for the purpose of deepening and acceleration of integration processes in the Customs union within Eurasian economic community (further – the Customs union) and forming of the Common economic space,
in view of the provisions established by the Agreement on bases of harmonization of technical regulations of state members of Eurasian economic community of March 24, 2005, the Agreement on carrying out the coordinated policy in the field of technical regulation, sanitary and phytosanitary measures of January 25, 2008, the Agreement on the product circulation which is subject to obligatory assessment (confirmation) of compliance on customs area of the Customs union of December 11, 2009, the Agreement on mutual recognition of accreditation of certification bodies (assessment (confirmation) of compliance) and test laboratories (centers) performing assessment works (confirmation) of compliance of December 11, 2009 and the Agreement on the Commission of the Customs union of October 6, 2007
agreed as follows:
1. The concepts used in this agreement mean the following:
"the declaration of conformity to technical regulations of the Customs union" – the document which the manufacturer (person authorized by the manufacturer, the supplier, the seller) certifies compliance issued in the product circulation to requirements of technical regulations of the Customs union;
"declaring of compliance" – form of confirmation by the manufacturer (authorized by the manufacturer person, the supplier, the seller) compliance issued in the product circulation to requirements of technical regulations of the Customs union;
"single market circulation mark of state members of the Customs union" – the designation serving for informing acquirers and consumers on compliance issued in the product circulation to requirements of technical regulations of the Customs union;
"the certificate of conformity to technical regulations of the Customs union" – the document which the certification body (assessment (confirmation) of compliance) certifies compliance issued in the product circulation to requirements of technical regulations of the Customs union;
"certification" – form of obligatory confirmation by certification body (assessment (confirmation) of compliance) of compliance issued in the product circulation to requirements of technical regulations of the Customs union;
"the technical regulation of the Customs union" – the document establishing obligatory for application and execution on customs area of the Customs union of the requirement to products or to products and production processes connected with requirements to products, installation, adjustment, operation (use), storage, transportation (transportation), realization and utilization, approved by the Commission of the Customs union;
"the standard scheme of assessment (confirmation) of compliance" – set of the rules and procedures establishing standard methods of performance of works by assessment (confirmation) of compliance to technical regulations of the Customs union.
Other concepts used in this agreement are applied in the value established by the Agreement on carrying out coordinated policy in the field of technical regulation, sanitary and phytosanitary measures of January 25, 2008.
2. Action of this agreement does not extend to establishment and application of sanitary, veterinary and sanitary and phytosanitary measures.

5. For the purpose of ensuring comparability of results of assessment (confirmation) compliance of products to requirements of technical regulations of the Customs union of the Party pursue the coordinated policy aimed at providing unity of measurements.
1. For the purpose of forming of the regulatory legal base of the Customs union in the field of technical regulation of the Party create the single list of products concerning which mandatory requirements within the Customs union are established (further – the single list).
2. For products included in the single list concerning which technical regulations of the Customs union or technical regulations of Eurasian economic community did not become effective regulations of the legislation of the Customs union and legislations of the Parties in the field of technical regulation are effective.
3. The single list and procedure for its maintaining affirm the Commission of the Customs union (further – the Commission).
4. The parties do not allow establishment in the legislation of mandatory requirements concerning products which are not included in the single list.
1. Technical regulations of the Customs union are developed only concerning products included in the single list if concerning such products technical regulations of Eurasian economic community are not accepted.
In case of adoption of the technical regulation of Eurasian economic community concerning products on which the technical regulation of the Customs union is accepted action of the technical regulation of the Customs union or its corresponding part stops from the effective date the technical regulation of Eurasian economic community.
2. Technical regulations of the Customs union are developed and accepted for the purpose of providing on customs area of the Customs union of protection of life and (or) health of the person, property, the environment, life and (or) health of animals and plants, preventions of the actions misleading consumers and also for the purpose of ensuring energy efficiency and resource-saving.
Adoption of technical regulations of the Customs union in other purposes is not allowed.
