Some questions of protection of the right of consumers (users) concerning safety of non-food products

According to part two of article 7 of the Law of Ukraine "About general safety of non-food products" and part one of article 11 of the Law of Ukraine "About the state market supervision and control of non-food products" the Cabinet of Ministers of Ukraine decides:

1. Approve the Procedure for accounting of addresses of consumers (users) and implementation of monitoring of accidents and cases of damnification to human health as a result of consumption (use) of non-food products which is applied.

2. Bring in the Procedure for investigation and accounting of accidents of non-productive nature approved by the resolution of the Cabinet of Ministers of Ukraine of March 22, 2001 No. 270 (The Official Bulletin of Ukraine, 2001, No. 13, Art. 543; 2007, No. 90, Art. 3306; 2009, No. 64, the Art. 2249), changes which are applied.

Procedure for accounting of addresses of consumers (users) and implementation of monitoring of accidents and cases of damnification to human health as a result of consumption (use) of non-food products

1. This Procedure determines the mechanism of accounting of addresses of consumers (users) about protection of their right to safety of non-food products (further - addresses of consumers), implementation of monitoring of such addresses, the reasons and the number of accidents and cases of damnification for human health as a result of consumption (use) of non-food products.

2. For the purpose of implementation of monitoring of the reasons and the number of addresses of consumers territorial authorities of the state market supervision in the respective sphere of responsibility, and in case of their absence - bodies of the state market supervision in the respective sphere of responsibility (further - bodies of market supervision) record such addresses in form which affirms the head of body of market supervision.

3. Bodies of market supervision perform monitoring of the reasons and the number of addresses of consumers, the reasons and the number of accidents and cases of damnification for human health as a result of consumption (use) of products (further - monitoring).

4. Monitoring is performed on the basis:

the consumers this concerning calls accounting;

reports of the territorial authorities of body of market supervision constituted based on acts of verifications of characteristics of non-food products;

messages of treatment-and-prophylactic institutions in which addressed or were delivered injured as a result of consumption (use) of non-food products.

5. During monitoring implementation bodies of market supervision interact and communicate among themselves, with customs authorities, the central executive bodies which exercise supervision and control of non-food products, law enforcement agencies, public organizations of consumers (associations of consumers) and associations of subjects of managing.

6. The body of market supervision by results of monitoring prepares and submits annually till March 1 of Ministry of Economics the report on the reasons and the number of addresses of consumers, the reasons and the number of accidents and cases of damnification for human health as a result of consumption (use) of products.

Changes which are made to the Procedure for investigation and accounting of accidents of non-productive nature

1. According to the procedure:

add Item 3 with subitem 15 of such content:

"15) consumption (use) of non-food products.";

to add Item 6 after paragraph two with the new paragraph of such content:

"about each accident which resulted from consumption (use) of non-food products - to body of the state market supervision in the respective sphere of responsibility;".

With respect thereto third - the fifth to consider paragraphs respectively paragraphs the fourth - the sixth.

2. To add appendix 1 to the Procedure after words of "body of prosecutor's office" with words ", body of the state market supervision".
