1. Approve the enclosed Regulations on procedure for state registration of the citizens who are engaged in business activity without formation of legal entity as the individual entrepreneur in the territory of the Kyrgyz Republic.

Regulations on procedure for state registration of the citizens who are engaged in business activity without formation of legal entity as the individual entrepreneur in the territory of the Kyrgyz Republic

I. General provision

1.1. This Regulations on procedure for state registration of the physical persons who are engaged in individual business activity in the territory of the Kyrgyz Republic determine procedure for state registration and are developed according to the legislation of the Kyrgyz Republic.

1.2. State registration of individual entrepreneurs has declarative character and consists directed by them on accounting as business entity, issue of the certificate on state registration to them with assignment of all-republican identification code and their inclusion in the Single state register of statistical units.

1.3. State registration of individual entrepreneurs is performed for the purpose of the certificate of the facts of accounting of creation and the termination of their activities.

1.4. Individual entrepreneurs are subject to state registration according to the Civil code of the Kyrgyz Republic and the Law of the Kyrgyz Republic "About the state statistics".

1.5. Citizens of the Kyrgyz Republic, foreign citizens, and also the persons without citizenship living constantly (temporarily) in the territory of the Kyrgyz Republic can be individual entrepreneurs.

Individual entrepreneurs can perform the activities after state registration in territorial authorities of the state statistics. Individual entrepreneurs can perform the activities without registration in territorial authorities of the state statistics in the presence of the patent, in cases, stipulated by the legislation the Kyrgyz Republic.

1.6. State registration of individual entrepreneurs is performed by territorial authorities of National Statistical Committee of the Kyrgyz Republic (registering bodies) in the place of their residence.

1.7. Territorial authorities of the state statistics perform maintaining the state register of individual entrepreneurs, forming of single databank of the individual entrepreneurs located in the territory of the Kyrgyz Republic, obtaining and information transfer of the individual entrepreneurs created and stopped activities.

1.8. The state committee of the Kyrgyz Republic on taxes and fees, its territorial subdivisions within 15 days after patent grant provide in the state statistical bodies information on the individual entrepreneurs who are engaged in sales of goods and rendering services for the corresponding registration. The patent to individual entrepreneurs, engaged in production of industrial output, is issued after their registration in territorial authorities of the state statistics.

1.9. Mutual information transfer about individual entrepreneurs based on Regulations on interaction of the Single state register of statistical units with departmental registers is performed on machine carriers at the scheduled time in the approved form.

II. Procedure for state registration of individual entrepreneurs

2. State registration (re-registration) of individual entrepreneurs is made in the following procedure:

2.1. Individual entrepreneurs represent to registering body:

- the statement for registration of the enclosed sample (appendix 1);

- passport. Foreign citizens the passport - in the presence in it marks about registration in law-enforcement bodies of the Kyrgyz Republic.

3. The registering body shall:

- check in the database of the Single state register of statistical units the name of the business entity created by the individual entrepreneur for case of its repeating;

- assign identification and classification codes;

- include information on the individual entrepreneur in the Single state register of statistical units;

- fill in the certificate on state registration (re-registration) and issue it to the individual entrepreneur personally under list (appendix 2);

4. The certificate on state registration (re-registration) is drawn up in four copies: first (original) is issued to the individual entrepreneur, the second (copy) remains in territorial authorities of the state statistics, third (copy) goes to territorial subdivisions of the State committee of the Kyrgyz Republic on taxes and fees, the fourth (copy) goes to the relevant territorial subdivisions of Social fund of the Kyrgyz Republic.

5. The granted certificate on state registration (re-registration) is considered valid in all territory of the Kyrgyz Republic. Copying and transfer of the certificate on state registration (re-registration) to other persons is forbidden.

III. Re-registration of the individual entrepreneur

6. The individual entrepreneur is subject to re-registration in the following cases:

- changes of core activity;

- changes of the residence;

- changes of the name of the business entity created by the individual entrepreneur.

7. The individual entrepreneur submits the following documents to registering body:

- the statement for re-registration of the individual entrepreneur of the enclosed sample;

- original of the certificate on state registration;

- passport.

The specified list of documents is provided in all cases of passing of re-registration.

IV. Termination of activities of the individual entrepreneur

8. The individual entrepreneur stops the activities based on own statement or the judgment.

The termination of activities of individual entrepreneurs is made by the rules applied in case of liquidation of legal entities.

V. Issue of the duplicate of the registration certificate (re-registration) of the individual entrepreneur

9. Based on the submitted documents and the statement of the individual entrepreneur the registering body makes issue of the duplicate of the certificate on state registration (re-registration).
