Preamble

The government of the Republic of Kazakhstan and the Government of the Kyrgyz Republic, hereinafter referred to as "Contracting parties",

proceeding from the reached agreements on boundary moving and transit road and transport agreements on the border check-point of Akzhol-Chu (Кордай) located on the highway Almaty-Bishkek for development of regional and international trade,

aiming at development and preserving the rational, approved and mutually advantageous transport and communication system on border,

for the purpose of mutual advantage from the approved trade and the transport circle between two countries,

based on membership in the international organizations, and participation in international conventions,

recognizing the obligations on assistance to smooth, bystry and effective movement of passengers, goods and baggage between Contracting Parties,

agreed as follows:

General provisions

Article 1 of Determination

For the purposes of this agreement the used determinations have the following values:

"Agreement" - Agreement between the Government of the Republic of Kazakhstan and Government of the Kyrgyz Republic on boundary moving on route of Almaty-Bishkek;

"assigned customs warehouse" - the customs warehouse for storage of the goods which are not paid with duty approved by bodies of the customs power for temporary storage of goods in the international transit and controlled by these bodies;

"border" - the boundary moving of Akzhol-Chu (Кордай) located on the highway Almaty-Bishkek;

"zone of border control" - the territory with limited access, located between border check-points or near them and controlled by boundary authorities;

"carrier" - the legal entity or physical person authorized for accomplishment of international delivery of goods, passengers or baggage and also person who concluded, or on behalf of whom the contract with the sender of baggage or the passenger for transportation of goods or passengers was signed;

"CMR" - the international commodity transport delivery note according to which the goods according to the Convention on the Contract for the International Carriage of Goods by Road (KDPG) of 1956 concerning obligations on insurance of road goods are transported.

"transportation contract" - the contract according to which the carrier undertakes the obligation for certain payment to deliver goods, passengers or baggage from the territory of the state of one Contracting Party on the territory of the state of other Contracting Party;

"boundary traffic" - traffic of transit appointment through boundary moving of Akzhol-Chu (Кордай);

"customs control" - the measures applied by customs authorities of Contracting Parties to ensuring compliance of activities of customs to the domestic customs legislation and international agreements to which customs authorities shall follow;

"domestic legislation" - the regulatory legal acts operating in the territory of the state of the Contracting Party;

"goods" - any kinds of goods and food, including live animals. In cases when goods are packed or unite in container, the pallet or similar product for transportation, the term "goods" include such products for transportation or packaging which are delivered by baggage determinant;

"one stop" - creation of conditions for carrying out joint processing of necessary documents when crossing border by personnel of both states;

"import duties and taxes" - the import customs duties, charges and taxes levied in case of commodity import;

"internal traffic" - transportation of goods or passengers, loading or landing of which was made in the territory of the state of the Contracting Party for unloading or disembarkation in the territory of the state of the same Contracting Party;

"vehicles" - are designated by any means used for transportation of passengers, goods or baggage, the equipment installed in it including containers or other types of the transport equipment;

"passenger" - any physical person which in case of contract performance of transportation of the prisoner it, or from his name, is transported by carrier for a fee or free of charge;

"permission" - the document issued by competent authority of the Contracting Party according to which the vehicle registered in the territory of the state of any of Contracting Parties is allowed or granted the right to entrance, departure or transit on the territory of the state of other Contracting Party;
