CIS;

explanations on interpretation of the Commodity Nomenclature of Foreign Economic Activity of the CIS.

Article 3

Contracting parties take measures for introduction of the necessary amendments and changes in the national legal system connected using the Commodity Nomenclature of Foreign Economic Activity of the CIS.

Article 4

Any Contracting Party can stop the participation in this agreement, having sent the adequate written notice to depositary. The Agreement for such Contracting Party is terminated after 6 months from the date of obtaining by depositary of the mentioned notification.

Article 5

This agreement becomes effective from the date of its signing.

It is made in the city of Moscow on November 3, 1995 in one authentic copy in Russian. The authentic copy is stored in the Executive secretariat of the Commonwealth of Independent States which will send to each state which signed this agreement, its verified copy.
