RESOLUTION OF THE CABINET OF MINISTERS OF THE REPUBLIC OF UZBEKISTAN

of December 30, 2011 No. 346

About additional measures for enhancement of activities of bodies of civil registration

(as amended on 26-08-2020)

For the purpose of further enhancement of activities of bodies of civil registration (further - bodies of ZAGS) and creating favorable conditions for receipt of qualified legal aid by citizens the Cabinet of Ministers decides:

1. Approve Regulations on procedure for determination of number of employees of bodies of civil registration, according to appendix No. 1, and enact it since January 1, 2012.

2. To the Ministry of Justice of the Republic of Uzbekistan:

in a month together with Council of Ministers of the Republic of Karakalpakstan, khokimiyats of areas and Tashkent to study the need for bodies of ZAGS for the remote settlements;

in two-month time together with the Ministry of Finance of the Republic of Uzbekistan, proceeding from the approved criteria to determine the number of employees of bodies of ZAGS;

in two-month time to develop and introduce to the Cabinet of Ministers the draft of the program of measures for strengthening of material and technical resources of bodies of ZAGS, including creation of the ZAGS single electronic archive providing creation of necessary conditions for receipt of qualified legal aid by citizens, and also ensuring safety of documents and archival materials;

in three-months time together with the Central bank of the Republic of Uzbekistan and the relevant serving banks to provide complete equipment of bodies of ZAGS with settlement terminals on acceptance of payments from bank plastic cards and cash registers.

3. Determine that providing bodies of ZAGS is performed at the expense of means of the Government budget of the Republic of Uzbekistan and off-budget fund of the Agency of the state services under the Ministry of Justice of the Republic of Uzbekistan.

4. Make change and addition to the resolution of the Cabinet of Ministers of April 12, 1996 No. 147 "About introduction of scale of charges on compensation of employees of state governing bodies, judicial authorities and notary offices" according to  appendix No. 2.

5. To impose control of execution of this resolution on the First Deputy Prime Minister of the Republic of Uzbekistan R. S. Azimov and the Minister of Justice of the Republic of Uzbekistan N. T. Yuldashev.

Regulations on procedure for determination of number of employees of bodies of civil registration

I. General provisions

1. This Provision establishes procedure for determination of number of employees of bodies of civil registration (further - bodies of ZAGS).

2. Bodies of ZAGS are:

departments of ZAGS of areas and cities (further - departments of ZAGS), and also houses of wedding;

ZAGS archives of territorial administrations of the Republic of Karakalpakstan, areas and the city of Tashkent (further - territorial administrations) the Agencies of the state services under the Ministry of Justice of the Republic of Uzbekistan (further - ZAGS archives).

3. Employees of bodies of ZAGS are:

manager;

inspector 1 and 2 categories;

report clerk (technicians).

4. The number of employees of departments of ZAGS, houses of wedding and ZAGS archives is determined by the Agency of the state services under the Ministry of Justice of the Republic of Uzbekistan (further - the Agency) in coordination with the Ministry of Finance of the Republic of Uzbekistan.

The number of employees of bodies of ZAGS is determined not more often than once a year.

At the same time expenses of bodies of ZAGS on compensation, including single social payment (except for payments of allowances for class ranks and length of service), become covered at the expense of means of the Government budget.

II. Criteria of determination of number of employees of bodies of ZAGS

5. In each body of ZAGS positions are entered:

a) in departments of ZAGS and houses of wedding - the manager and the inspector of the I category;

b) in ZAGS archives - the manager and on 1 unit of the inspector 1 and 2 categories.

6. In case of determination of the second and the subsequent positions of inspectors of departments of ZAGS and houses of wedding the following criteria are considered in total:

a) the average monthly number of the acts of civil status (the birth, death, marriage and annulment of marriage) registered in the territory of the respective area and the city, and the changes made to them. At the same time on one worker (except for the report clerk) the number of the registered acts of civil status and the changes made to them shall constitute at least 200 - 250 units a month;

b) population of the served territory of the area and the city. At the same time in case of population of the served territory from 50 thousand to 100 thousand people it is entered - 1 unit of the inspector, from 100 thousand to 150 thousand people - 2 units of the inspector, from 150 thousand to 200 thousand people - 3 units of the inspector and from 200 thousand and more people - 4 units of the inspector.

7. In the presence of the 4th and more positions of inspectors in body of ZAGS inspectors of 1 category shall constitute no more than a half of their total number.

8. In addition to the criteria provided in Item 6 of this provision in case of determination of quantity of positions of inspectors in department of ZAGS or the house of wedding, proceeding from specific circumstances, can be considered also remoteness of settlements from each other in borders of the served territory and the available transport connection between them.

9. In case of determination of third and the subsequent positions of inspectors of ZAGS archives the following criteria are considered in total:

the number of the cases which are available in archival fund. At the same time the number of inspectors is determined at the rate of 4000 cases a year on 250 sheets in everyone on one worker;

quantity of the brought marks in civil registration according to the arrived notices from departments of ZAGS and houses of wedding. At the same time the number of inspectors is determined at the rate of 450 - 500 brought marks a month on one worker;

the number of the granted the references, repeated certificates and statements from acts of civil status. At the same time the number of inspectors is determined at the rate of 250 - 300 issued documents a month on one worker.

10. In the presence in body of ZAGS of three and more inspectors the position of the report clerk is entered.
