Chapter 1. General provisions

Article 1. Purpose of this Law

The purpose of this Law is regulation of the relations in the field of the competition in the goods and financial markets.

Article 2. Legislation on the competition

The legislation on the competition consists of this Law and other acts of the legislation.

If the international treaty of the Republic of Uzbekistan establishes other rules, than those which are stipulated by the legislation the Republic of Uzbekistan about the competition then are applied rules of the international treaty.

Article 3. Scope of this Law

This Law extends to actions of business entities, physical persons, state bodies and public authorities on places which bring or can lead to restriction of the competition in the goods and financial markets in the Republic of Uzbekistan, made in the territory of the Republic of Uzbekistan and (or) beyond its limits.

This Law does not extend to the relations connected with exclusive rights on intellectual property items, except for actions, the stipulated in Article 13 these Laws.

Provisions of this Law are applied to subjects of natural monopolies in that part when their application does not limit accomplishment of specific functions of these subjects.

Article 4. Basic concepts

In this Law the following basic concepts are applied:

interchangeable goods - to the price and other parameters in such a way that the acquirer really replaces or one goods are ready to replace with another goods which can be comparable on functional purpose, application, quality and technical characteristics in case of consumption;

unfair competition - the actions of business entity or group of persons directed to acquisition of benefits when implementing economic activity which contradict the legislation to business customs and cause or can cause losses to other business entities (competitors) either cause or can cause damage to their goodwill;

economic concentration - transactions and (or) other actions resulting in dominance of business entity or group of persons which exerts impact on competitive situation in the goods or financial market;

coordination of economic activity - approval of actions of business entities of the legal entity or physical person which is not entering one group of persons with one of such business entities;

discrimination conditions - conditions of access to the goods or financial market, conditions of production, consumption, acquisition, realization, other transfer of goods which with other things being equal put one or several business entities in unequal position in comparison with other business entity (competitor);

coordinated actions - the actions of two or more business entities in the goods or financial market satisfying interests of each of the specified participants of the market and known to each of them which bring or can lead to competition restriction;

the agreement - the arrangement of two and more parties in writing containing in the document or several documents and also the arrangement in oral form which bring or can lead to competition restriction;

the financial market - the sphere of the address of the financial service rendered by banks and other credit, insurance and other financial institutions and also services of professional participants of the security market in the territory of the Republic of Uzbekistan or its part which can not match with administrative-territorial division of the Republic of Uzbekistan and in which borders there is possibility of its rendering;

incorrect comparison - the false, inexact or distorted comparison creating in the goods or financial market of benefit to certain business entity or discrediting business entity (competitor) or the goods made by the competitor and proceeding from competitors or other persons;

the competition - competitiveness of business entities (competitors) in case of which their independent actions exclude or limit possibility of each of them to influence unilaterally general terms of the address of goods in the goods or financial market;

anti-competitive actions - the actions of business entities prohibited by the legislation on the competition, and also actions (failure to act) of state bodies, public authorities on places and their officials directed to competition restriction;

goods - the activities product intended for acquisition and realization, including work and service;
