About approval of the Procedure for functioning of the state system of physical protection

According to article 5-2 of the Law of Ukraine "About physical protection of nuclear installations, nuclear materials, radioactive waste, other sources of ionizing radiation" the Cabinet of Ministers of Ukraine decides:

Approve the Procedure for functioning of the state system of physical protection which is applied.

Procedure for functioning of the state system of physical protection

1. This Procedure determines the principles of functioning of the state system of the physical protection created for goal achievement of physical protection at the national level:

specific nuclear installations, the objects intended for the treatment of radioactive waste, other sources of ionizing radiation;

specific transportations of nuclear materials, radioactive waste, other sources of ionizing radiation.

2. Tasks and subjects of the state system of physical protection (further - subjects of system) are determined by the Law of Ukraine "About physical protection of nuclear installations, nuclear materials, radioactive waste, other sources of ionizing radiation".

3. Objects of the state system of physical protection (further - system objects) are:

nuclear installations;

the objects intended for the treatment of radioactive waste;

nuclear materials;

radioactive waste;

other sources of ionizing radiation;

the radioactive materials found in the illegal address.

4. The basic principles of functioning of the state system of physical protection are:

the principle of systemacity (functioning of system has the system, arranged and permanent nature);

the principle of differentiation according to which compliance of level of physical protection of objects of system to their categories and potential radiation effects of making of illegal actions concerning system objects is provided;

the principle of prevention of making of illegal actions according to which identification of potential hazards concerning objects of system and taking measures for successful counteraction to such threats is provided;

the principle of adaptivity according to which accomplishment of tasks of system in case of change of project threat is provided;

the principle of adequacy (operating conditions of system answer the level of the available threats concerning system objects);

the principle of knowledge (subjects of system are timely provided with information on the available and potential hazards concerning system objects in amounts which give the chance to subjects to take adequate measures for successful counteraction to such threats);

the principle of the personal responsibility (heads of subjects of system within the powers are personally actionees of tasks of system);

the principle of identification and elimination of the reasons of illegal actions according to which implementation of constant control behind compliance of physical protection of objects of system to requirements of the legislation and taking measures to elimination of the revealed discrepancies is provided.

5. Gosatomregulirovaniye as the subject of system within the powers conferred to it:

takes part in forming of state policy in the field of physical protection, and also develops the mechanism of realization of the specified state policy;

generalizes practice of application of the legislation concerning physical protection, develops and in accordance with the established procedure submits for consideration of the Cabinet of Ministers of Ukraine of the offer concerning enhancement of such legislation;

checks activities of subjects of system in case of accomplishment of system tasks by them, including activities for creation and ensuring functioning of single system of the protected communication between public authorities and legal entities to whose powers implementation of functions of accounting, control, physical protection and counteraction to attack on nuclear installations, the objects intended for the treatment of radioactive waste, other sources of ionizing radiation, vehicles which transport radioactive materials (daleeediny system of the protected communication) belongs;

takes part in functioning of the state system of professional training, retraining and advanced training of specialists in physical protection, accounting and control of nuclear materials;

takes part in evaluating threat of making of diversion, theft or any other illegal withdrawal of radioactive materials and determination of project threat;

will organize in the procedure established by the legislation work on preparation and accomplishment of nation-wide, other programs of physical protection, carrying out scientific and scientific and technical research in this sphere;

develops and performs actions for forming of culture of security, coordinates activities of subjects of system concerning increase in level of culture of security;

establishes requirements to quality management systems of physical protection of objects of system;

establishes requirements to registration and the document form for conducting special check for the purpose of provision to physical persons of the admission to accomplishment of special works on nuclear installations, with nuclear materials, radioactive waste, other sources of ionizing radiation (further - special check);

will organize in accordance with the established procedure work on carrying out scientific and technical researches in the field of physical protection, controls the course of their carrying out, quality of results of researches and promotes implementation of such results in practice;

takes part in evaluating threat of making of diversion, theft, kakogolibo other illegal withdrawal of radioactive materials;

will organize work on determination of project threat;

takes part in work of the interdepartmental commissions on the organization of protection of objects of system;

receives in accordance with the established procedure from the relevant state bodies information on the available threats to objects of system and reports in accordance with the established procedure to licensees about such threats;

develops and approves regulations and rules on physical protection of objects of system;

approves regulatory legal acts concerning physical protection which arrive for review from the ministries and other central executive bodies;

prepares conclusions concerning observance of requirements of physical protection in case of export/import and transit transportation on the territory of Ukraine of radioactive materials;

establishes minimum admissible operational characteristics of systems of physical protection of objects of system, admissible risk of making of diversion concerning system objects depending on their categories and possible radiation effects of making of diversion;

approves plans of ensuring physical protection of nuclear installations and nuclear materials which arrive for review from licensees;
