The government of the Kyrgyz Republic and the Cabinet of Ministers of Ukraine which further are referred to as with the Parties

being guided by aspiration to further strengthening of the friendship existing between both states

considering interest of the Parties in preserving and development of interstate government communication,

agreed as follows:

Article 1

For the purposes of this agreement stated below terms mean:

"Competent authorities" - the Ministry of homeland security of the Kyrgyz Republic and the Security Service of Ukraine;

"government communication" - the encoded telephone and document communication;

"interstate government communication" - the system of government communication intended for exchange of confidential information between subscribers of government communication of the Kyrgyz Republic and Ukraine;

"cryptography tools" - manual codes, the cryptographic and coding equipment, confidential reserve property and belongings to them, regulating and technical documentation, shifrklyuch and the equipment for their production.

Article 2

The parties will organize the permanent interstate government communication intended for exchange of confidential information between subscribers of government communication of the Kyrgyz Republic and Ukraine.

The parties have the equal rights on the organization of technical operation and safety of interstate government communication.

Questions of the organization, technical operation, safety and smooth functioning of interstate government communication are solved Competent authorities.

Article 3

Government communication for management officials of the state of one Party in case of their temporary stay in the territory of the state of other Party is provided in the amount and procedure approved by Competent authorities.

The organization of communication channels and subscriber lines, and also installation of the means of government communication necessary for this purpose, is performed at the expense of the concerned party.

Article 4

Each of the Parties provides, according to the mutual arrangement, in the territory of the state government communication for officials of the state of other Party according to the procedure operating in the territory of its state if other conditions are not stipulated by the corresponding intergovernmental agreements.

Payment for provision of government communication is performed by Competent authority of the concerned party.

Article 5

Expenses between the Kyrgyz Republic and Ukraine within the territories of each state are paid for creation, commissioning, technical operation and further enhancement of interstate government communication with each of the Parties independently.

Article 6

The parties charge to Competent authorities on mutually advantageous conditions:

- carry out research and construction work in the field of development and production of new systems and means of communication for interstate government communication according to the procedure determined by the separate documents approved by Competent authorities;

- interact in the field of production of means of government communication;

- interact according to the solution of questions in the field of cryptographic and technical information security;

- perform preparation, retraining and advanced training of personnel of Competent authorities.

Article 7

The parties shall provide in agreed volumes delivery of the cryptography tools, the equipment and means of communication, components and spare parts necessary for the organization and operation of interstate government communication between the Kyrgyz Republic and Ukraine, and also national networks of government communication, according to the current legislation and the procedure of export control of the states of both Parties and with observance of the international obligations.

Article 8

Mutual deliveries between the Kyrgyz Republic and Ukraine of the cryptography tools, the equipment and means of communication, components and spare parts, and also the organization of repair and provision of services of special purpose are performed on contractual basis.

Article 9

The parties charge to Competent authorities, on mutually agreed conditions, to perform through the military representations, at the relevant companies, military control of development, production, delivery and operation of the cryptography tools, the equipment and means of communication, components and spare parts.

Article 10

The parties are determined that Russian is working language in case of interaction of Competent authorities on realization of the questions following from this agreement.

Article 11

The parties charge to Competent authorities to conduct negotiations for the purpose of the solution of the questions following from this agreement.

Article 12

In this agreement by mutual consent of the Parties, changes and additions which are drawn up by the Protocol can be made.

Article 13

This agreement becomes effective from the date of the last written notice of accomplishment of interstate procedures by the Parties, and will be effective within five years.

The duration of the agreement will be extended automatically for the subsequent five-year periods if any of the Parties at least in six months prior to the expiration of the next period does not notify in writing other Party on the desire to stop its action.

It is made to Kiev on April 25, 2000 in duplicate, everyone in the Kyrgyz, Ukrainian and Russian languages, and all texts have identical legal force.

In case of disagreements in case of interpretation of this agreement, the Party will be guided by the text in Russian.
