About approval of the Regulations on free warehouses

For the purpose of realization in the Republic of Belarus Agreements on the Customs code of the Eurasian Economic Union of April 11, 2017, creations of conditions for development of free warehouses I decide:

1. Approve the enclosed Regulations on free warehouses.

2. Recognize to invalid:

The presidential decree of the Republic of Belarus of October 15, 2007 No. 512 "About modification and amendments in the Presidential decree of the Republic of Belarus of November 24, 2005 No. 545" (The national register of legal acts of the Republic of Belarus, 2007, No. 250, 1/9011);

subitem 3.4 of Item 3 of the Presidential decree of the Republic of Belarus of October 25, 2007 No. 534 "About measures for enhancement of security activities" (The national register of legal acts of the Republic of Belarus, 2007, No. 262, 1/9048).

3. In three-months time to provide to Council of Ministers of the Republic of Belarus reduction of acts of the legislation in compliance with this Decree and to take other measures for its realization.

4. To impose control over the implementation of this Decree on the State Control Committee.

5. This Decree becomes effective in 10 days after its official publication, except for Item 3 and this Item which are becoming effective from the date of official publication of this Decree.

Regulations on free warehouses

Chapter 1. General provisions

1. Are regulated by this Provision:

conditions and procedure for inclusion of the legal entities interested in implementation of activities as the owner of free warehouse in the register of owners of free warehouses and exception of this register, and also procedure for suspension of operations as the owner of free warehouse and its renewal;

procedure for maintaining register of owners of free warehouses;

requirements to arrangement, equipment and functioning of free warehouse;

obligations of the owner of free warehouse and condition of implementation of activities as the owner of free warehouse;

single questions of making of transactions with the goods placed (placed) under customs procedure of free warehouse and (or) which are in free warehouse.

2. In this Provision the main terms and their determinations in the values established by the Customs code of the Eurasian Economic Union, the legislation of the Republic of Belarus and also the following terms and their determinations are used:

the interested person - the legal entity interested in implementation of activities as the owner of free warehouse;

technical means - barriers, systems of the alarm system, means of video surveillance, and also other means necessary for ensuring control of goods and detection of their unauthorized movement through perimeter of the protected zone;

the register of owners of free warehouses (further - the register) - data set, created by the State Customs Committee, about owners of free warehouses.

3. Part one is excluded.

In the territory of free warehouse temporary storage of the goods intended for the room under customs procedure of free warehouse and the subsequent stay in this warehouse according to such customs procedure is allowed.

4. Free warehouses can be used also for storage of the goods detained or withdrawn by customs authorities according to the legislation of the Republic of Belarus.

When placing goods on free warehouse by customs authorities remuneration for storage and indemnification to owners of free warehouses are performed at the expense of persons determined by the legislation of the Republic of Belarus.

5. Part one is excluded.

Legal entities have the right to perform activities as the owner of free warehouse after inclusion in the register.

6. Implementation of business activity as the owner of free warehouse is forbidden by the faces which are not included in the register and attracts responsibility according to legal acts of the Republic of Belarus.

7. The legal entities with the location in the Republic of Belarus created according to the legislation of the Republic of Belarus have the right to inclusion in the register.

The right to inclusion in the register can be exercised in case of observance established by the Customs code of the Eurasian Economic Union and this Provision of conditions of inclusion in the register.

8. Inclusion of the legal entity in the register and exception of it, and also suspension of operations as the owner of free warehouse and its renewal are performed by the State Customs Committee according to this Provision according to the decision of the President of the Republic of Belarus on consent to inclusion in this register or exception of it, on suspension of operations as the owner of free warehouse or its renewal.
