About sanitary and epidemiologic wellbeing of the population

This Law is directed to establishment of legal and organizational basis of prevention of adverse effect on human body of factors of the circle of its dwelling for the purpose of ensuring sanitary and epidemiologic wellbeing of the population.

Chapter 1. General provisions

Article 1. The main terms applied in this Law and their determinations

For the purposes of this Law the following main terms and their determinations are applied:

risk analysis – process of assessment by the bodies and organizations exercising the state sanitary inspection, the state bodies exercising control of activities in the field of sanitary and epidemiologic wellbeing of the population, the medical scientific organizations of public information for identification (detection) and risks assessment for the purpose of taking measures to the prevention and minimization of these risks (risk management) and also for the purpose of informing in accordance with the established procedure state bodies, the organizations, physical persons, including individual entrepreneurs about availability of risks;

the hygienic standard rate – the technical regulatory legal act establishing admissible maximum or minimum quantitative and (or) high-quality measure value, the person characterizing this or that factor of the habitat, products from line items of their safety and harmlessness for the person;

state registration of products constituting potential danger for life and health of the population (further – state registration), – system of accounting and the admission to realization and use of products constituting potential danger for life and health of the population, acknowledged conforming to requirements of the legislation in the field of sanitary and epidemiologic wellbeing of the population;

the state sanitary and hygienic examination – establishment of compliance (discrepancy) of the objects which are subject to the state sanitary and hygienic examination, requirements of the legislation in the field of sanitary and epidemiologic wellbeing of the population;

the state sanitary inspection – the activities for the prevention, detection, suppression of violations of the law in the field of the sanitary and epidemiologic wellbeing of the population, sanitary and epidemiologic, hygienic requirements and procedures established by technical regulations of the Customs union, Eurasian Economic Union performed for the purpose of health protection and the habitat of the person;

disinfection, disinsection and deratization actions (further – disinfection actions) – the actions directed to destruction or reducing number of activators and carriers of infectious diseases;

infectious diseases – diseases, including poisonings which emergence and distribution are caused by impact of causative agents of infectious diseases;

source of infectious diseases – the infected human body or animal in whom causative agents of infectious diseases can live, breed, accumulate and cause infection of other person;

mass noninfectious diseases – diseases, including poisonings which emergence and distribution are caused by impact of chemical, physical, social factors of the habitat of the person;

the product circulation – development, production, realization, storage, transportation, use, destruction, import to the territory of the Republic of Belarus, export from the territory of the Republic of Belarus of products;

restrictive actions – the administrative, sanitary and anti-epidemic actions directed to prevention of spread of infectious and (or) mass noninfectious diseases, their localization and liquidation and providing specific mode of economic and other activity, restriction of movement of the population, and also movement of vehicles, goods, freights and animals;

pathogenic biological agents – microorganisms (bacteria, viruses, hlamidiya, rikketsiya, protozoa, mushrooms, mycoplasmas), the prions, poisons of biological origin (toxins), helminths, any microorganisms including the fragments of genome of pathogenic biological agents capable in case of hit in human body or animal to cause the expressed disease or carriage of microorganisms;

products – chemical and biological substances, materials and products from them, industrial goods, goods for personal (household) needs, food staples and foodstuff, dietary supplements to food, and also the materials and products applied to production, realization, storage, transportation, packaging of food staples and foodstuff;

products constituting potential danger for life and health of the population – separate types of products which can make harmful effects on life and health of the population in case of their address and which are included in the list of products constituting potential danger for life and health of the population, determined by the Ministry of Health;

production supervision – the control of observance of requirements of the legislation in the field of sanitary and epidemiologic wellbeing of the population directed to preserving life and health of the population, the habitat of the person in case of the product circulation, performance of works and rendering services, provided with the organizations and physical persons, including individual entrepreneurs;

preventive inoculations – introduction in human body of immunobiological medicines for creation of specific immunity to infectious diseases;

risk – the combination of probability of adverse effect on human body of factors of the circle of its dwelling, violation of the law in the field of sanitary and epidemiologic wellbeing of the population and consequences of this impact leading to emergence of threat of life and health of the population;

sanitary and quarantine control – type of the control exercised concerning physical persons, vehicles and products including at check points through Frontier of the Republic of Belarus, at interstate transfer railway stations, for the purpose of prevention of drift, origin and spread of infectious and mass noninfectious diseases;

sanitary and anti-epidemic actions – the organizational, preventive and other actions directed to elimination or reduction of adverse effect on human body of factors of the circle of its dwelling, prevention of drift, origin and spread of infectious and mass noninfectious diseases, their localization and liquidation;

sanitary and epidemiologic situation – the state of health of the population, factors of the habitat of the person in certain territory during specific period of time;

sanitary and epidemiologic requirements – requirements to safety and harmlessness for the person of factors of the circle of its dwelling, conditions of organization activity, physical persons, including individual entrepreneurs used by them the territories, capital structures (buildings, constructions), rooms, the equipment, vehicles and also to safety and harmlessness of products, technologies of its production, the product circulation, including products constituting potential danger for life and health of the population;
