About adoption of the technical regulation of the Customs union "About safety of individual protection equipment"

(as amended on 30-03-2020)

According to article 13 of the Agreement on the single principles and rules of technical regulation in the Republic of Kazakhstan, the Republic of Belarus and the Russian Federation of November 18, 2010 the Commission of the Customs union (further – the Commission) solved:

1. Accept the technical regulation of the Customs union "About safety of individual protection equipment" (TR CU 019/2011) (is applied).

2. Ceased to be valid according to the Decision of Board of the Eurasian economic commission of 03.03.2020 No. 30.

3. Establish:

3.1. The technical regulation of the Customs union "About safety of individual protection equipment" (further – the Technical regulation) becomes effective since June 1, 2012;

3.2. The documents on assessment (confirmation) of compliance to the mandatory requirements established by regulatory legal acts of the Customs union or the legislation of state member of the Customs union, issued or accepted concerning products which are object of technical regulation of the Technical regulation (further – products), about day of entry into force of the Technical regulation, are valid before the termination of term of their action, but no later than February 15, 2014. The specified documents issued or accepted about day of official publication of this Decision are valid before the termination of term of their action.

From the date of entry into force of the Technical regulation issue or adoption of documents on assessment (confirmation) of compliance of products to the mandatory requirements which are earlier established by regulatory legal acts of the Customs union or the legislation of state member of the Customs union is not allowed;

3.3. Till February 15, 2014 production and release into the stream of commerce of products according to the mandatory requirements which are earlier established by regulatory legal acts of the Customs union or the legislation of state member of the Customs union in the presence of the documents on assessment (confirmation) of compliance of products specified to mandatory requirements, issued or accepted about day of entry into force of the Technical regulation is allowed.

The specified products are marked by national mark of conformity (market access mark) according to the legislation of state member of the Customs union or with the Decision of the Commission of September 20, 2010 No. 386.

Marking of such products single market circulation mark of state members of the Customs union is not allowed;

3.4. The product circulation, released during action of the documents on assessment (confirmation) of compliance specified in subitem 3.2 of this Decision is allowed during expiration date (service life) of products established according to the legislation of state member of the Customs union.

4. To the secretariat of the Commission jointly with the Parties to prepare the draft of the Actions plan, necessary for implementation of the Technical regulation, and in three-months time from the date of entry into force of this Decision to provide representation it on approval of the Commission in accordance with the established procedure.

5. To provide to the Russian side with participation of the Parties based on monitoring of results of application of standards preparation of offers on updating of the lists specified in Item 2 of this Decision and their representation at least once a year from the date of entry into force of the Technical regulation in the Secretariat of the Commission for approval by the Commission in accordance with the established procedure.

6. To the parties:

6.1. Prior to the day of entry into force of the Technical regulation to determine the state control (supervision) bodies responsible for implementation of the state control (supervision) of observance of requirements of the Technical regulation and to inform on it the Commission;

6.2. From the date of entry into force of the Technical regulation to provide carrying out the state control (supervision) of observance of requirements of the Technical regulation taking into account subitems 3.2 - 3.4 presents of the Decision.

7. This Decision becomes effective from the date of its official publication.

About safety of individual protection equipment

Preface

1. This technical regulation of the Customs union "About safety of individual protection equipment" (further - the technical regulation of the Customs union) is developed according to the Agreement on the single principles and rules of technical regulation in the Republic of Belarus, the Republic of Kazakhstan and the Russian Federation of November 18, 2010.

2. This technical regulation of the Customs union is developed for the purpose of establishment on single customs area of the Customs union single obligatory for application and execution of requirements to individual protection equipment, the ensuring free funds transfer of individual protection released on single customs area of the Customs union.

3. If concerning individual protection equipment other technical regulations of the Customs union establishing requirements to individual protection equipment are accepted, then individual protection equipment shall conform to requirements of these technical regulations of the Customs union which action extends to them.

1. Scope

1.1. This technical regulation of the Customs union is accepted for the purpose of providing in the territory of the Customs union of protection of life and health of citizens, environmental protection, and also the prevention of the actions misleading consumers.

1.2. This technical regulation of the Customs union extends to individual protection equipment, irrespective of country of source, earlier not being in operation (new) and released on single customs area of the Customs union.

Requirements to designing, production, operation, storage, transportation, realization and utilization of individual protection equipment are not regulated by provisions of this technical regulation of the Customs union and established by the legislation of state member of the Eurasian Economic Union (further - state member).

