According to the subitem 20) of Article 15 of the Labor code of the Republic of Kazakhstan of May 15, 2007 the Government of the Republic of Kazakhstan DECIDES:

1. Approve enclosed:

1) Rules of issue to workers of milk, treatment-and-prophylactic food, special clothes, special footwear and other individual protection equipment, providing workers with means of collective protection, sanitary and household rooms and devices at the expense of means of the employer;

2) regulations of issue to workers of milk at the expense of means of the employer;

3) regulations of issue to workers of treatment-and-prophylactic food at the expense of means of the employer.

2. This resolution becomes effective after ten calendar days after the first official publication.

Rules of issue to workers of milk, treatment-and-prophylactic food, special clothes, special footwear and other individual protection equipment, providing workers with means of collective protection, sanitary and household rooms and devices at the expense of means of the employer

1. General provisions

1. These rules of issue to workers of milk, treatment-and-prophylactic food, special clothes, special footwear and other individual protection equipment, providing workers with means of collective protection, are developed by sanitary and household rooms and devices at the expense of means of the employer (further - Rules) according to the subitem 20) of Article 15 of the Labor code of the Republic of Kazakhstan of May 15, 2007 and establish procedure for issue to workers of milk and treatment-and-prophylactic food, special clothes, special footwear and other individual protection equipment, providing workers with means of collective protection, sanitary and household rooms and devices at the expense of means of the employer.

2. Action of these rules extends to the organizations with harmful (especially harmful) and dangerous working conditions.

3. The basic concepts used in these rules:

1) individual protection equipment - the means intended for protection of the worker against impact of harmful and (or) dangerous production factors including special clothes;

2) means of collective protection - the technical means intended for simultaneous protection of two and more working from impact harmful and (or) dangerous production factors.

2. Procedure for issue to workers of milk and treatment-and-prophylactic food

4. Milk and treatment-and-prophylactic food (further - LPP) are issued to workers by results of certification of production facilities under the terms of work, for the purpose of the prevention of occupational diseases and poisonings, strengthening of health of workers.

5. Milk is issued for change (during break) irrespective of its duration in days of the actual employment of the worker at the works connected with production or use of chemicals on the regulations approved by the Government of the Republic of Kazakhstan.

6. Appointment and issue of LPP is made according to the regulations approved by the Government of the Republic of Kazakhstan.

7. Issue of LPP is made in the form of hot breakfasts before work. Issue of LPP in lunch break in coordination with medical and sanitary part of the organization is in some cases allowed, and in case of its absence with body of the state sanitary and epidemiological surveillance of the corresponding territory. To the workers working in the conditions of elevated pressure (in caissons, pressures chamber, at diving works), LPP is issued after vyshlyuzovaniye.

8. LPP is issued also to the workers occupied full time on construction, construction, repair and construction and commissioning, to the workers making cleaning and preparation of the equipment for repair and preservation - in the operating productions with especially harmful working conditions in which both for the main workers, and for maintenance force LPP is established.

9. LPP and milk is not issued:

1) in non-working days;

2) in vacation days;

3) in days of official journeys;

4) in days of study with separation from production;

5) in days of performance of works on other sites where issue of LPP is not provided;

6) in the period of temporary disability.

10. Issue of LPP lately or for several changes forward, and also payment of compensation for LPP uncollected in time, is not allowed.

11. Replacement in LPP of one foodstuff is allowed by others within regulations of interchangeability of the products determined by regulations of issue of LPP.

12. Preparation and issue of LPP is made according to approximate six-day menyuraskladka of hot breakfasts of LPP on diets based on which the menu layout for every day is constituted.

13. The menu is constituted by the production manager of the organization performing cooking to workers.

14. To the workers receiving LPP at the expense of means of the employer in connection with especially harmful working conditions issue of milk or other equivalent foodstuff, is not made.

3. Procedure for issue to workers of special clothes, special footwear and other individual protection equipment, ensuring collective protection with means, sanitary and household rooms and devices

15. Individual protection equipment is issued in case of acceptance or transfer of workers to other work or in connection with the expiration of use of these means.

16. Terms of use of individual protection equipment are established kalendarno and estimated from the date of their actual issue to workers.

17. Individual protection equipment shall be certified, and also is convenient in case of sock, not to create obstacles to movement, to be selected and issued to workers by the corresponding sizes.

18. Individual protection equipment (gas masks, self-rescuers, safety belts, mosquito nets, helmets and other means) is subject to regular testing and check of serviceability, and filters, glasses and other parts with the gone-down protective properties timely replacement. After check on individual protection equipment the mark (brand, stamp) about terms of the subsequent testing shall be made.

19. The employer organizes proper care of means of individual and collective protection, timely performs preventive processing, and also repair of means of individual and collective protection.

