1. Approve enclosed:

1) Rules of placement on pack of tobacco product, packaging of tobacco product of information about structure, about the level of content of resinous substances, nicotine and about system poisons, cancerogenic and mutagen substances (further – Rules);

2) the warnings of harm of smoking placed on pack of tobacco product, packaging of tobacco product (further – Preventions).

2. This resolution becomes effective after ten calendar days after the first official publication, except for Items 4, of 6 Rules and Items 2, 5 Preventions which become effective after eighteen months from the date of enforcement of this resolution. Item 5 of Rules voids after eighteen months from the date of enforcement of this resolution.

Rules of placement on pack of tobacco product, packaging of tobacco product of information about structure, about the level of content of resinous substances, nicotine and about system poisons, cancerogenic and mutagen substances

1. General provisions

1. These rules determine procedure for placement on pack of tobacco product, packaging of tobacco product of information about structure, about the level of content of resinous substances, nicotine and about system poisons, cancerogenic and mutagen substances (further – Rules).

2. These rules are obligatory for execution by the physical persons and legal entities performing activities for import, production, wholesale and retail sale of tobacco and tobacco products.

2. Procedure for placement on pack of tobacco product, packaging of tobacco product of information about structure, about the level of content of resinous substances, nicotine and about system poisons, cancerogenic and mutagen substances

3. Data on the level of content of resinous substances and nicotine are applied on pack of tobacco product, packaging of tobacco products and occupy at least 4% (four percent) of one of side surfaces of pack, packaging of tobacco products.

4. Data on content at least three harmful connections include information about:

1) system poisons: arsenic, mercury, acetone, hydrocianic acid, ammonium, phenol;

2) cancerogenic substances: polonii-210, benzene, formaldehyde, benzpyrene, cadmium, akroleena;

3) mutagen substances: ethyl aldehyde, toluene, lead, acrylonitrile, carbon monoxide, 3 aminobiphenyl.

5. Data on content at least three harmful connections – system poisons, cancerogenic and mutagen substances are applied on pack and packaging of tobacco products in the form of text: "Contain in smoke of tobacco products: formaldehyde, benzene and monoxide of carbon" are also located on each party of pack of tobacco product, bigger on the area, packagings of tobacco product.

6. Data on content at least three harmful connections – system poisons, cancerogenic and mutagen substances from eighteen types listed in item 4 of these rules:

1) are put from left to right, parallel to the left edge of pack of tobacco product, packaging of tobacco product;

2) is occupied by at least 17% (seventeen percent) of the area of the left average side surface;

3) are applied on approximately equal quantity of packs of tobacco product, the packagings of tobacco product made in the territory of the Republic of Kazakhstan, and also imported on the territory of the Republic of Kazakhstan within calendar year.

7. The text of text of data shall conform to the following requirements:

1) to be printed in the state and Russian languages;

2) the name of font – Helvetica kz;

3) space from the left edge – at least 2 mm;

1. The warning of harm of smoking (further – the Prevention) placed on pack of tobacco product, packaging of tobacco products represents information on destructive consequences of consumption of tobacco and inhalation of tobacco smoke for human body.

2. The full-color drawing in the form of the image of destructive consequences of consumption of tobacco and inhalation of tobacco smoke for human body and the text accompanying it shall:

1) to correspond to sketches according to appendix to this Prevention;

2) to be located in the upper part of each party of pack of tobacco product, bigger on the area;

3) to be located on each party of packaging of tobacco product, bigger on the area;

4) to be applied on approximately equal quantity of packs of tobacco product, the packagings of tobacco product made in the territory of the Republic of Kazakhstan, and also imported on the territory of the Republic of Kazakhstan within calendar year and to be printed in high resolution (CMYK at least 300 dpi).

3. The prevention shall conform to the following requirements:

1) to occupy at least 40% (forty percent) of each party of pack of tobacco product, bigger on the area, packagings of tobacco products;

2) it shall not be printed on transparent wrapping film or any other external wrapping material.

4. The texts of preventions accompanying full-color drawings are printed in two languages (on the face – in state language, on reverse side – in Russian) and include texts:

1) "Smoking causes heart attacks and strokes";

2) "Smoking causes lung cancer";

3) "Smoking causes emphysema of lungs";

4) "Smoking causes diseases of vessels";

5) "Smoking causes periodontosis and loss of teeth";
