About approval of Rules and terms of carrying out training, instructing and examinations on safety issues and labor protections of workers

According to the subitem 25) of Article 15 of the Labor code of the Republic of Kazakhstan of May 15, 2007 the Government of the Republic of Kazakhstan DECIDES:

1. Approve the enclosed Rules and terms of carrying out training, instructing and examinations on safety issues and labor protections of workers.

2. This resolution becomes effective after ten calendar days from the date of the first official publication.

Rules and terms of carrying out training, instructing and examinations on safety issues and labor protections of workers

1. General provisions

1. These rules are developed according to the subitem 25) of Article 15 of the Labor code of the Republic of Kazakhstan of May 15, 2007 and determine procedure and terms of carrying out training, instructing and examinations of workers by safety issues and labor protections.

2. Training, instructing, examination of workers in safety issues and labor protections are carried out by the employer at the expense of own means.

3. Persons employed without fail undergo the preliminary training organized by the employer with the subsequent obligatory holding examination on safety issues and labor protections. The workers who did not undergo preliminary training, instructing and examination in safety issues and labor protections are not allowed to work.

4. The list of workers, leading employees and persons of the organizations performing productive activity responsible for safety and labor protections, the list of works and professions on which training is provided and also procedure, form of education is established by the employer proceeding from nature of profession, work type, specifics of production and safety conditions of work in coordination with employee representatives (in case of their availability).

2. Procedure for training and examination of workers by profession in the organizations

5. Training and examination of workers in working professions is performed at least once a year. Training of workers in working professions comes to the end with examination (examination) in safety and labor protection. Results of examination are drawn up by the protocol according to appendix 1 to these rules.

6. Training (occupations, lectures, seminars) in professions in the organizations performing productive activity is carried out by the employer with involvement of highly qualified specialists of the corresponding industries, experienced engineering employees and security services and labor protections of the organization.

7. Training programs on safety and labor protection shall provide theoretical and inservice training taking into account specifics of this organization and affirm the employer.

8. Inservice training to safe methods and acceptances of work is carried out in educational classes, workshops, sites, shops under the leadership of responsible persons of the organization for safety and labor protection.

9. Undergo additional special training in the separate productions connected with works, to which the special safety requirements of work established by the legislation are imposed, workers.

10. The workers having work stoppage on this work type, position, profession three and more years, and during the work with the increased danger - more than one year, are trained on safety issues and labor protection prior to independent work.

11. Examination committee is created by the order of the employer, numbering at least three people.

12. The commission consists of the chairman, the secretary and members of the commission. Examination committee division managers, security service specialists and the labor protections of the organization, and also person responsible for safety and labor protections, the public safety inspector of the company who underwent examination in the relevant commission are included.

13. Functioning of examination committee is performed on permanent basis.

14. The operating procedure of examination committee is determined by the employer.

15. The workers who are subject to examination on safety and labor protection shall be warned not later than thirty days prior to its carrying out.

16. Issue to the worker who successfully underwent examination the certificate or minutes abstract according to appendix 2 to these rules.

17. In case of receipt of unsatisfactory assessment by the worker the repeated examination is appointed no later than one month. Before repeated check the worker is not allowed to independent work.

3. Procedure for training and examination on safety and labor protection of leading employees and persons of the organizations responsible for safety and labor protections

18. The leading employees and persons responsible for safety and labor protections of the organizations performing productive activity (further - leading employees), periodically, at least once in three years shall undergo training and examination in safety issues and labor protections in the organizations performing professional training, retraining and advanced training of personnel.

20. Training (occupations, lectures, seminars) on safety issues and labor protections of leading employees is carried out with involvement of specialists of state bodies of supervision and control, teachers of educational institutions, experienced lawyers and engineering employees and security services and labor protections of large industrial bodies.
