The government of the Kyrgyz Republic and the Government of the Republic of Uzbekistan which are hereinafter referred to as with the Parties

wishing to develop cooperation in the field of communication,

considering rates of demand for services of radio communication, television and broadcasting,

considering necessary to perform coordination of radio-frequency assignments in strip of radio frequencies of 29,7-960 of MHz for the purpose of avoidance of harmful mutual hindrances to their radio services,

being effective according to Regulations of radio communication of the International Union of Telecommunication (IUT),

agreed as follows:

Article 1.

For the purpose of this agreement:

- the term "border area" means the territory located on both sides of border between the Kyrgyz Republic and the Republic of Uzbekistan where radio-electronic means of one Party can create harmful hindrances with the level exceeding the admissible size accepted in Item the second Articles of the fifth of this agreement, to radio-electronic means of other Party;

- the term "coordination of radio-frequency assignments" means the procedure of receipt of consent of the Parties to installation and operation of radio-electronic means according to characteristics of radio-frequency assignments of these radio-electronic means.

Article 2.

The rights, obligations and responsibility of the parties are determined and regulated by the universally recognized norms of international law, the national legal system of the Parties and provisions of this agreement.

Article 3.

The competent authorities of the Parties on implementation of this agreement which are hereinafter referred to as with authorized bodies are:

Authorized bodies of the Parties:

- perform exchange of the relevant data on management of use of radio spectrum from national databases;

- determine and accept decision methods in case of unexpected harmful hindrances;

- determine and accept procedural mechanisms, such, for example, as establishment of the Coordination zone within which the coordination agreement, etc. is applied;

- conclude, within this agreement, the agreement on technical bases of coordination of frequency assignments of radio services or on use of separate strips of frequencies;

- perform other actions for implementation of this agreement.

In case of appointment of new authorized body of the Party without delay inform each other on it.

Article 4.

The parties will cooperate in questions of coordination of use of radio frequencies in strip of radio frequencies 29, of MHz stations of different types of radio services in border areas according to provisions of this agreement.

Article 5.

1. According to this agreement coordination of radio-frequency assignments of stations overland the mobile, fixed and broadcasting radio services is performed.

The fixed or overland mobile radio services which are not falling under responsibility of authorized bodies of the Parties shall not be regulated by provisions of this agreement until it is not provided.

2. Radio-frequency assignments of the stations located in border areas of the Parties, and also certain stations outside border areas are subject to coordination in the strip of radio frequencies specified in Article 4, if they create to the stations located in the border area of the adjacent Party harmful hindrance with the intensity of the field exceeding the admissible level determined for the relevant services by the supplementary agreement on technical bases of coordination signed by authorized bodies of the Parties.

As harmful hindrance any radiation which causes serious quality degradation of traffic of radio service shall be treated or repeatedly interrupts or stops functioning of this service because of exceeding of the most admissible intensity of the field of hindrance which is determined in this agreement.

3. Also coordination of radio-frequency assignments of reception stations of border areas can be performed if their protection against hindrances is required.

Article 6.

1. The parties determine the following categories of frequencies:

- the preferable radio frequencies appointed by authorized body of any Party on exclusive or preferential basis without preliminary coordination with other Party. At the same time the characteristics of stations fixed in the supplementary agreement on technical bases of coordination shall be supported. Preferable radio frequencies are appointed (are appropriated) to the radio stations located in any point in the territory of the border area;

- the combined radio frequencies which can be shared by both Parties and are appointed by their authorized bodies without preliminary coordination as civil channels of services of safety (channels of joint communication of customs, the Ministry of Internal Affairs, security services, in emergency situations and similar exceptional cases). At the same time the characteristics of stations fixed in the supplementary agreement on technical bases of coordination are supported;

- the coordinated radio frequencies which can be appointed (to be appropriated) only as a result of successful coordination;

- radio frequencies for the planned communication networks which shall be coordinated by authorized bodies of the Parties for development of communication networks (such as networks of cellular communication, broadcasting, radio relay lines, etc.). Such networks can require big capital investments, have long terms of commissioning, but can be created only as a result of the coordinated and approved frequency and territorial plans.

Purpose (assignment) of the coordinated radio frequencies is performed on the terms of the preposted coordination with other Party.

2. Assignments to stations of radio frequencies from categories preferable, combined, and also the radio-frequency assignments coordinated both for certain stations and for the planned communication networks, are considered by the Parties as performed on the basis of mutual consent.

Are considered coordinated all frequency assignments of each of the Parties:

- registered in the International help register of frequencies and published in part two of the Weekly circular letter of International union of telecommunication;

- appointed on a centralized basis in case of the USSR;

- the bonds of both Parties coordinated by administrations until the conclusion of this agreement;

- the radio-frequency assignments of the Parties brought in the Plans approved by the World conferences on radio communication.
