ORDER OF THE GOVERNMENT OF THE KYRGYZ REPUBLIC

of December 30, 2011 No. 767

About measures for economy of means of the government budget due to reducing office and motor transport on duty state bodies and local government bodies of the Kyrgyz Republic

For the purpose of streamlining and rational use of the budgetary funds allocated for maintenance of the state bodies and local government bodies financed from the government budget of the Kyrgyz Republic, introduction of the mode of stringent restriction of use of office and motor transport on duty, the Government of the Kyrgyz Republic decides:

1. Approve the list of the service employees having the right to use services of personal office motor transport, according to appendix 1.

2. Establish:

- limit of number of passenger motor transport on duty for servicing of state bodies (except for special cars) according to appendix 2;

- limit of number of passenger motor transport on duty for servicing of offices of plenipotentiaries of the Government of the Kyrgyz Republic in areas, local public administrations and local government bodies according to appendix 3;

- the maximum useful life of passenger office motor transport of state bodies, local government bodies and budgetary institutions - 7 years from the date of acquisition of motor transport.

3. Prohibit state bodies and local government bodies use of office and motor transport on duty:

- on the purposes which are not connected with execution of direct duties by service employees of state bodies, local government bodies including in days off and holidays, and also in off-duty time;

- for servicing of members of families of heads of state bodies and local government bodies.

4. Determine that:

- the engine displacement of the used passenger motor transport on duty shall not exceed 2700 cubic cm, except for office motor transport for servicing of the service employees specified in appendix 1 to this resolution;

- fuel usage of motor transport shall not exceed:

500 liters a month for the office motor transport assigned to management of the Government of the Kyrgyz Republic, the chairman of the Supreme Court of the Kyrgyz Republic, the chairman of the Constitutional chamber of the Supreme Court of the Kyrgyz Republic and heads of local public administrations;

550 liters a month for the office motor transport assigned to heads of local public administrations with the remote settlements;

840 liters a month for the office motor transport assigned to plenipotentiaries of the Government of the Kyrgyz Republic in areas;

480 liters a month for the motor transport on duty assigned to offices of plenipotentiaries of the Government of the Kyrgyz Republic in areas;

240 liters a month for office and motor transport on duty assigned to state bodies and local government bodies and the motor transport on duty assigned to local public administrations;

- number boards of the KG series are intended only for official cars of members of the government of the Kyrgyz Republic;

- acquisition of motor transport with the period of use of more than 10 years from the date of release is forbidden;

- for servicing of service employees, except for the service employees specified in appendix 1, passenger vehicles worth no more than 750 000 som are acquired;

- forming of special means of the state bodies and budgetary institutions for the income account received from rendering transport services is not allowed, except for Motor transportation merging of Administration of the President of the Kyrgyz Republic and the Motor transportation company of Business management of Jogorku Kenesh of the Kyrgyz Republic.

5. Permit state bodies and local government bodies:

- perform hiring of transport services by the conclusion of contracts with Motor transportation merging of Administration of the President of the Kyrgyz Republic or private enterprises within the set limit;

- use personal vehicles in the office purposes, with payment of compensation for the regulations established by the Government of the Kyrgyz Republic.

6. Provide to Administration of the President and the Governments of the Kyrgyz Republic right of disposal of the office and vehicles on duty which are in its operational management, in economic maintaining its subordinated organizations in operational management, economic maintaining and urgent use to state bodies, within limit of vehicles, the stipulated in Item 2 presents of the resolution, and also to public institutions and the companies.

6-1. To heads of the ministries, state committees, administrative departments, local public administrations, state commissions:

- provide submission to Administration of the President and the Governments of the Kyrgyz Republic and Fund for management of state-owned property under the Government of the Kyrgyz Republic information on the beginning of projects implementation, financed by the international organizations within which vehicles are acquired or allocated;

- transfer to operational management of Administration of the President and Government of the Kyrgyz Republic the vehicles which are in operational management or economic maintaining acquired or allocated within implementation of the different projects financed by the international organizations, in process of their completion, the set limits which did not enter in, including at the expense of grants and other sources of financing.

7. To fund for management of state-owned property under the Government of the Kyrgyz Republic together with Administration of the President of the Kyrgyz Republic in accordance with the established procedure:

- make the offer on released cars of state bodies and local government bodies according to appendices 2 and 3 to this resolution;

- together with state bodies to carry out inventory count of office motor transport of budgetary institutions, and also specialized cars.

8. To the Ministry of Foreign Affairs of the Kyrgyz Republic together with the Ministry of Finance of the Kyrgyz Republic in two-month time to introduce to the Government of the Kyrgyz Republic the draft of regulatory legal act on establishment of limit of quantity and cost of office and cars on duty for servicing of diplomatic organizations and representations of the Kyrgyz Republic abroad, taking into account their reducing.

9. Recommend to the Office of the President of the Kyrgyz Republic, the Office of Jogorku Kenesh of the Kyrgyz Republic, judicial bodies and other state bodies in case of approval of procedure and conditions of providing with vehicles to be guided by this resolution.

10. Operation of this resolution does not extend to bodies and organizations of Armed Forces of the Kyrgyz Republic, other military forming, law enforcement agencies, the State center of judicial examinations under the Ministry of Justice of the Kyrgyz Republic and to diplomatic organizations and representations of the Kyrgyz Republic abroad.
