About the status of "Nazarbaev Universitet", "Nazarbayev Intellectual schools" and "Nazarbayev Fond"

(as amended on 27-12-2019)

This Law determines legal status and particular legal regime of creation and activities of "Nazarbaev Universitet" (further - Universitet), "Nazarbayev Intellectual schools" (further - Intellectual schools) and "Nazarbayev of Fond" (further - Fund), created at the initiative of the First President of the Republic of Kazakhstan - Elbasa.

Chapter 1. General provisions

Article 1. The basic concepts used in this Law

In this Law the following basic concepts are used:

1) the autonomous organization of education - the non-profit organization which does not have membership established by the Government of the Republic of Kazakhstan which legal status and particular legal regime of activities are determined by this Law;

2) the organizations of Intellectual schools - the non-profit organizations established by Intellectual schools, other legal entities, fifty and more percent of voting shares (shares in the authorized capital) which belong to Intellectual schools on the property right or trust management, and also their affiliated organizations;

3) the educational grant "Nazarbaev Universitet" - the target amount of money provided to students within the state educational order for payment of education at University on appropriate level of education or on preparatory department on the conditions established by this Law;

4) grant of "Nazarbaev Universitet" - the amount of money provided to the student according to the educational grant "Nazarbaev Universitet";

5) extracurricular activities - the activities of participants of educational process of University, Intellectual schools aimed at all-round development and realization of individual capabilities of students, performed in the form of actions which list affirms the decision of the relevant board of trustees;

6) innovative cluster of University (further - innovative cluster) - consolidation of the subjects of research and innovative activities located in the territory of University, and the suppliers of other goods (works, services) complementing and increasing competitive advantages of each other at the expense of high extent of cooperation within implementation of research and development works, transfer of technologies, commercialization of projects, creation and implementation of new or advanced technologies and goods (works, services) interconnected with them;

7) the organizations of University - the non-profit organizations established by University, other legal entities, fifty and more percent of voting shares (shares in the authorized capital) which belong to University on the property right or trust management, and also their affiliated organizations.

Article 2. Legislation of the Republic of Kazakhstan on University, Intellectual schools and on Fonda

1. The legislation of the Republic of Kazakhstan on University, Intellectual schools and on Fonda is based on the Constitution of the Republic of Kazakhstan, consists of this Law and other regulatory legal acts of the Republic of Kazakhstan.

2. The legislation of the Republic of Kazakhstan regulating educational, scientific and (or) scientific and technical activities is applied to University, Intellectual schools, their organizations and Fund in the part which is not settled by this Law.

3. If the international treaty ratified by the Republic of Kazakhstan establishes other rules, than those which contain in this Law then are applied rules of the international treaty.

Article 3. Principles of activities of University, Intellectual schools and Fund

Activities of University, Intellectual schools and Fund are based on the following principles:

1) the principle of the academic freedom - independence of University and Intellectual schools in development and the choice of educational programs, forms and methods of implementation of educational activities, the directions of carrying out scientific research;

2) the principle of integration of education, science and production - inseparability of educational process from scientific and practical activities at University and Intellectual schools, ensuring strategic partnership with the organizations of science and entrepreneurship;

3) the principle of autonomy and self-controllability - isolation and independence of University, Intellectual schools and Fund in financial and economic, managerial control, decision making;

4) principle of collective leadership of decision making - decision making, connected with activities of University, Intellectual schools and Fund, their boards of trustees, the Highest board of trustees;

5) the principle of social responsibility and transparency - development and participation of University, Intellectual schools and Fund in socially important projects with the purpose of improvement of welfare of society, ensuring information openness in all directions of the activities.

Chapter 2. Legal status of University, Intellectual schools and Fund

Article 4. Legal status of University, Intellectual schools and Fund

1. The university is the autonomous organization of education created for the purpose of implementation of educational activities, including additional education, scientific and (or) scientific and technical activities, creation of modern educational, scientific infrastructure and other activities according to its charter. Educational activities by University are performed on the following education levels:

1) postsecondary education;

2) the higher education;

3) postgraduate education. The university is the experimental platform performing development, monitoring, research, the analysis, approbation, implementation and implementation of innovative programs in the field of science and education.

2. Intellectual schools are the autonomous organization of education created for the purpose of implementation of educational activities including in the field of additional education. Intellectual schools perform educational activities for the following education levels:

1) the elementary school including preschool education and training;

2) main school;

3) high school. Intellectual schools have the right to perform other activities according to its charter. Intellectual schools are the experimental platform performing development, monitoring, research, the analysis, approbation, implementation and realization of modern models of educational programs and technologies.

3. Founder of University and Intellectual schools is the Government of the Republic of Kazakhstan.

4. The fund is the non-profit organization created in form of business of fund only for ensuring financing of activities of University and Intellectual schools, and also their organizations.
