About adoption of the technical regulation of the Customs union "About safety of food products"

According to article 13 of the Agreement on the single principles and rules of technical regulation in the Republic of Belarus, the Republic of Kazakhstan and the Russian Federation of November 18, 2010 the Commission of the Customs union (further – the Commission) solved:

1. Accept the technical regulation of the Customs union "About safety of food products" (TR CU 021/2011) (is applied).

2. Ceased to be valid according to the Decision of Board of the Eurasian economic commission of 24.12.2019 No. 236

3. Establish:

3.1. The technical regulation of the Customs union "About safety of food products" (further - the Technical regulation) becomes effective since July 1, 2013, except for requirements to fish and fish products and the related processes of their production, storage, transportation, realization and utilization. Prior to the day of entry into force of the technical regulation of the Customs union establishing requirements and to the related processes of their production, storage, transportation, realization and utilization concerning such products and processes of its production, storage, transportation, realization and utilizations are effective provisions of regulatory legal acts of the Customs union or the legislation of state member of the Customs union;

3.2. The documents on assessment (confirmation) of compliance to the mandatory requirements established by regulatory legal acts of the Customs union or the legislation of state member of the Customs union, issued or accepted concerning products which are object of technical regulation of the Technical regulation (further - products), about day of entry into force of the Technical regulation, are valid before the termination of term of their action, but no later than February 15, 2015. The specified documents issued or accepted about day of official publication of this Decision are valid before the termination of term of their action;

From the date of entry into force of the Technical regulation issue or adoption of documents on assessment (confirmation) of compliance of products to the mandatory requirements which are earlier established by regulatory legal acts of the Customs union or the legislation of state member of the Customs union is not allowed;

3.3. Till February 15, 2015 production and release into the stream of commerce of products according to the mandatory requirements which are earlier established by regulatory legal acts of the Customs union or the legislation of state member of the Customs union in the presence of the documents on assessment (confirmation) of compliance of products specified to mandatory requirements, issued or accepted about day of entry into force of the Technical regulation is allowed;

The specified products are marked by national mark of conformity (market access mark) according to the legislation of state member of the Customs union or with the Decision of the Commission of September 20, 2010 No. 386;

3.3.1. Till July 1, 2014 production and release into the stream of commerce on customs area of the Customs union of products which were not subject about day of entry into force of the Technical regulation to obligatory assessment (confirmation) of compliance to the mandatory requirements established by regulatory legal acts of the Customs union or the legislation of state member of the Customs union without documents on obligatory assessment (confirmation) of compliance and not marked national mark of conformity (market access mark) are allowed.

3.4. The product circulation, released during action of the documents on assessment (confirmation) of compliance specified in subitem 3.2 of this Decision, and also products specified in subitem 3.3.1 of this Decision is allowed during the expiration date of products established according to the legislation of state member of the Customs union;

3.5. According to the procedure, stipulated in Article 24 Technical regulations, till February 15, 2015 the following products are subject to state registration:

1) natural table mineral water;

2) the butylated drinking water which is packed up in reservoir;

3) tonics;

4) nutritional supplements, complex dietary supplements, fragrances, plant extracts as vkusoaromatichesky substances and input products, starting cultures of microorganisms and bacterial ferments, technological supportive applications, including fermental medicines;

5) the foodstuff received with use of the gene engineering modified (transgene) organisms including genetically modified microorganisms;

3.6. Data on the production facilities which were earlier performing activities for production (production) of food products according to the legislation of state member of the Customs union are entered in the state register without holding procedures of state registration of production facilities according to the Technical regulation;

3.7. Provisions of Article 29 of the Technical regulation become effective from the moment of enforcement of the Integrated information system of foreign and mutual trade of the Customs union.

3.8. Co of day of entry into force of technical regulations of the Customs union on separate types of food products by modification of the Technical regulation are subject to refining of the name of types of food products according to the determinations established by such technical regulations and to exception of the safety requirement of products which are object of technical regulation of such technical regulations (except requirements to content of pathogenic microorganisms and their toxins, mycotoxins, toxic elements, nitrates, global pesticides, and also admissible level of radionuclides), and microbiological standard rates of safety (opportunistic microorganisms).

4. To the secretariat of the Commission jointly with the Parties:

4.1. Prior to the day of entry into force of technical regulations of the Customs union on separate types of food products to provide entering into the Technical regulation of changes according to subitem 3.8 of this Decision.

4.2. Prepare the draft of the Actions plan, necessary for implementation of the Technical regulation, and in three-months time from the date of entry into force of this Decision to provide representation it on approval of the Commission in accordance with the established procedure, having provided:

4.2.1. Preparation and representation on approval of the Commission in accordance with the established procedure till March 15, 2013 the draft decision about entering of changes into Single sanitary and epidemiologic and hygienic requirements to the goods which are subject to sanitary and epidemiological surveillance (control), the Commissions of the Customs union approved by the Decision of May 28, 2010 No. 299, regarding their exception them requirements to products which are object of technical regulation of the Technical regulation;

4.2.2. Preparation and representation on approval of the Commission in accordance with the established procedure till March 15, 2013 the draft decision about modification of the Single list of products which are subject to obligatory assessment (confirmation) of compliance within the Customs union with issue of single documents, No. approved by the Decision of the Commission of the Customs union of April 7, 2011 620, regarding exception from it of products which are object of technical regulation of the Technical regulation;

4.2.3. Preparation and representation on approval of the Commission in accordance with the established procedure till March 15, 2013 the draft decision about modification of the Single inventory, subject to sanitary and epidemiological surveillance (control) on customs border and customs area of the Customs union, No. approved by the Decision of the Commission of the Customs union of May 28, 2011 299, regarding exception from it of products which are object of technical regulation of the Technical regulation;

4.2.4. Preparation and representation on approval of the Commission in accordance with the established procedure the project of changes in procedures of renewal of the documents on assessment (confirmation) of compliance of products to the mandatory requirements which are earlier established by regulatory legal acts of the Customs union or the legislation of state member of the Customs union, issued or accepted before entry into force of the Technical regulation on documents on assessment (confirmation) of compliance of products to mandatory requirements of the Technical regulation, except as specified, when indicators and (or) their admissible levels do not match with the indicators and (or) their admissible levels specified in the Technical regulation;

4.2.5. Preparation and representation on approval of the Commission in accordance with the established procedure till March 15, 2013 the draft of the program for development (modification, review) and to introduction of interstate standards as a result of which application on voluntary basis observance of requirements of the Technical regulation, and also the interstate standards containing rules and methods of researches (testing) and measurements, including the rules of sampling necessary for application and execution of the Technical regulation and implementation of assessment (confirmation) of compliance of products is provided.

4.2.6. Preparation and representation on approval of the Commission in accordance with the established procedure till March 15, 2013 the draft decision about modification of the Single inventory, subject to veterinary control (supervision), No. approved by the Decision of the Commission of the Customs union of June 18, 2011 317, regarding exception from it of products relating according to the Technical regulation to the processed food products of animal origin;
