RESOLUTION OF COUNCIL OF MINISTERS OF THE REPUBLIC OF BELARUS

About procedure for record keeping according to addresses of citizens and legal entities

(as amended on 19-12-2022)

In pursuance of Item 2 of article 13 of the Law of the Republic of Belarus of July 18, 2011 "About addresses of citizens and legal entities" (further – the Law) the Council of Ministers of the Republic of Belarus DECIDES: No. 300-Z

1. Approve Regulations on procedure for record keeping according to addresses of citizens and legal entities it (is applied).

2. No. 877 is excluded according to the Resolution of Council of Ministers of the Republic of Belarus of 19.12.2022

3. Recognize invalid:

subitem 1.61 of Item 1 of the resolution of Council of Ministers of the Republic of Belarus of August 2, 2006 No. 990 "About modification and amendments in some orders of the Government of the Republic of Belarus and recognition voided the separate orders of the Government of the Republic of Belarus in connection with reorganization of system of republican state bodies" (The national register of legal acts of the Republic of Belarus, 2006, No. 146, 5/22839);

the resolution of Council of Ministers of the Republic of Belarus of January 17, 2008 No. 60 "About some questions of record keeping according to addresses of citizens and legal entities in state bodies, other organizations" (The national register of legal acts of the Republic of Belarus, 2008, No. 27, 5/26649);

Item 6 of the resolution of Council of Ministers of the Republic of Belarus of June 28, 2011 No. 854 "About some questions of work with addresses of citizens and legal entities" (The national register of legal acts of the Republic of Belarus, 2011, No. 75, 5/34057).

4. To the republican state bodies, other state organizations subordinated to the Government of the Republic of Belarus, regional executive committees, the Minsk Gorispolkom to bring the regulatory legal acts into accord with this resolution and to take other measures for its realization.

5. This resolution becomes effective since January 22, 2012.

Regulations on procedure for record keeping according to addresses of citizens and legal entities

1. This Provision determines procedure for record keeping by addresses of citizens of the Republic of Belarus, the foreign citizens and stateless persons which are in the territory of the Republic of Belarus including individual entrepreneurs (further if other is not determined, – citizens), legal entities of the Republic of Belarus and representative offices of the foreign organizations (further – legal entities), arrived in state body, other organization, to the individual entrepreneur.

2. In this Provision terms in the values determined in article 1 of the Law are applied.

Action of this provision does not extend to record keeping according to the addresses of applicants which are subject to consideration according to the legislation on the constitutional legal proceedings, the civil, civil procedural, economic procedural, criminal procedure legislation, the legislation determining procedure for administrative process, the legislation on ministerial procedures, to addresses of the worker to the employer, other addresses concerning which legal acts establish other procedure for their giving and consideration, and also on correspondence of state bodies in case of accomplishment by them of the functions assigned to them by regulatory legal acts.

4. The clerical work according to addresses of applicants is performed by authorized officers separately from other types of clerical work.

The clerical work according to the written addresses of citizens introduced in the book of notes and offers is conducted separately from clerical work according to the addresses of citizens and legal entities submitted in written, oral or electronic form.

The clerical work according to the addresses of citizens introduced in the book of notes and offers in the organizations, at the individual entrepreneur is conducted on a centralized basis.

The clerical work according to addresses of citizens and legal entities is conducted on a centralized basis or is decentralized.

5. Arriving in state body, other organization of the address of applicants are registered in day of their receipt in accordance with the established procedure.

The addresses of applicants which arrived in state body, other organization in non-working day (time off) are registered not later than in the first working day following it.

6. Registration of addresses of the applicants who arrived in state bodies, other state organizations and answers to them is performed in the state single (integrated) republican information system of accounting and processing of addresses of citizens and legal entities (further – system of accounting and processing of addresses), and also can be performed in electronic document management system or with use of registration and control forms on paper.

Registration of written and oral addresses of the applicants who arrived in other organizations is performed in electronic document management system or with use of registration and control forms on paper.

7. In case of receipt in state body, other organization of electronic addresses its paper copy in case of need can be created.

8. The registration and control registration form of addresses of citizens and legal entities contains details according to appendix.

Registration and control forms can join the details necessary for ensuring accounting, control, job analysis with addresses of the applicants, document retrieval connected with consideration of addresses.

Details which data for filling are absent in connection with features of consideration of addresses of applicants can be excluded from registration and control forms or contain information, distribution and (or) provision of which is limited.

The registration index is appropriated to addresses of applicants, answers (notifications) to addresses, including answers (notifications) directed to the applicant to notes and (or) offers made in the book of notes and offers according to procedure for functioning of system of accounting and processing of addresses, and also the accepted system of document registration in state body, other organization, at the individual entrepreneur.

11. The appeals of the same applicant on the same question sent to various addressees and which arrived for consideration in the same state body, other organization are considered under registration index of the initial address with addition of additional sequence number.