20. When it is required under the terms of work, dryers, cameras and installations for preventive processing of individual protection equipment get a job in the organizations.

21. Preventive processing, repair of individual protection equipment shall be made in time when workers are not engaged at work (on the weekend), or during inter-shift breaks.

If the regulations approved by the Government of the Republic of Kazakhstan provide issue to workers of two or three sets of special clothes and special footwear, preventive processing and repair of individual protection equipment can be performed in working hours, replaceable sets of special clothes, special footwear which employers shall have in necessary quantity are issued to workers for this time.

22. The monthly regulation washed to the worker who worked the regulation of working hours which is completely determined for this period, there cannot be lower than 500 grams.

23. Means of collective protection, sanitary and household rooms and devices are provided during the designing, construction and reconstruction of factory buildings and constructions, taking into account engineering procedures, design of machines, mechanisms, the equipment and other products according to national standards and construction regulations and rules.

24. The procedure and conditions of providing with wardrobe, shower, washing, lechebnoprofilaktichesky means, medical first-aid kits, bathrooms, places for arrangement with half carcass, devices of drinking water supply, rooms for heating or chilling, processing, storage and issue of special clothes, special footwear and other additional sanitary and household rooms and devices, are determined by the collective agreement or the act of the employer.

25. Special clothes, special footwear which do not conform to qualifying standards or became useless before the expiration of fixed term of use, for the reasons independent of the worker, are subject to replacement.

26. With approach of season special clothes and special footwear shall be returned to those workers to whom they were issued during the previous season.

27. For storage the employer provides to the issued workers of special clothes, special footwear and other individual protection equipment specially equipped rooms (wardrobe) according to requirements of construction regulations and rules, sanitary and epidemiologic rules and regulations.

28. Before delivery on long-term storage special clothes and special footwear are cleared of pollution, dried, repaired and disinfected.

Milk issue regulations to workers at the expense of means of the employer

1. Milk it is issued to fat content percent 3,2 on liter 0,5 for change irrespective of its duration in days of the actual employment of the worker at the works connected with production or use of the following chemicals:

1) aliphatic and alicyclic hydrocarbons (saturated and nonsaturated):

hydrocarbons of number of methane: butane, isobutane, pentane, isopentane, hexane, octane, isooctane, nonan;

hydrocarbons of number of ethylene: butylene, amilena, isobutylene;

cyclic unsaturated hydrocarbons: the cyclopentadiene, tsitsiklopentadiyen, tsiklopentadiyeniltrikarbonit manganese;

aromatic hydrocarbons one-multinuclear: benzene, xylol, toluene, ethyl benzene, cumene (diizopropilenbenzol), xylols, stirola, diphenyl, naphthalene and their derivatives;

2) galogenoproizvodny hydrocarbons of fat row: ftorproizvodny: ftoretilen, diftoretilen, trifluoroethylene,

tetraftoretilen, trifluoropropylene, diftoretan, dekaftorbutan;

benzene chloride, dibenzene chloride, phenyl trichloride, tetrabenzene chloride, hexachlorobenzene, chloride Benzylium, petroltrichloride, chlorstyrene, brombenzol, bromic Benzylium and other galogenoproizvodny this row;

4) chlorderivatives of one-cyclic multinuclear hydrocarbons: the chlorinated diphenyls, diphenyl oxychloride, hlorindan, hlornaftalina, heptachlor, DDT, hexachlorocyclohexane, polychlorpinene, polychlorcamphene, hlorten, simazin, art azine;

11) the aldehydes and ketones replaced and not replaced: ethyl aldehyde, formaldehyde, bekzaldegid, akrolein, acetone, bromatseton, chloracetone, pentachloracetone, hexachloracetone, hloratsetofenon and the others of this row;

12) organic acids, their anhydrides, amides and galogenoangidrida: maleic, phthalic anhydride, acids: ant, acetic, propionic and their anhydrides, naphthenic acids, chloride benzoit chlorphenoxyacetic acid, compounds of carboamine acid, thiodithiocarboamine acid, dimetilformamid and the others of this group, and also diazoconnection, diazoketones and diazoair;

13) esters: air of nitrogenous, nitric, sulfuric, chlorsulfonew, ant, acetic, propionic, acrylic, milakrilovy acids and their galogenoproizvodny;

14) esters and amides of acids of phosphorus: trikrezilfosfat, tiofos, metafos, metiletiltiofos, merkaptofos, metilmerkaptofos, carbophos, medicines M-81, M-74, DDVF, fosfamid, hlorofos, herd, GD, sarin, octamethyl, diethylchlormonophosphate, metildikhlortifosfat, dimethyl-hlortnofosfat and other fosfororganichesky agricultural chemicals;