1.3. In this technical regulation of the Customs union as safety of individual protection equipment it is understood:

lack of inadmissible impact per capita and the environment, caused by use of individual protection equipment, including impact of materials of which they are made;

safety of the person in case of impact on it harmful (dangerous) factors in use the individual protection equipment which is listed below:

- mechanical impacts and general production pollution;

- harmful chemicals;

- the ionizing and not ionizing radiation;

- impact of the increased (lowered) temperature;

- impact of electric current, electric and electromagnetic fields;

- impact of biological factors (microorganisms, insects);

- the lowered visibility.

1.4. Individual protection equipment to which action of this technical regulation of the Customs union extends are given in appendix No. 1 to this technical regulation of the Customs union.

1.5. Individual protection equipment (components of individual protection equipment) are classified to destination depending on protective properties according to appendix No. 2 to this technical regulation of the Customs union.

1.6. Identification of individual protection equipment is performed by the following rules:

1) identification of individual protection equipment is made by the applicant, person performing functions of the foreign producer, the state supervision bodies (control), bodies exercising customs control, certification bodies of individual protection equipment (further - the identifying persons) in the following purposes:

establishment of belonging of individual protection equipment to coverage of this technical regulation of the Customs union;

the prevention of the actions misleading consumers (acquirers and users);

2) in case of identification are established:

types of individual protection equipment according to appendix No. 1 to this technical regulation of the Customs union;

the group and subgroup of protection provided by appendix No. 2 to this technical regulation of the Customs union;

the name of individual protection equipment according to Section 4 of this technical regulation of the Customs union;

3) for identification of individual protection equipment for the purpose of establishment of its belonging to coverage of this technical regulation of the Customs union the identifying person shall be convinced that the name of identifiable individual protection equipment corresponds to certain type or combination of the types provided by appendix No. 1 and Section 4 of this technical regulation of the Customs union, and purpose of protective properties corresponds to the group and subgroup of protection or their combination provided in appendix No. 2 to this technical regulation of the Customs union;

4) identification of individual protection equipment for establishment of their belonging to coverage of this technical regulation of the Customs union is carried out by visual comparison of type and the name of the individual protection equipment specified in marking on packaging or is direct on individual protection equipment, with the name and type provided by Section 4 and appendix No. 1 of this technical regulation of the Customs union;

5) for identification of individual protection equipment for the purpose of the prevention of the actions misleading consumers (acquirers, users), the identifying person shall be convinced that by results of the procedure of the identification provided by subitems 1-4 of this Item, the identifiable individual protection equipment corresponds to information specified in marking.

1.7. Action of this technical regulation of the Customs union does not extend to the following types of individual protection equipment, requirements to which safety are established by the relevant legislative and other documents of state member and the corresponding technical regulations of the Customs union:

1) the individual protection equipment used when holding sports meets;

2) specially developed individual protection equipment for divisions of fire protection and for the divisions providing mitigation of consequences of emergency situations of natural and technogenic nature;

3) specially developed individual protection equipment for use in the aircraft, space equipment and at underwater works;

4) specially developed individual protection equipment for use in the medical purposes and in microbiology;

5) the individual protection equipment used as samples when holding exhibitions and trade fairs;

6) the individual protection equipment developed or modified for protection against bacteriological (biological) agents and radioactive materials which can be used in the military purposes, from the toxic chemicals used in chemical weapon and chemical means for fight against mass riots, and also the components which are specially developed for them.

2. Determinations

In this technical regulation of the Customs union the following terms and their determinations are applied:

the shock-absorber - independent detail or the component of safety system intended for dispersion of the kinetic energy developed in case of fall from height;

biological factor - the microorganisms producers, living cells and disputes containing in bacterial medicines and their components; the pathogenic microorganisms and viruses capable to initiate infectious diseases; plants, insects, arachnoid, animal, capable to do harm to health in case of their impact on organism or hit in organism and on integuments;

harmful factor - factor which impact per capita can lead to his disease or deterioration in health;

time of protective action of individual protection equipment - period of time from the beginning of use of individual protection equipment by the user in the conditions of impact of harmful or dangerous factor until emergence of situation when the level of impact of harmful or dangerous factor on the user exceeds the established standard rates in the set conditions, and in case of mechanical impact in the set conditions will lead to violation of integrity of components of individual protection equipment;

decontamination of individual protection equipment - neutralization (neutralization, dilution) or removal of dangerous chemicals from individual protection equipment;

deactivation of individual protection equipment - removal (decrease) of radioactive pollution from individual protection equipment and their components;

disinfection of individual protection equipment - removal (decrease) of bacterial pollution from individual protection equipment and their components;

disinsection of individual protection equipment - removal of arthropods from individual protection equipment and their components;

protective helmet - the headdress intended for protection of the upper part of the head against damages by the falling objects, against impact of moisture, electric current, metal splashes;

protective kasketka - the headdress intended for protection of the upper part of the head against damage to result of blow about firm motionless objects;
