1. This Law governs the relations connected with provision of temporary disability benefits and to motherhood of the hired employee and person which independently provided itself with work establishes concept of temporary disability benefit and to motherhood of the hired employee and person which independently provided itself with work, types of temporary disability benefit, condition and procedure for calculation, appointment and allowance payment on temporary disability and motherhood of the hired employee and person which independently provided itself with work.
2. Provisions of this Law do not extend to military personnel, rescue employees, criminal and executive employees and forced contractors of court resolutions. In the period of temporary disability of persons specified in this part, their remuneration remains.
3. The relations connected with provision, appointment and allowance payment on motherhood to unemployed person (not being the hired employee or person which independently provided itself with work), are regulated by the Law of the Republic of Armenia "About public welfare payments".
1. The relations connected with temporary disability benefit and to motherhood are regulated by the Constitution of the Republic of Armenia, international treaties of the Republic of Armenia, the Law of the Republic of Armenia "About public welfare payments", this Law, the Tax code of the Republic of Armenia, other laws and other legal acts.
2. If international treaties of the Republic of Armenia establish other regulations than provided by this Law, then regulations of international treaties are applied.
1. Temporary disability benefit partially compensates the salary (income) lost (lost) owing to temporary disability the stipulated in Clause 4 presents of the Law of persons which (which) person received or could receive.
2. This Law establishes the following types of temporary disability benefit:
1) the benefit issued in case of the temporary disability which arose owing to disease (injury) (further - sickness benefit);
2) the benefit issued in case of the temporary disability which arose in connection with prosthetics (further - benefit in case of prosthetics);
3) the benefit issued in case of the temporary disability which arose due to the need of sanatorium treatment (further - benefit for sanatorium treatment);
4) ceased to be valid
5) the benefit issued in case of the temporary disability which arose in connection with disease (injury) of the family member caused by need of care of it (further - care allowance for a sick the family member).
3. By means of benefit on motherhood during maternity leave (availability of the right to leave) established by the Labor code of the Republic of Armenia the salary (income) lost by persons, the stipulated in Clause 4 presents of the Law as a result of the temporary disability which arose because of pregnancy and childbirth which person received or could receive is in parts or in full compensated.
