This Law is directed to determination of legal and organizational basis of the prevention of spread of the diseases constituting health hazard of the population (further - socially dangerous disease), human immunodeficiency virus (further - HIV) and providing the rights of persons having such diseases, persons concerning whom good reasons to believe about availability at them such diseases, and also the persons providing them medical care or participating in the organization of its rendering are had.
For the purposes of this Law the following main terms and their determinations are applied:
the specialist doctor - person having the higher medical education and in the procedure established by the legislation engaged in the activities connected with the organization and delivery of health care;
the state social order in the field of holding preventive actions for the prevention of spread of socially dangerous diseases, HIV (further - the state social order in the field of prevention of socially dangerous diseases, HIV) - the mechanism of involvement of non-state non-profit organizations to rendering services and (or) project implementations directed to the prevention of spread of socially dangerous diseases, HIV;
voluntary medical examination - the medical examination which is carried out at the request of the patient, and in the cases provided by legal acts - with the consent of his legal representative according to the procedure, the established legislation on health care;
medical examination - the studying and assessment of the state of health of the patient which are carried out by the specialist doctor in the course of delivery of health care for the purpose of establishment of availability or absence at the patient of socially dangerous disease, HIV, determination of its needs in medical care;
obligatory medical examination - the medical examination which is obligatory for separate categories of persons determined by this Law and also persons whose list is determined by the Ministry of Health of the Republic of Belarus;
the patient - person having socially dangerous disease, HIV, or person concerning whom good reasons to believe about availability at it socially dangerous disease, by HIV, addressed for delivery of health care are had who is under observation of the specialist doctor or receiving medical care and also other persons concerning whom voluntary medical examination or obligatory medical examination are carried out;
the prevention of spread of socially dangerous diseases, HIV - complex of the actions directed to identification, the analysis, the prevention and elimination of the reasons and conditions promoting emergence of socially dangerous diseases, HIV;
forced hospitalization and treatment - the placement of person having socially dangerous disease to the state organization of health care performing delivery of health care in stationary conditions, and its treatment performed in the cases and procedure determined by this Law and other legal acts;
forced medical examination - medical examination of person concerning which good reasons to believe about availability at it socially dangerous disease are had, HIV, carried out without its consent or without the consent of his legal representative in the cases and procedure determined by this Law and other legal acts;
the project directed to the prevention of spread of socially dangerous diseases, HIV - complex of preventive actions for the prevention of spread of socially dangerous diseases, HIV among separate national groups;
socially dangerous disease - disease which spread creates threat of personal, public and homeland security (including attracts considerable deterioration in health of the nation, causes the necessity of application of complex of effective measures for the purpose of the prevention of its distribution) and which is included in the list of the diseases constituting health hazard of the population, determined by the Ministry of Health of the Republic of Belarus;
the service directed to the prevention of spread of socially dangerous diseases, HIV - actions for holding preventive actions for the prevention of spread of socially dangerous diseases, HIV, including for rendering consulting, information, psychological, legal and other assistance to persons having socially dangerous diseases, HIV and to persons belonging to national groups with high risk of infection with socially dangerous diseases, HIV.
The legislation on the prevention of spread of socially dangerous diseases, HIV is based on the Constitution of the Republic of Belarus and consists of the Law of the Republic of Belarus of June 18, 1993 "About health care" (Vyarkho¸naga Savet's Vedamastsi of Respubliki Belarus, 1993, No. 24, Art. 290; National register of legal acts of the Republic of Belarus, 2008, No. 159, 2/1460), this Law and other acts of the legislation, and also international treaties of the Republic of Belarus.