15) nitro - both amino compounds of fat polymethylene row and their derivatives: nitroolefins, nitromethane, nitroethane, nitropropane, nitrobutane, nitrofoska, hloropikrin, nitrocyclohexane, methylamine, dimethylamine, trimetilamin, ethylamine, diethyl amine, triethylamine, etilenimin, polietilenpoliamin, hexamethylenediamine, etapolamin, cyclohexaylamine, dicyclohexylamine and the others of this row;

16) nitro - both amino compounds of aromatic series and their derivatives: nitrobenzene, nitrotoluola, nitroxylol, dinOC, dinoseb, nitronaftalina, nitrobenzene chlorides, nitrophenol, nitro - and aminoanizoanilin, atsetonanilin, chloraniline, phenylenediamines, benzidine, parafitidin;

17) quinones, naftakhinon, anthraquinone, benzatren, paraquinone and dikhlornaftakhinon;

18) organic dyes: antrakhinonovy, nitro - and nitrozokrasitel, azoic dyes, azinovy, 2metilfuran (Silvan);

19) heterocyclic compounds: furan, tetrahydrofuran, furfural, the thiohair dryer, indole, pyridine, pirazalan, purin, the pyridinic and purinovy bases, pikolina, nicotinic acid, dioxanes, piperidine, morpholinium, hexogen, barbaturata, their semi-products and others in case of production medicines;

20) alkaloid atropine, cocaine, opium, morphine, cocaine, strychnine, salsolin, omnokok, nicotine, anatazin and the others in case of production of these medicines, and also raw materials and finished goods, the containing specified alkaloids (tobacco and tobacco, cigar, cigarette production, tobacco fermentation);

21) boranes;

22) halogens and galogenoproizvodny: fluorine, chlorine, bromine, iodine, chloride, bromic, fluoric hydrogen, fluoric, kremneftoristovodorodny acids, fluorine oxide, oxide and dioxide of chlorine, chlorine trifluoride, chloride iodine, carbon oxychloride (phosgene);

2. 2 grams of pectin as a part of the foodstuff enriched with it are issued to the workers contacting to inorganic compounds of non-ferrous metals in addition to milk: drinks, jelly, jams, fruit jelly, juice products from fruit and (or) vegetables and canned food (the actual content of pectin is specified the manufacturer).

Replacement of these products with natural fruit and (or) vegetable juice with pulp in number of 300 milliliters is allowed.

In case of permanent contact with inorganic compounds of non-ferrous metals instead of milk fermented milk products or products for dietary (medical and preventive) food are issued under harmful working conditions.

Issue of the foodstuff enriched with pectin, drinks, jelly, jams, fruit jelly, juice products from fruit and (or) vegetables and canned food shall be organized before work, and fermented milk products - during all working day.

3. To workers, busy production or conversion of antibiotics, instead of fresh milk issue the fermented milk products enriched with probiotics (bifidobacteria, lactic bacteria), or prepared on the basis of whole milk kolibakterin.

Milk replacement with sour cream, butter, other products (except the equivalent, provided by regulations of free issue equivalent foodstuff which can be issued to workers instead of milk), and also issue of milk or other equivalent foodstuff for one or several changes forward, as well as for last shifts is not allowed.

Milk replacement with equivalent foodstuff is allowed with the consent of workers and taking into account opinion of primary trade-union organization or other representative body of workers.

4) works with radioactive materials and sources of ionizing radiation:

workers, directly busy on production and conversion (including loading works and storage) uranium and thorium ores and concentrates; production and conversion of uranium, thorium, tritium, radium, thorium-228, of radium-228, of actinium-228, of polonium, transuranium elements and their salts and connections, fission products of uranium and thorium at the companies and pilot productions and installations;

workers, directly busy on industrial, power, transport and opytnopromyshlenny nuclear reactors, installations more 0,5 of kW generating x-ray radiation capacity;

the workers who are directly occupied with preparation of neytronovy sources (radium - beryllium, polonium - beryllium and other neutron sources on the basis of radioactive materials of especially high radio toxicity), in case of activity on workplace over 1 millicurie;

workers, directly busy in production of radioactive svetosostav of permanent action using radium, thorium-228, of radium-228, of actinium-228, of polonium in open form;

the workers who are directly occupied with receipt of emanation of radium in case of activity of source on workplace over 1 millicurie;

workers, directly busy at laboratory and other works using in open form in number of over 1 millicurie on workplace of radium, thorium-228, of radium-228, of actinium-228, of polonium, plutonium, uranium 233-235, of strontium-90, of caesium-137, of cerium-144, of undivided mix of products of splitting of uranium, transuranium elements.
