About formation of the State innovative non-bank financial credit institute "Fund of Support of Small Innovative Business"

According to article 19 of the Law of Ukraine "About innovative activities" the Cabinet of Ministers of Ukraine decides:

1. Form the State innovative non-bank financial credit institute "Fund of Support of Small Innovative Business" with reference it to the sphere of management of the Ministry of Education and Science.

2. Approve the Charter of the State innovative non-bank financial credit institute "Fund of Support of Small Innovative Business" which is attached.

General provisions

1. The state innovative non-bank financial credit institute "Fund of Support of Small Innovative Business" (further - Fund) is formed according to the resolution of the Cabinet of Ministers of Ukraine of December 12, 2011 No. 1396.

2. The fund in the activities is guided by the Constitution and the laws of Ukraine, acts of the President of Ukraine and the Cabinet of Ministers of Ukraine, other regulatory legal acts and this Charter.

3. Founder of Fund is the state on behalf of the Cabinet of Ministers of Ukraine. The fund belongs to the sphere of management of MON.

4. Official name of Fund:

Purpose and object of activity of Fund

5. The fund is formed for the purpose of provision of the state support for implementation of domestic high-tech scientific, nauchnotekhnichesky developments and inventions in production according to the priority directions of innovative activities, first of all for support of implementation of innovative projects of small business entities (small innovative business).

6. Object of activity of Fund is:

1) the organization of selection of innovative projects with the purpose of provision of financial support for their realization according to the procedure, the approved MON;

2) provision to subjects of innovative activities of financial support for implementation of innovative projects according to the Law of Ukraine "About innovative activities" can be performed in the way:

complete interest-free crediting of priority innovative projects at the expense of means of the government budget, budget of the Autonomous Republic of Crimea and local budgets;

partial (to 50 percent) interest-free crediting of innovative projects at the expense of means of the government budget, budget of the Autonomous Republic of Crimea and local budgets on condition of attraction to financing of such projects of other necessary means of the contractor of the project and (or) other subjects of innovative activities;

total or partial compensation at the expense of means of the government budget, budget of the Autonomous Republic of Crimea and local budgets of the percent paid by subjects of innovative activities to banks and other financial institutions for crediting of innovative projects;

provisions of the state guarantees to the banks performing crediting of priority innovative projects;

property insurance of implementation of innovative projects at insurers according to the Law of Ukraine "About insurance";

3) implementation of financing of innovative projects at the expense of own and raised funds;

4) maintenance of implementation of innovative projects and control of target use by subjects of innovative activities of the means provided as financial support of Fund for implementation of such projects;

5) attraction of domestic and foreign investments for implementation of innovative projects, including the scientific and technical, developmental and other project works provided by them, the works connected with production of industrial designs, pilot batches of innovative products, implementation of the latest technologies;

6) adjustment of cooperation with the international government and non-governmental organizations concerning innovative activities and attraction of financial resources in economy of Ukraine for implementation of general innovative projects;

7) the organization and holding exhibitions, conferences, seminars, rates, other information and presentation and scientific actions in the field of innovative activities;

8) implementation of actions for development of the design estimates, feasibility statement by preparation for implementation of innovative projects which will be financed by Fund;

9) implementation of actions for provision of information, marketing, intermediary, legal and other services by preparation for implementation of innovative projects which will be financed by Fund;

10) the organization in the procedure for examination of innovative projects, including the state scientific and scientific and technical examination established by the legislation;

11) trust management of financial assets of subjects of innovative activities in case of implementation of innovative projects which are financed by Fund;

12) participation in institutes of general investment according to the legislation;

13) ensuring return of the means provided as financial support of innovative activities, in particular by interest-free crediting of innovative projects.

Means which arrived from return of the loans granted by Fund at the expense of means of the government budget to subjects of innovative activities go according to the Budget code of Ukraine, the Law on the Government budget of Ukraine for the corresponding year and the Law of Ukraine "About innovative activities".

7. The fund is legal entity.

The fund acquires the right of the legal entity from the date of its state registration.

The fund has the status of the state non-bank innovative financial credit institute.

8. The fund has separate balance, accounts in banks, round stamp, stamps and forms with the name.

9. The fund operates on the principles of complete economic independence, performs economic activity according to the financial plans approved in the procedure established by the legislation and bears responsibility for results of the economic activity.
