Regulations on the Headquarters on coordination of military cooperation of the State Parties of the Commonwealth of Independent States

This Provision determines functions, the rights, structure and structure, and also the organization of activities of the Headquarters for coordination of military cooperation of the State Parties of the Commonwealth of Independent States and its officials.

I. Main terms

1. Terms in this Provision mean:

1.7. Representatives of armed forces of the states of Sodruzhestvapredstaviteli of the Ministries of Defence of the directing states of the Commonwealth.

1.8. Bodies of the Headquarters - command, managements, the directions, departments and other bodies provided by organizational structure.

1.9. The military personnel of the Headquarters is the military personnel of armed forces of the State Parties of the Commonwealth of Independent States serving in the Headquarters on coordination of military cooperation of the State Parties of the Commonwealth of Independent States.

1.10. Civil personnel of the Headquarters - the citizens of the host state of the Commonwealth consisting with the Headquarters in employment relationships.

1.11. Staff of the Headquarters - military personnel and civil personnel of the Headquarters on coordination of military cooperation of the State Parties of the Commonwealth of Independent States.

1.12. Members of families are members of families of the military personnel and civil personnel of the Headquarters on coordination of military cooperation of the State Parties of the Commonwealth of Independent States.

1.13. The directing state - the state of the Commonwealth which sent the military personnel to structure of the Headquarters on coordination of military cooperation of the State Parties of the Commonwealth of Independent States.

1.14. The host state - the state of the Commonwealth in the territory of which the permanent location of the Headquarters is determined by coordination of military cooperation of the State Parties of the Commonwealth of Independent States.

II. General provisions

2. The headquarters are interstate permanent working body of the Council of Ministers of Defense, according to the status not below the general (main) headquarters of armed forces of the host state and are intended for assistance to development of comprehensive military state cooperation of the Commonwealth and coordination of implementation of decisions of Council of heads of states, Council of Heads of Government and the Council of Ministers of Defense in this area.

2.1. The headquarters in the activities are guided by the Charter of the Commonwealth of Independent States, contracts and agreements signed within the Commonwealth, decisions of Council of heads of states. Council of Heads of Government and Council of Ministers of Defense, and also this Provision.

2.2. The headquarters are legal entity and, within the powers having the right to sign on its own behalf agreements, to acquire the property and personal non-property rights and to perform duties, to be claimant and the defendant in court and arbitration (economic court).

2.3. Legal status of representatives of armed forces of the states of the Commonwealth and staff of the Headquarters is determined by the free standing agreement:

III. Functions of the Headquarters

3. As the Headquarters enters:

3.1. Collection, generalization and the analysis of open information on the military-political situation in the world and regions which is of interest to the states of the Commonwealth, preparation of reports based on this information to the Council of Ministers of Defense.

3.2. Development of offers to the Council of Ministers of Defense on consolidation of mutual understanding and measures of trust in the field of military cooperation within the Commonwealth.

3.3. Approval of efforts of the Ministries of Defence of the states of the Commonwealth in implementation of decisions of Council of heads of states, Council of Heads of Government and Council of Ministers of Defense about questions of military cooperation.

3.4. Coordination of efforts in rendering mutual aid in creation and development of armed forces of the states of the Commonwealth.

3.5. The analysis of regulatory legal acts of the states of the Commonwealth about military questions, questions of social and legal protection of the military personnel and members of their families and development of recommendations about their rapprochement.

3.6. Participation at the request of the Council of Ministers of Defense in development and implementation of measures of providing ecological safety on objects of the Ministries of Defence of the states of the Commonwealth and implementation of interaction with the Ministries of Defence of the states of the Commonwealth in these questions.

3.7. Participation in coordination of efforts of the states of the Commonwealth in observance of the international agreements in the field of measures of trust and increase in openness in the military sphere, reducings regular armed forces and arms.

3.8. Approval at the request of the Council of Ministers of Defense of actions for the benefit of recovery of joint air defense systems, the warning of missile attack and control of space of the states of the Commonwealth.

3.9. Generalization of offers of the Ministries of Defence of the states of the Commonwealth on military cooperation on multilateral basis and their analysis for the purpose of identification of areas of coincident interests.

3.10. Studying, the analysis and generalization of experience of scientific achievements of military of departments of the states of the Commonwealth, development of offers on cooperation in the field of military scientific research, military and technical policy, logistic support of troops and peacekeeping forces.

3.11. Development and approval of measures of material and technical supply of military forming of the Commonwealth, and also the principles of creation and content of inventories of appliances for them.

3.12. Rendering at requests of the Ministries of Defence of the states of the Commonwealth of special and legal aid in preparation and the conclusion them international treaties in the field of military cooperation, disarmament and prevention of armed conflicts.

3.13. Development of offers to the Council of Ministers of Defense on questions:

preparation and use of groups of military observers and Collective forces on peacekeeping in the Commonwealth;
