1. Approve enclosed:

Rules of determination and application by the guaranteeing suppliers of the non-regulated prices of electrical energy (capacity);

changes which are made to acts of the Government of the Russian Federation.

2. This resolution becomes effective from the 1st following after month of its official publication.

The fourth and fifth Item 4, the paragraph two of Item 11 and Item 12 Edited paragraphs, approved by this resolution, the Section I of appendix to the specified Rules, paragraph two of the subitem "b" of Item of 3 changes approved by this resolution are applied till April 1, 2012.

Changes which are made to acts of the Government of the Russian Federation

3. In the Rules of the wholesale market of electrical energy and capacity approved by the order of the Government of the Russian Federation of December 27, 2010 N 1172 (The Russian Federation Code, 2011, N 14, the Art. 1916):

The organization of commercial infrastructure concerning group (groups) of points of delivery of each guaranteeing supplier - the participant of the wholesale market acquiring electrical energy (capacity) in the wholesale market for the purpose of realization in the retail markets in the territories united in price zones of the wholesale market determines according to basic provisions of functioning of the retail markets, procedure for determination and application by the guaranteeing suppliers of limits of the non-regulated prices of electrical energy (capacity) and the Treaty of Accession to trade system of the wholesale market the following components of limits of the non-regulated prices differentiated by options of limits of the non-regulated prices or price categories:

the weighted non-regulated average price differentiated on the ranges of number of hours of capacity utilization on electrical energy (capacity) in the wholesale market;

the weighted non-regulated average price differentiated on zones of days of settlement period on electrical energy (capacity) in the wholesale market;

the weighted non-regulated average price on electrical energy in the wholesale market;

the non-regulated prices of electrical energy differentiated on hours of settlement period;

the sizes of difference of the preliminary requirements and obligations calculated in the wholesale market by results of competitive selection of price requests for the days ahead and competitive selection of requests for balancing of system having per unit of electrical energy;

the weighted non-regulated average price on capacity in the wholesale market.

The sizes of cost of unit of electrical energy in the subject of the Russian Federation determined according to Item 99 of these rules are applied to determination of the weighted non-regulated average prices during action in price zone (price zones) of the wholesale market of the second stage of state regulation entered in accordance with the established procedure in power industry instead of the equilibrium prices specified in this Section on electrical energy.";

c) - e) voided according to the Order of the Government of the Russian Federation of 04.05.2012 No. 442

g) in Item 192 of the word "Weighted average prices" shall be replaced with words "The weighted non-regulated average prices".
