1. Approve the enclosed Rules of use of objects and rooms in the sphere of drug trafficking, psychotropic substances and precursors.

2. This resolution becomes effective after ten calendar days after its first official publication.

Rules of use of objects and rooms in the sphere of drug trafficking, psychotropic substances and precursors

1. These rules are developed according to the laws of the Republic of Kazakhstan of December 21, 1995 "About law-enforcement bodies of the Republic of Kazakhstan" and of July 10, 1998 "About drugs, psychotropic substances, precursors and measures of counteraction to their illicit trafficking and abuse of them" (further – the Law) and determine procedure for use of objects and rooms in the sphere of drug trafficking, psychotropic substances and precursors entered in the List of the drugs, psychotropic substances and precursors which are subject to control in the Republic of Kazakhstan according to the Law (further - drugs, psychotropic substances and precursors).

2. All types of activity in the sphere of drug trafficking, psychotropic substances and precursors in the territory of the Republic of Kazakhstan are performed by legal entities, regardless of their pattern of ownership after receipt of the corresponding license, except as specified, provided by articles 19 and 20 of the Law.

3. Objects and rooms are allowed to use in the sphere of drug trafficking, psychotropic substances, precursors on condition of their compliance to requirements of technical reinforcement, according to appendix to these rules, sanitary standards and rules, and also conditions of fire safety.

4. Objects and rooms in the sphere of drug trafficking, psychotropic substances, precursors are subdivided into three groups:

1) the first group – the manufacturing companies of drugs, psychotropic substances, drugstores, test laboratories, research institutions, wholesale companies, subjects of health care performing activities in the sphere of drug trafficking, psychotropic substances;

2) the second group – objects for cultivation and procurement of narkotikosoderzhashchy plants;

3) the third group – the companies making and/or performing wholesale trade by precursors, and also using them in the productive activity.

5. The layout of objects and rooms in the sphere of drug trafficking, psychotropic substances, precursors shall provide:

1) safety of available drugs, psychotropic substances and precursors, and also products made of them;

2) threading of process with the shortest distances between technologically connected rooms;

3) exception of crossing of technological flows;

4) the maximum group of rooms with identical degree of purity;

5) prevention of mixture of different types and series of initial raw materials, semi-products and ready-made products;

6) protection against pollution when moving initial raw materials, semi-products and ready-made products.

6. The re-equipment and re-planning of objects and rooms in the sphere of drug trafficking, psychotropic substances, precursors leading to violation of durability or destruction of the bearing structures of the building, deterioration in safety and appearance of facades, violation of fire protection regulations are not allowed.

7. Access to objects and to rooms in the sphere of drug trafficking, psychotropic substances and precursors is allowed to persons which are directly working with them. The list of persons allowed to work with under control substances affirms the order of the head of the legal entity, after coordination with law-enforcement bodies and receipt of the conclusion of doctors (the psychiatrist and the narcologist) about absence at them of diseases of drug addiction, toxicomania and chronic alcoholism.

8. Rooms in the sphere of drug trafficking, psychotropic substances and precursors after the termination of the working day are sealed or sealed up.

Requirements to technical reinforcement of objects and rooms in the sphere of drug trafficking, psychotropic substances, precursors

1. Requirements to technical reinforcement imposed to objects of the first group

1. The main external walls, overlappings, partitions executed from brick or stone laying at least 500 mm thick, either concrete wall blocks at least 200 mm thick, or concrete stones 90 mm thick in two layers or steel concrete panels at least 180 mm thick.

2.
